BLUE EARTH COUNTY, MINNESOTA
October 24, 1995
The County Board of Commissioners met in the Commissioners'
Room at 9:00 a.m. Present were Chairperson Leon Tacheny,
Commissioner Colleen Landkamer, Commissioner Lin Barnes,
Commissioner Al Bennett, Commissioner Alvis More, County Attorney
Ross Arneson and County Administrator David Twa.
Commissioner Barnes moved and Commissioner Bennett seconded
the motion to approve the amended Agenda. The motion carried.

The Commissioners reported on committees that they have
attended since the last Board meeting.
Ms. Kris Juliar, Deputy Director, and Ms. Allison McKenzie,
Director-Small Business Development Center, gave an update on
services provided by Region Nine Development Commission. They
requested funding for the Small Business Development Center. The
Board will discuss the request at a future budget workshop.
Mr. Rick Hanna, Land Use & Natural Resources Administrator,
and Ms. Julie Conrad, Land Use & Natural Resources Planner,
presented the following Planning and Zoning items.
A preliminary plat was reviewed for a two lot subdivision,
Sections 16 and 21, LeRay Township from Mr. Darrell Anderegg.
Commissioner Barnes moved and Commissioner More seconded the
motion to approve the following Conditional Use Permit:
RESOLUTION
GRANTING A CONDITIONAL USE PERMIT FOR
MINERAL EXTRACTION IN
SECTION 27 AND SECTION 28
SOUTH BEND TOWNSHIP
WHEREAS, Southern Minnesota Construction Company, Inc., leasee of
the following real estate in Blue Earth County to wit:
The South 40 acres of Government Lot 6 in Section 28,
has applied for a permit to extract gravel in a C-1 Conservation
Zoning District and an A-1 Agricultural Zoning District; and,
WHEREAS, the Planning Agency of the County has completed a review
of the application and made a report pertaining to said request
(CO 54-95), a copy of said report has been presented to the
County Board; and
WHEREAS, the Planning Commission of the County on the 12th day of
October, 1995, following proper notice held a public hearing
regarding the request and, following the hearing, adopted a
recommendation that the request be granted; and
WHEREAS, the Blue Earth County Board of Commissioners finds:
1. That the Conditional Use will not be injurious to the use
of other property in the immediate vicinity for the purposes
already permitted.
2. That the establishment of the Conditional Use will not
impede the normal and orderly development of surrounding
vacant property for predominant uses in the area.
3. That adequate utilities, access roads, drainage and other
necessary facilities have been or are being provided.
4. That adequate measures have been or will be taken to provide
sufficient off-street parking and loading space to serve the
proposed use.
5. That adequate measures have been or will be taken to prevent
or control offensive odor, fumes, dust, noise and vibration,
so that none of these will constitute a nuisance.
6. That soil conditions are adequate to accommodate the
proposed use.
7. That proper facilities will be provided to eliminate any
traffic congestion or traffic hazard which may result from
the proposed use.
8. That no residential development is proposed.
9. That the intensity of proposed mineral extraction
development is not greater than the intensity of the
surrounding uses or not greater than the intensity
characteristic of the applicable Zoning District.
10. That the proposed use is consistent with the County Land
Use Plan.
11. That the applicant has demonstrated need for the proposed
use.
12. That the reclamation plan is adequate to reclaim the site.
NOW THEREFORE BE IT RESOLVED, by the Blue Earth County Board of
Commissioners, that the request for a conditional use permit for
mineral extraction in a Conservation Zoning District, and in an
Agricultural Zoning District is granted with the following
conditions:
1. That the mining operations shall be conducted in compliance
with the laws of the State of Minnesota and the Federal
Government, especially as related to safety standards, and
ordinances and resolutions of Blue Earth County, as amended
from time to time, and in compliance with and furtherance of
the approved reclamation plan for the affected land.
2 That the sand and gravel extraction operation shall be setback
as follows:
a. Fifty (50) feet to the boundary of an adjoining property
line, unless the written consent of the owner of such
adjoining property is first secured.
b. Dust and noise producing processing or loading shall not
be conducted closer than three hundred (300) feet to the
boundary of any residential structures existing prior to
the implementation of the reclamation plan.
c. Excavating or stockpiling shall not be conducted closer
than one hundred (100) feet to the right-of-way line of
any existing or platted street, road, or highway, where
such excavation may create a traffic or line of site
problem.
3. That the clearing of the mining site shall conform to the
development and reclamation plan whenever possible. Existing
trees and shrubs shall remain in their natural state and not
prematurely stripped.
4. That existing trees and ground cover along public road
frontage shall be preserved, maintained, and supplemented for
the depth of the required roadside setback.
5. That the access point shall be clearly identified 1,000 feet
in both directions and signed to indicate that slow moving
trucks are entering the roadway.
6. Trucks used in hauling materials from the site of excavation
shall be loaded in such manner as to minimize spillage onto
public highways. Any spillage resulting from overloading or
from adhering to truck tires shall be removed at regular
intervals.
7. Operating procedures will be utilized to control dust and
noise so as not to be in conflict with adjoining property.
8. Upon completion of excavation, all buildings, plants, and
equipment shall be removed within six (6) months, unless such
buildings, plants, and equipment will be used in the
reclamation process.
9. Graded or backfilled areas and banks shall conform to the
approved reclamation plan. The backsloping shall not be less
than three (3) feet horizontal to one (1) foot vertical.
10. All exposed surface area shall be reclaimed by covering with
topsoil and seeding with legumes, grasses, or other ground
cover to prevent wind and water erosion.
11. That the owner coordinate the planting of trees on the
reclaimed 3:1 slopes with the SWCD's annual tree planting
program.
12. That a reclamation performance bond in the amount of $1,000
per acre bond be filed with the County Administrator, payable
to the County, as assurance for the completion of the approved
reclamation plan.
13. That if the County Engineer determines that acceleration and
deceleration lanes are required then the applicant will fund
the design, acquire the right of way and construct right turn
lanes and left turn bypass lanes to State Aid standards.
This resolution shall become effective immediately upon its passage
and without publication.

Commissioner Bennett moved and Commissioner Landkamer seconded
the motion to approve the following Conditional Use Permit:
RESOLUTION GRANTING A
CONDITIONAL USE PERMIT
FOR A MANUFACTURED HOME
SECTION 26, LERAY TOWNSHIP
WHEREAS, Paul Sieberg, owner of the following real estate in
Blue Earth County, Minnesota, to wit:
The West 264.00 feet of the South Half of the Southwest
Quarter of the Northwest Quarter of Section 26 Township 108
North Range 25 West, Blue Earth County, Minnesota. Said
tract contains 4.0 acres, Reserving therefrom an easement
for access purposes over and across the northerly 16.5 feet.
has applied for a conditional use permit to put a manufactured
home in an A-2, Limited Agriculture Zoning District; and
WHEREAS, the Planning Agency of the County has completed a
review of the application and made a report pertaining to said
request (AH 06-95), a copy of said report has been presented to
the County Board; and
WHEREAS, the Planning Agency of the County on the 19th day
of October, 1995, following proper notice, held an
administrative, public hearing regarding the request; and
WHEREAS, the Blue Earth County Board of Commissioners finds
that:
1. The Conditional Use will not be injurious to the use and
enjoyment of other property in the immediate vicinity.
2. Establishment of the Conditional Use will not impede the
normal and orderly development and improvement of
surrounding vacant property for the predominate uses in the
area.
3. Adequate utilities, access roads, drainage and other

construct a new home and have adequate living space for his
family.
NOW THEREFORE BE IT RESOLVED, by the Blue Earth County
Board of Commissioners, that the request for a Conditional Use
Permit for the use of a manufactured home, in an A-2, Limited
Agriculture Zoning District, is granted with the following
conditions:
1. That the manufactured home be installed in conformance with
State of Minnesota manufactured home installation
requirements.
2. That a conforming on-site sewage treatment system be
installed prior to occupancy of the mobile home.
3. That the applicant remove and properly dispose of the
manufactured home when the existing structure is ready for
occupancy or a new structure built.
4. That any change in the use from that stated on the permit
shall be cause for review and at which time the permit may
be continued, modified or terminated.
5. That the Conditional Use Permit shall be valid for a period
of five years, until October 25, 2000, after which time the
permit shall be reviewed and may be continued, modified, or
terminated.
6. That the applicant continue cleaning up the site and
properly disposing of all solid waste, demolition debris and
new construction waste materials.
This resolution shall become effective immediately upon its
passage and without publication.

the motion to approve the following:
RESOLUTION GRANTING A CONDITIONAL USE PERMIT
TEMPORARY USE OF A MOBILE HOME
SECTION 20, LERAY TOWNSHIP
WHEREAS, Robert Cords, owner of the following real estate in
the County of Blue Earth, Minnesota, to wit:
The South 10 acres of the East 40 acres of the Southwest
Quarter of Section 20, T108N, R25W, and the South 5 acres of
the West 20 acres of the Southeast Quarter of Section 20,
T108N, R25W.
has applied for a Conditional Use Permit for temporary use of a
mobile home in an A-1 Prime Agriculture Zoning District, and
WHEREAS, the Planning Agency of the County has completed a
review of the application and made a report pertaining to said
request (AH 07-95 ), a copy of said report has been presented to
the County Board; and
WHEREAS, the Planning Agency of the County on the 19th day
of October, 1995, following proper notice, held an administrative
public hearing regarding the request and, following the hearing,
adopted a recommendation that the request for a conditional use
permit be granted; and
WHEREAS, the Blue Earth County Board of Commissioners finds
that:
1. That the Conditional Use will not be injurious to the
use and enjoyment of other property in the immediate
vicinity for the purposes already permitted.
2. Establishment of the Conditional Use will not impede

surrounding vacant property for predominant uses in the
area.

WHEREAS, Allen Hanson, owner of the following real estate in Blue
Earth County, Minnesota, to wit:
Five acres, more or less, in the East Half of the southwest
Quarter of Section 36-108-28, being the "William More
homesite" and approximately described as follows: A tract
of land bounded by the following lines: southline of
property shall run east and west 200 feet south of the
south-west corner of the barn. West line of property shall
run north and south 280 feet west of the south-west corner
of the barn. North line of property shall run east and west
325 feet north of the south-west corner of the barn. East

the motion to approve an agreement for Mankato State University
faculty in the College of Social and Behavioral Science to
provide professional and technical services as needed by the

Commissioner Landkamer moved and Commissioner More seconded
the motion to approve the Minnesota Valley Action Council's Blue
Earth County Housing Rehab Report. The motion carried. 95-343
Commissioner Landkamer moved and Commissioner Barnes
seconded the motion to approve the following proclamation:
Whereas competitive sports is helpful in teaching the
principles of sportsmanship and fair play thereby
contributing to better citizenship; and
The Happy Chef Fast Pitch Softball Team has won the
American Softball Association (ASA) Men's Class A
National Tournament.
The citizens of Blue Earth County wish to
congratulate and recognize these exciting
accomplishments; and
It is appropriate to designate Tuesday, November 7,
1995, as
"HAPPY CHEF FAST PITCH SOFTBALL TEAM DAY!"
Now, Therefore, Be It Resolved, by the Blue Earth
County Board of Commissioners that the Happy Chef Fast
Pitch Softball Team be congratulated on behalf of the
entire County of Blue Earth on their outstanding
athletic accomplishments!
Be it further resolved, that Tuesday, November 7, 1995
is hereby proclaimed
"HAPPY CHEF FAST PITCH SOFTBALL TEAM DAY!"

Mr. David Twa, County Administrator, presented the September
30, 1995 Financial Report as an informational item.
Mayor Jerry Groebner, Madison Lake; Sam and Mary Jo Shelton,
and Mr. Jerry Books, Finance Director, presented the following
item for the Boards consideration.
Commissioner More moved and Commissioner Bennett seconded
the motion to approve a five year, $30,000 Small Cities Loan to
the City of Madison Lake for Sam and Mary Jo Shelton's Sakatah
Trail Campground. The motion carried. 95-345
Mr. Dennis McCoy, Deputy County Administrator, presented the
following Human Services items.
Commissioner Landkamer moved and Commissioner Bennett
seconded the motion to approve the following Human Services
contracts:
Agreement with the State Department of Corrections to
receive funding in the amount of $5,000 to conduct
regional training for sexual assault service program
advocates.
The 1995 Legislature amended the statutes to allow
boards of health to relinquish their authority to
perform lead inspections. The Minnesota Department of
Health must perform lead inspections in any
jurisdiction for which the Board of Health relinquishes
inspection authority. The local Board of Health
retains responsibility for any cases that were
identified prior to the date of the letter from the
Board of Health. The Board relinquishes the authority
to perform lead inspections effective October 24, 1995.
Approve the Child and Teen Checkup administrative
services contract between the Minnesota Department of
Human Services and the County. This agreement is for
calendar year 1996 and is projected to generate
$64,510.00.

October 12, 1995 Human Service Advisory Committee's report.
