The County Board of Commissioners met in the Commissioners' Room at 9:00 a.m. Present were Chairperson Colleen Landkamer, Commissioner Tom McLaughlin, Commissioner Al Bennett, Commissioner Alvis More, Commissioner Lin Barnes, County Attorney Ross Arneson and County Administrator Dennis McCoy.

1. AGENDA REVIEW
Commissioner Bennett moved and Commissioner More seconded the motion to approve the amended Agenda to include a State Highway and Transportation Funding Resolution; Renewal Liquor Set-Up Permits; Discussion on a County Wood Chipper Policy and to Set Public Hearings for amendments to the Park Ordinance and the Well Ordinance. The motion carried. 2000-106
Mr. Craig Austinson, Ditch Manager, was present to discuss establishing a policy to cover the cost of expenses for repairs to the County’s wood chipper. Additional research will be gathered and brought back to the Board.

2. COMMISSIONERS’ REPORTS ON COMMITTEES
The Commissioners reported on committees they have attended since the last Board Meeting.

4. PLANNING AND ZONING
Mr. Veryl Morrell, Land Use & Natural Resources Administrator; Mr. Scott Salsbury, Land Use Planner and Mr. Bill Goebel, Land Use Specialist, presented the following Planning and Zoning items for the Boards consideration.
Commissioner More moved and Commissioner Bennett seconded the motion to approve the following Conditional Use Permit:

RESOLUTION GRANTING A
CONDITIONAL USE PERMIT
TO TRANSFER A DEVELOPMENT RIGHT
FROM THE SE 1/4 OF SW 1/4, SECTION 20, DECORIA TOWNSHIP
TO THE SW 1/4 OF THE SW 1/4, SECTION 20, DECORIA TOWNSHIP

WHEREAS, Leon E. Goebel and Mary F. Goebel, owners of the following real estate in the County of Blue Earth, Minnesota, to wit:

have signed a written agreement transferring residential development rights to Tom and Loretta Goebel; and

WHEREAS, Tom and Loretta Goebel have applied for a Conditional Use Permit to Transfer Development Rights from the Southeast Quarter of the Southwest Quarter, Section 20, Decoria Township to the Southwest Quarter of the Southwest Quarter Section 20, Decoria Township, an Agricultural Zoning District; and

WHEREAS, the Planning Agency of the County has completed a review of the application and made a report pertaining to said request (PC 05-00 ), a copy of said report has been presented to the County Board; and

WHEREAS, the Planning Commission of the County on the 1st day of March, 2000, following proper notice, held a public hearing regarding the request and, following the hearing, adopted a recommendation that the request for a Conditional Use Permit be granted; and

WHEREAS, the Blue Earth County Board of Commissioners finds that:

1. That the Transfer of Development Rights conforms with the County Land Use Plan.

2. That the Transfer of Development Rights will not degrade the water quality of the County.

3. That the Transfer of Development Rights will not adversely increase the quantity of water runoff.

4. That soil conditions are adequate to accommodate the Transfer of Development Rights.

5. That the Transfer of Development Rights does not create a potential pollution hazard.
6. That adequate utilities, access roads, drainage and other necessary facilities have been or are being provided.

7. That the Transfer of Development Rights will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted.

8. That the establishment of the Transfer of Development Rights will not impede the normal and orderly development and improvement of surrounding vacant property for predominant uses in the area.

9. That site specific conditions and such other conditions are established as required for the protection of the public’s health, safety, morals, and general welfare.

10. That the Notification Amendment to the Agricultural District States : “Owners of property, residents, other users of property in the agricultural zone, and neighboring properties adjacent to the agricultural zone may be subjected to inconvenience or discomfort arising from normal and accepted agricultural practices and operations including, but not limited to; noise, odors, dust, operation of aircraft and late night operation of farm machinery, the storage and application of manure, fertilizers, soil amendments, herbicides, and pesticides associated with normal agricultural operations.

Owners of Property, residents, other users of property in the agricultural zone, and neighboring properties to the agricultural zone, should be prepared to accept such inconveniences or discomfort from normal operations, and are hereby put on official notice, pursuant to MN Statutes, Chapter 561.19, that this declaration may prevent them from obtaining a legal judgement against such normal operations.”

NOW THEREFORE BE IT RESOLVED, by the Blue Earth County Board of Commissioners, that the request for a Conditional Use Permit, to Transfer Development Rights in an Agricultural Zoning District, is granted with the following condition:


1. The applicant must subdivide and record all divisions of land in accordance with the provisions of the County Subdivision Ordinance.

This resolution shall become effective immediately upon its passage and without publication.

Commissioner McLaughlin moved and Commissioner Barnes seconded the motion to approve the following Conditional Use Permit:

RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO
GRADE AND FILL TO CONSTRUCT A PRIVATE ACCESS ROAD TO A
NEW DWELLING SITE IN A C-1, CONSERVATION ZONED DISTRICT
IN THE SW 1/4 OF THE SE 1/4, SECTION 18, DECORIA TOWNSHIP


WHEREAS,
John and Dawn Thompson, owners of the following real estate in the County of Blue Earth to wit:

All of that part of the Southeast Quarter (SE1/4) of Section 18, Township107, Range 26, lying South and West of the Cobb River.

Parcel No. R35 14 18 452 001

have requested a Conditional Use Permit to grade and fill to create access to a new building site in a C-1, Conservation Zoned District; and,

WHEREAS, the Planning Agency of the County has completed a review of the application and made a report pertaining to said request (PC 06-00), a copy of said report has been presented to the County Board; and,

WHEREAS, the Planning Commission of the County on the 1st Day of March, 2000, following proper notice held a public hearing regarding the request and, following the hearing, adopted a recommendation that the request be approved; and,

WHEREAS,
the Blue Earth County Board of Commissioners finds:

1. The proposed use conforms with the County Land Use Plan.

2. The applicant has demonstrated a need for the proposed use.

3. The proposed use will not degrade the water quality of the County.

4. The proposed use will not adversely increase the quantity of water runoff.

5. The soils are adequate to accommodate the proposed use.

6. The proposed use does not create a potential pollution hazard.

7. Adequate utilities, access roads, drainage and other necessary facilities have been or are being provided.

8. Adequate measures have been or will be taken to provide sufficient off-road parking space to serve the proposed use.

9. The Conditional Use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted.

10. Establishment of the Conditional Use will not impede the normal and orderly development and improvement of surrounding vacant property for the predominate uses in the area.

11. Density of the proposed residential development is not greater than the density of the surrounding neighborhood or applicable zoning district.

NOW THEREFORE BE IT RESOLVED,
by the Blue Earth County Board of Commissioners, that the request to approve a Conditional Use Permit to grade and fill to create an access to a new building site in a C-1, Conservation Zoned District is hereby granted contingent upon the following conditions:

1. All construction activities shall be conducted in accordance with approved plans attached to this staff report.

2. Construction and Septic System Permits must be obtained before any construction commences on the site.

This Conditional Use Permit shall become effective immediately upon it’s passage and without publication.

Mr. Karl Duncanson, Applicant, made comments and answered questions from the Board. After discussion, Commissioner Bennett moved and Commissioner More seconded the motion to approve the following:

RESOLUTION GRANTING A CONDITIONAL USE PERMIT
TO CONSTRUCT THREE TOTAL CONFINEMENT SWINE BARNS
AT AN EXISTING FEEDLOT EXPANDING FROM 807 A.U. TO 1,615 A.U. LOCATED IN THE SOUTHWEST QUARTER OF THE SOUTHWEST QUARTER OF SECTION 31, BEAUFORD TOWNSHIP

WHEREAS, Karl Duncanson, owner of the following real estate in the County of Blue Earth, Minnesota, to wit:

The Southwest Quarter of the Southwest Quarter Section 31 Beauford Township T. 106 N. - R. 26 W.;

has applied for a Conditional Use Permit to construct three total confinement swine barns expanding an existing feedlot in an, Agriculture Zoning District; and

WHEREAS, the Planning Agency of the County has completed a review of the application and made a report pertaining to said request (PC-09-00 ), a copy of said report has been presented to the County Board; and

WHEREAS, the Planning Commission of the County on the 1st day of March, 2000, following proper notice, held a public hearing regarding the request and, following the hearing, adopted a recommendation that the request for a Conditional Use Permit be granted; and

WHEREAS, the Blue Earth County Board of Commissioners finds that:

1. That with proper management of the proposed barns and with proper manure application, the Conditional Use should not be injurious to the use and enjoyment of other property in the immediate vicinity designated for agricultural uses.

2. That with proper management of the proposed barns and with proper manure application, this facility should not constitute a pollution problem.

3. That the predominant use in the area is agriculture. The Conditional Use should not impede the normal and orderly development and improvement of surrounding vacant property for agricultural uses.

4. Adequate utilities, access roads, drainage and other necessary facilities have been or will be provided.

5. Adequate measures will be taken to provide sufficient off-road parking and loading space to serve the proposed use.

6. Soil conditions are adequate to accommodate the proposed request.

7. Proper facilities will be provided which will eliminate any traffic congestion or traffic hazard which may result from the proposed use.

8.
The feedlot is not greater than the feedlot standards allowed in the A, Agricultural Zoning District.

9. The proposed use is consistent with the County Land Use Plan.

10. That the proposed use does not include residential development.

11. That the proposed use does not include industrial development.


NOW THEREFORE BE IT RESOLVED, by the Blue Earth County Board of Commissioners, that the request for a Conditional Use Permit, to build three total confinement swine barns in an Agriculture Zoning District, is granted with the following conditions:

1. That the total confinement barns, conform with the site plan attached to this report PC 09-00.

2. That the feedlot, including all buildings and the proposed buildings, be located on a single, legally described parcel consisting of a minimum of forty contiguous acres. The parcel shall be a parcel of record, properly recorded in the Blue Earth County Land Records Office.

3. That the applicant must obtain a Blue Earth County Feedlot Permit and a Certificate of Compliance before any animals are placed in the barns.

4.
That the applicant obtain a Blue Earth County Construction Permit before building begins and within one year from the date the County Board of Commissioners approves the Conditional Use Permit. The permit shall be rendered invalid if application for a Construction Permit is not made within this one year period. Time extensions for Conditional Use Permits must be obtained from the County Board of Commissioners subsequent to a public hearing conducted by the Planning Commission.

5. That a perimeter footing drain tile be located at or below the bottom of the pit footings. The footing tile shall include one inspection pipe for each concrete pit. The native materials must be excavated and walls back filled with granular material (pit run gravel or equivalent).

6.
That application of manure be on the land documented in the aerial photos included in the State of Minnesota Application for Construction and Operation of an animal feedlot. The application of manure shall comply with standards set forth in Attachment A-1, Manure Management Summary and Attachment A-4, Manure Application Setbacks, as contained in staff report PC 09-00.

7. That the disposal of dead animals be consistent with the Minnesota Board of Animal Health regulations.

8. That the applicant provide an enclosed location for the pick up of dead animals before any animals are placed in the proposed barns.

9
. That adequate measures be taken to minimize or control offensive odor, fumes, dust, noise, or vibrations so that none of these will constitute a nuisance.

  1. That all manure storage structures must be designed by a registered engineer. A copy of
the designed plans must be submitted to Blue Earth County Environmental Services prior to the issuance of a construction permit.

  1. That an Environmental Assessment Worksheet be approved by the necessary agencies before a construction permit is issued.

  1. That the applicant will furnish an as-built plan report to Environmental Services verifying that the concrete manure storage structure was constructed per approved engineered design plan. Said as-built report shall be signed by a professional engineer registered in the State of Minnesota and will include the following: photographic documentation of reinforcing steel placement, collection of three sample concrete cylinders to be retained by the engineer / landowner for concrete compressive strength testing, and three batch tickets documenting the concrete design.

TO STORE AND LAND APPLY LIQUID MILK BYPRODUCT AND BIOSOLIDS LOCATED IN THE SOUTH HALF NORTHWEST QUARTER AND THE NORTHEAST QUARTER OF SOUTHWEST QUARTER ALL IN SECTION 23, McPHERSON TOWNSHIP

WHEREAS, David Ivers and Andy Drummer, owner of the following real estate in the County of Blue Earth, Minnesota, to wit:

have applied for a Conditional Use Permit to land apply liquid milk byproduct and biosolids on approximately 100 acres located in A, Agriculture and C, Conservation Zoning District;

WHEREAS, the Planning Agency of the County has completed a review of the application and made a report pertaining to said request (PC-11-00 ), a copy of said report has been presented to the County Board; and

WHEREAS, the Planning Commission of the County on the 1st day of March, 2000, following proper notice, held a public hearing regarding the request and, following the hearing, adopted a recommendation that the request for a Conditional Use Permit be granted; and

WHEREAS, the Blue Earth County Board of Commissioners finds that:

  1. That the proposed use conforms with the Land Use Plan.

  1. That with proper management, the proposed use will not degrade the water quality of the
County.


  1. That with proper management, the proposed use will not adversely increase the quantity of water runoff.

  1. That soil conditions are adequate to accommodate the proposed use.

  1. That the proposed use does not create a potential pollution hazard.

  1. That adequate utilities, access roads, drainage and other necessary facilities have been or are being proposed.

9. That adequate measures have been or will be taken to prevent or control offensive odor, fumes, dust, noise, and vibration, so that none of these will constitute a nuisance, and to control lighted signs and other lights in such a manner that no disturbance to neighboring properties will result.

NOW THEREFORE BE IT RESOLVED, by the Blue Earth County Board of Commissioners, that the request for a Conditional Use Permit to land apply liquid milk byproducts and biosolids, is granted with the following conditions:

  1. That all land application shall be done in conformance with all applicable MPCA rules.

  1. That all applicable MPCA Permits must be obtained prior to land application of wastewater or sludge.

  1. That all monitoring and testing procedures shall be continuous and as specified by MPCA regulations.

  1. That all separation distances from residences, seasonal water table, wells, wetlands, ditches, watercourses, tile inlets, etc., shall be as specified by MPCA Rules.

  1. That all equipment used in hauling wastewater and/or sludge shall be loaded and/or in such a manner as to minimize spillage onto public roadways. Excessive amounts of mud deposited on public roadways as a result of mud adhering to truck tires shall be removed by the applicant.

  1. That all spills shall be reported to the MPCA and Blue Earth County immediately.

  1. That if the operation becomes or creates a public nuisance or is out of compliance with the terms of the Conditional Use Permit or other required permits, the County Board may review, modify, or revoke the Conditional Use Permit.

  1. That this permit shall be effective for a period of five years, after which it will be reviewed by the Blue Earth County Board.

This resolution shall become effective immediately upon its passage and without publication.

Commissioner Barnes moved and Commissioner Bennett seconded the motion to approve the following:

RESOLUTION


WHEREAS, Blue Earth County installed 9-1-1 service in compliance with state law which requires that each County of the State implement 9-1-1 emergency telephone service by December 15, 1986; and,

WHEREAS, the Blue Earth County 9-1-1 planning committee developed the Blue Earth County 9-1-1 plan to meet the requirements of those public service agencies who’s services will be available by dialing 9-1-1; and,

WHEREAS, The 9-1-1 planning committee has recommended modifying the 9-1-1 County plan to have Automatic Number Identification (ANI) and Automatic Location (ALI) from two selective routers and to request a waiver to Minnesota Rules Chapter 1215.1400 and 1215.1500 so that an even number of Public Safety Answering Points can be used;

NOW THEREFORE, IT IS HEREBY RESOLVED, that the Blue Earth County Board of Commissioners hereby endorses the report of the County 9-1-1 Committee; and

BE IT FURTHER RESOLVED, The Board of Commissioners intends to have Automatic Number Identification (ANI) and Automatic Location Information (ALI) from two selective routers and requests approval of a waiver to Minnesota Rules Chapter 1215.1400 and 1215.1500 so that an even number of Public Safety Answering Points can be used; and

BE IT FURTHER RESOLVED The Board of Commissioners intends to modify the 9-1-1 contracts with the State of Minnesota and respective telephone companies to implement the approved changes to the 9-1-1 system and hereby authorizes Joint Service Administrator Jerome Huettl to sign such agreements on behalf of the County; and

BE IT FINALLY RESOLVED that a copy of this resolution be forwarded to the State of Minnesota Department of Administration for inclusion in the State’s copy of the Blue Earth County 9-1-1 plan.

Commissioner Barnes moved and Commissioner Bennett seconded the motion to approve the following:

RESOLUTION SUPPORTING
STATE LEGISLATIVE ACTION IN 2000 TO INCREASE STATE
HIGHWAY AND TRANSPORTATION FUNDING


WHEREAS, increasing state funding for growing highway and transportation needs is one of the most critical issues facing Minnesota, and

WHEREAS, highways throughout Minnesota are increasingly congested, are unsafe due to deterioration or outdated design, and often hinder economic growth due to poor condition and lack of capacity, and

WHEREAS, studies show that more than $8 billion in additional funding over the next ten years is needed to address state and county highway and bridge needs, and

WHEREAS, Minnesota’s continued economic vitality and high quality of life depend on the state immediately increasing investments in highway safety, maintenance, reconstruction and expansion,

NOW, THEREFORE, BE IT RESOLVED, the Blue Earth County Board of Commissioners commends Governor Jesse Ventura and Republican and Democrat legislative leaders for offering a variety of significant highway and transportation funding proposals for consideration during the 2000 legislative session, thus making transportation a legislative priority for the first time in more than a decade, and

BE IT FURTHER RESOLVED, the Blue Earth County Board of Commissioners strongly urges Governor Ventura and the State Legislature to complete the good work they have begun and dedicate themselves to approving significant long term highway and transportation funding legislation in the 2000 legislative session by dedicating 100% of MVET to highways and transportation.

Commissioner Bennett moved and Commissioner McLaughlin seconded the motion to set Public Hearings for an amendment to the Blue Earth County Well Ordinance to be held at 10:30 a.m. on April 18, 2000, Boardroom, Courthouse and an amendment to the Park Ordinance to be held at 6:00 p.m. on May 9, 2000, Boardroom, Courthouse. Commissioner Bennett moved and Commissioner More seconded the motion to approve Renewal of Consumption & Display Permits to Mankato Labor Temple Association, South Bend Township; Minneopa Golf Club, South Bend Township and L.B.’s Inc., Garden City Township. The motion carried. 2000-118
Commissioner More was excused to teach an agricultural class at Kennedy School.

5. HUMAN SERVICE
Mr. Bob Meyer, Human Service Director, presented the following Human Service items for the Board’s consideration.
Commissioner Bennett moved and Commissioner Barnes seconded the motion to approve the following:
Family Service Collaborative Grant

A grant award with the State of Minnesota, Department of Children, Family, and Learning, in the amount of $34,000.00. This grant is for the period of July 1, 1999, to June 30, 2000, and represents the final year of funding for the expansion portion of the Family Service Collaborative funding. This funding has historically supported staffing of the South Central Children’s Project.

Health Alert Network

A grant award with the State of Minnesota, Department of Health, in the amount of $4,200.00. This grant is awarded to each local public health office in the state to connect, via the internet, to form a network of public health officials to respond to threats of bioterrorism and disease outbreaks.

Residential Program (Rule 34) Application for Need Determination

REM-Heartland, Inc., is requesting a one-time rate increase to address staffing issues in their facility. REM continues to serve clients with multiple needs and requiring additional staff resources.

Medicare Provider Enrollment Application

Authorize Board chair signature on a Medicare Provider Enrollment Application for Daniel Zenga. Submission of this application will result in a Medicare provider number being secured and allow the department to recover Medicare reimbursements for mental health services provided by Dr. Zenga.

Senior Volunteer Transportation Reimbursement

Approval of a 3¢ increase in the per-mile reimbursement from 37_¢ per mile to 40_¢ per mile effective March 1, 2000, with bimonthly reviews conducted by Human Services staff through the end of calendar year 2000 to determine whether additional adjustments are warranted for the Senior Transportation Program.

Sexual Violence Resource Center Continuation Funds Application

A grant application for continuation funding from the Minnesota Center for Crime Victims’ Services for the Sexual Violence Resource Center. Blue Earth County is eligible to receive $47,000.00 for continuation of the community-based sexual assault program.

Sexual Violence Resource Center Enhancement Grant Application

A grant application to enhance sexual violence prevention services from the Minnesota Center for Crime Victims’ Services. The Sexual Violence Resource Center has developed a proposal seeking these enhancement funds to address the developmentally disabled and mentally ill populations, who are currently underserved. This grant would result in the development of a training curriculum that will be used to train staff who work with the developmentally disabled and mentally ill.

Task Force Appointments

Approve the following youth representative appointments. Appointment of Nora Myers to the Human Service Advisory Committee representing commissioner district 2. Appointment of Nicole Engeswick to the Mental Health Task Force representing commissioner district 5.

Commissioner Barnes moved and Commissioner McLaughlin seconded the motion to approve the following Public Health Week Proclamation:

RESOLUTION FOR NATIONAL PUBLIC HEALTH WEEK

WHEREAS, over the past 50 years, the United States has achieved significant increases in life expectancy and reductions in the incidence of injury, disability and disease.

WHEREAS,
of the additional 50 years of life expectancy that we have gained since the turn of the century, the public health approach to improving our health status is credited with approximately half of this gain.

WHEREAS,
the use of population-based strategies for disease and injury prevention, public health has contributed to the decline in illness and injury, including heart disease, stroke, tobacco-related diseases, infectious disease, and motor vehicle and workplace injuries.

WHEREAS,
the National Public Health Week theme – Healthy People in Healthy Communities – provides an opportunity to highlight and encourage the efforts of public health professionals to protect, promote and enhance the health of all citizens in communities across the country. Examples of such efforts include the elimination of polio, reduction of lead in childhood blood levels, decline in tooth decay through fluoridated water supplies, immunizations against infectious diseases, improving nutritional standards, and improving prenatal care.

NOW, THEREFORE, BE IT RESOLVED
that Blue Earth County proclaims April 3-9, 2000 as National Public Health Week, and commends this observance to our community.

6. BOARD PLANNING WORKSHOP
Mr. Tim Hayes, Director of Library Services, and Ms. Kathryn Nerem-Roth, Public Information Coordinator, gave an update on the Blue Earth County Library System.
Mr. Steve Michel, Physical Plant Director, gave an update on building projects, including the former Group Home on Jackson Street.
