BLUE EARTH COUNTY, MINNESOTA
May 9, 2000
The County Board of Commissioners met in the Commissioners' Room at 2:00 p.m. Present were Chairperson Colleen Landkamer, Commissioner Tom McLaughlin, Commissioner Al Bennett, Commissioner Alvis More, Commissioner Lin Barnes, County Attorney Ross Arneson and County Administrator Dennis McCoy.
1. TRANSPORTATION WORKSHOP
Mr. Al Forsberg, Public Works Director; Mr. Roger Guenette, Advance Resources; Mr. Ken Saffert, City Engineer; Mr. Pat Hentges, City Manager and Mr. Jerry Books, Finance Director, were present and provided information for the Workshop.
A discussion was held on the report from Advance Resources for funding options for the North East Development Area Improvements (Victory Drive/Highway 14/C.S.A.H. #3 Improvement Project).
The meeting recessed at 3:49 p.m.
The meeting reconvened at 6:00 p.m.
2. AGENDA REVIEW
Commissioner Bennett moved and Commissioner More seconded the motion to approve the amended Agenda to include the Re-appointment of the County Engineer.

3. COMMISSIONERS’ REPORTS ON COMMITTEES
The Commissioners reported on committees they have attended since the last Board Meeting.
5. DM & E RAILROAD
Ms. Mary Dowd, Mankato; Ms. Gail Langsjoen, LeHillier and Mr. Mike Spellacy, Mankato, expressed concerns with the proposed Dakota, Minnesota & Eastern Railroad Project.
They were particularly concerned with the threatened closing of Sakatah Singing Hills State Trail and County Road 12.
6. PUBLIC HEARING ON COUNTY DITCH #77
Pursuant to publication, a Public Hearing was held for the Improvement of County Ditch #77. Blue Earth County Commissioners Colleen Landkamer, Alvis More, Linley Barnes, Tom McLaughlin and Al Bennett acting as the Drainage Authority pursuant to M.S. 103E.005, Subd. 9, held a Public Hearing, at the Blue Earth County Courthouse on April 20, 2000 and continued the hearing on May 9, 2000.
The Public Hearing was opened for public comments by Chairperson Landkamer at 6:30 p.m. on May 9, 2000.
Officials present included Land Records Director Sandra King, County Administrator Dennis McCoy, County Attorney Ross Arneson, Ditch Manager Craig Austinson, and Ditch Viewers: Mr. Obert Haldorson, Mr. Thomas Behrends, and Mr. Lowell Ross.
A listing of others present is included as part of the record. The proceedings were tape-recorded.
Mr. Tom Behrends, Ditch Viewer, read the amended Viewer’s report into the record.
All parties present were given an opportunity to express their concerns and opinions. Public comments were heard from: Mr. Duane Humber, Janesville; Mr. Francis Wingen, Janesville and Mr. Blaine Phillips, Janesville.
Chairperson Landkamer closed the public comment portion.
Commissioner More moved and Commissioner Barnes seconded the motion to approve the amended Redetermination of Benefits Report based on the following Findings of Fact:
- That proper notice was given to effected landowners, pursuant to Minnesota Statues 103E
- That the Viewers Report, as given and amended is hereby approved and shall take the place of all previous benefits and damages assessments from the date the order is filed.

Chairperson Landkamer officially closed the Public Hearing at 7:12 p.m., May 9, 2000. A transcript of this hearing is on file at the County Administrator’s Office, Courthouse, Mankato, MN.

Commissioner Barnes moved and Commissioner McLaughlin seconded the motion to approve an Application for License to Permit Large Assemblies, in accordance to the Blue Earth County Mass Gathering Ordinance, waiving the drinking water provision (as noted in the report), to the Mankato Symphony Orchestra, Inc. to hold a concert at the SMC Quarry, Mankato Township, on June 11, 2000.

Commissioner Bennett moved and Commissioner McLaughlin seconded the motion to approve an Application and Permit for a 1 to 4 Day Temporary On-Sale Liquor License to Mankato Symphony Orchestra, Inc., to be held on June 10-11, 2000 at the SMC Kasota Quarry, Mankato, Township.
