The County Board of Commissioners met in the Commissioners' Room at 9:00
a.m. Present were Chairperson Keith Stoltzman, Commissioner Colleen
Landkamer, Commissioner Leon Tacheny, Commissioner Lin Barnes, Commissioner
Alvis More, County Attorney Ross Arneson and County Administrator David
Twa. 

Commissioner More moved and Commissioner Landkamer seconded the motion to
approve the amended Agenda. The motion carried. 94-650

Mr. Joel Anderson, DNR Area Wildlife Manager, presented the following item
for the Boards consideration. 

Commissioner Barnes moved and Commissioner Landkamer seconded the motion to
approve the following land acquisition pending the Soil & Water
Conservation Supervisor's approval: 

BLUE EARTH COUNTY
BOARD OF COUNTY COMMISSIONERS
REVIEW OF PROPOSED STATE WILDLIFE LAND ACQUISITION 

In accordance with Minnesota Statutes 97A.145 Subd. 2, the Commissioner of
the Department of Natural Resources on December 20, 1994 provided the
County Board and the appropriate town officers with a description of lands
to be acquired by the State of Minnesota for water and wildlife
conservation purposes. Lands to be acquired are described as follows:

That portion of Government Lot 4 of Section 36, Township 108 North, Range
25 West, Blue Earth County, described as follows:

Commencing at the south quarter corner of said Section 36: thence on an
assumed bearing of South 89 degrees 30 minutes 29 seconds West, 1384.34
feet along the south line of said Government Lot 4 to the point of
beginning: thence North 00 degrees 06 minutes 52 seconds West, 159.00 feet:
thence North 66 degrees 54 minutes 03 seconds East, 255.8 feet; thence
North 46 degrees 04 minutes 41 seconds East, 158.06 feet; thence North 89
degrees 08 minutes 57 seconds East, 370.72 feet; thence North 04 degrees 54
minutes 20 seconds East, 504.29 feet; thence North 58 degrees 49 minutes 47
seconds East, 141.98 feet; thence North 18 degrees 07 minutes 44 seconds
East, 142.8 feet: thence East 48.9 feet, thence southerly approximately
1052.6 to a point on the South line of said Government Lot 4; thence South
89 degrees 30 minutes 29 seconds West, approximately 930 feet to point of
beginning. 

IT IS HEREBY RESOLVED, by the Board of County Commissioners of Blue Earth
County on December 20, 1994 that the State's proposed acquisition of the
above described property be approved.

Mr. Al Forsberg, Public Works Director, presented the following item for
the Boards consideration. Commissioner Landkamer moved and Commissioner
Tacheny seconded the motion to approve the purchase of 0.68 acres of land
including a 110 foot timber trestle from CMC Heartland Inc., Chicago,
Illinois, in the amount of $8,500. The land is located at the intersection
of Dewey & Patterson, Mankato. The timber from the trestle will be used to
restore the Red Jacket Trail Trestle. 94-652 

Mr. David Twa, County Administrator, presented the following items for the
Boards consideration.

approve the December 13, 1994 Board Minutes. The motion carried. 94-653

Commissioner Tacheny moved and Commissioner More seconded the motion to
approve the following Bills:

Commissioner Tacheny moved and Commissioner Barnes seconded the motion to
approve the following Personnel items: 

Employment of Jozette Bruender as a License Center Specialist 1 (B21), with
starting salary of $9.18 per hour effective December 23, 1994. (License
Center) 

The elimination of both Section Coordinator positions within Land Records
Department and the establishment of two Land Records Specialist positions
effective January 3, 1995. (Land Records)

Commissioner Landkamer moved and Commissioner Barnes seconded the motion to
approve the 1995 Tax levy: 

WHEREAS, Minnesota Statutes 375A.06 require that the proposed property tax
levy for the coming year be certified to the County Auditor by December 28,
and 

WHEREAS, the County Administrator has prepared and the County Board has
adopted a proposed 1995 County budget including the property tax levy;

NOW THEREFORE BE IT RESOLVED, that the following 1995 property tax levy of
$11,924,294.00 be certified to the Blue Earth County Auditor.

Commissioner Tacheny moved and Commissioner More seconded the motion to
approve the 1995 Tax Budget: 

WHEREAS, Minnesota Statutes 375A.06 provides that the County Administrator
shall prepare and submit to the County Board a proposed budget and
long-range capital expenditure program including detailed estimates of
revenue and expenditures and enforce the provisions of the budget when
adopted by the County Board, and 

WHEREAS, the County Administrator has prepared such documents and the
County Board has met in regular sessions for the purpose of adopting an
adequate budget for maintenace of the administrative agencies of county
government for fiscal year 1995, and

WHEREAS, the County Board has come to the conclusion that the budget so
prepared is adequate and according to form prescribed by Minnesota
Statutes; 

NOW, THEREFORE BE IT RESOLVED, that the preliminary budget of
$43,294,993.00 be adopted and certified to the County Auditor this 13th Day
of December, 1994:

Statement as an informational item. 

Commissioner Landkamer moved and Commissioner Tacheny seconded the motion
to approve a Tax Abatement to Mr. Roger Guenette, 625 Byron Street,
Mankato, Minnesota, R01-09-18-351-003 K-0012417. The motion carried. 94-658

Mr. Rick Hanna, Land Use & Natural Resources Administrator, Ms. Julie
Conrad, Land Use & Natural Resources Planner and Mr. Jerry Floren, Land Use
& Natural Resources Feedlot Specialist, presented the following Planning &
Zoning items. 

Commissioner Landkamer moved and Commissioner More seconded the motion to
approve the following:

A RESOLUTION
APPROVING FINAL PLAT
REGISTERED LAND SURVEY NO. 129
LERAY TOWNSHIP

WHEREAS, the owners of the property included in the plat of Registered Land
Survey No. 129 has submitted a final plat for approval; and,

WHEREAS, the final plat was reviewed by the Blue Earth County Planning
Commission; and,

WHEREAS, the final plat meets the requirements of the Blue Earth County
Subdivision Ordinance.

NOW, THEREFORE, BE IT RESOLVED that the Blue Earth County Board of
Commissioners hereby approve the final plat of Registered Land Survey No.
129, and authorizes the Chair of the Board of Commissioners and the County
Administrator to sign said plat. 

This resolution shall become effective immediately upon its passage and
without publication.

Commissioner Tacheny moved and Commissioner More seconded the motion to
approve the following Final Plat: 

RESOLUTION GRANTING
FINAL PLAT APPROVAL
Dittberner Subdivision
Section 27, Mankato Township

WHEREAS, the owners of the following real estate in the County of Blue
Earth, Minnesota, to wit: 

East Half of the Northwest Quarter of Section 27, Mankato Township, T108N,
R26W

have submitted a final plat for approval as Dittberner Subdivision, and

WHEREAS, the Planning Agency of the County has completed a review of the
application and made a report pertaining to said request (CO 68-94), a copy
of said report has been presented to the County Board; and

WHEREAS, the Planning Commission of the County on the 7th day of December,
reviewed the final plat and found it to be in conformance with the approved
preliminary plat; and 

WHEREAS, the Blue Earth County Board of Commissioners finds that:

1. There are adequate service utilities available. 

2. The site is not located in a floodplain or shoreland. 

3. The soils are suitable for residential development in 
accordance with current standards.

4. The area of each lot meets the minimum standards of the 
County Zoning Ordinance and Subdivision Ordinance. 

5. The proposed subdivision is consistent with the County 
Land Use Plan.

6. All conditions of preliminary plat approval have been 
addressed in the final plat review.

NOW THEREFORE BE IT RESOLVED, the Blue Earth County Board of Commissioners
hereby approve the final plat of Dittberner Subdivision, and authorizes the
Chair of the Board of Commissioners and the County Administrator to sign
said plat.

Commissioner Landkamer moved and Commissioner Barnes seconded the motion to
approve the following Final Plat: 

RESOLUTION GRANTING
FINAL PLAT APPROVAL
MADSEN HOBBY ACRES SUBDIVISION
SECTION 17, BUTTERNUT VALLEY TOWNSHIP

WHEREAS, Don Madsen owner of the following real estate in the County of
Blue Earth, Minnesota, to wit: 

That part of Government Lot 3 and Government Lot 4, Northwest Quarter of
the Southwest Quarter Section 17, Butternut Valley Township.

has submitted a final plat for approval as Madsen Hobby Acres, and

WHEREAS, the Planning Agency of the County has completed a review of the
application and made a report pertaining to said request (CO 71-94), a copy
of said report has been presented to the County Board; and

WHEREAS, the Planning Commission of the County on the 7th day of December,
reviewed the plat and recommended approval of both the preliminary and
final plat; and 

WHEREAS, the Blue Earth County Board of Commissioners finds that:

1. There are adequate service utilities available. 

2. The site is located in shoreland of Lake Armstrong and 
meets requirements for County Shoreland Ordinance at this time.

3. The soils are suitable for residential development in 
accordance with current standards.

4. The area and dimensions of each lot meet the minimum 
standards of the County Zoning Ordinance and Subdivision Ordinance.

5. The proposed subdivision is consistent with the County 
Land Use Plan.

NOW THEREFORE BE IT RESOLVED, the Blue Earth County Board of Commissioners
hereby approve the final plat of Madsen Hobby Acres, and authorizes the
Chair of the Board of Commissioners and the County Administrator to sign
said plat.

Commissioner Tacheny moved and Commissioner Landkamer seconded the motion
to approve the Preliminary Plat of Alexandria Subdivision, a one lot
subdivision located in the Northeast Quarter of Section 34, to Lee and
Marion Cox, Shelby Township subject to approval by Shelby Township. The
motion carried. 94-662

Commissioner Barnes moved and Commissioner Tacheny seconded the motion to
approve the following Conditional Use Permit: 

RESOLUTION GRANTING A CONDITIONAL USE PERMIT FOR 
THE CONSTRUCTION OF AN EARTHEN BASIN
IN AN AGRICULTURE ZONING DISTRICT
SECTION 7, SHELBY TOWNSHIP

WHEREAS, Howard and Dan Fox, owners of the following real estate located in
Blue Earth County, Minnesota, to wit: 

The East Half of Section 7, except 2 acres of highway, of Township 105
North, Range 28 West, said parcel containing 318 acres

have applied for a conditional use permit to allow the construction of an
earthen basin in an A-1, Prime Agriculture Zoning District; and

WHEREAS, the Planning Agency of the County has completed a review of the
application and made a report pertaining to said request (CO 74-94), a copy
of said report has been presented to the County Board; and

WHEREAS, the Planning Commission of the County on the 7th day of December,
1994, following proper notice, held a public hearing regarding the request
and, following the hearing, adopted a recommendation that the request for a
conditional use permit be granted; and

WHEREAS, the Blue Earth County Board of Commissioners finds: 

1. That the proposed use conforms with the Zoning 
Ordinance.

2. That the proposed use conforms with the Land Use Plan. 

3. That the proposed use has the required manure storage. 

4. That the proposed use has the spreadable acres required 
for manure application.

5. That the applicant has applied for all required 
permits.

6. That the proposed use greatly reduces the potential for 
pollution.

NOW, THEREFORE, BE IT RESOLVED, by the Blue Earth County Board of
Commissioners, that the request for a conditional use permit for the
construction of an earthen basin in an A-1, Prime Agriculture Zoning
District, is granted with the following conditions:

General Conditions

1. That the earthen basin conforms with the site plan 
attached to the Planning Commission CO 74-94 report. 

2. That all required permits are obtained as shown in 
Attachment A-4, Structural Setbacks and Required Permits, attached to the
Planning Commission CO 74-94 report.

3. That a Minnesota Pollution Control Agency Interim Permit 
is issued before a construction permit is issued. 

4. That a Blue Earth County construction permit is issued 
before building begins.

5. That a minimum of one footing tile inspection pipe is 
included in the building design and construction of the earthen basin. MPCA
requires that the footing tile is located at least two (2) feet deeper than
the basin bottom.

6. That the earthen basin has the required setbacks as 
shown in Attachment A-4, Structural Setback Distances and Required Permits,
of the Planning Commission CO 74- 94 report.

7. That the land application of manure shall be on the land 
described in the Planning Commission Report CO 74-94 and shall comply with
the standards set forth in Attachments A-1 and A-5 of the Planning
Commission Report CO 74-94. 

8. That the applicants shall comply with the provisions of 
the Blue Earth County Livestock Manure Management Ordinance, Number 130,
effective January 4, 1995. 

9. That the abandoned well is sealed by a licensed well 
driller.

This resolution shall become effective immediately upon its passage and

Commissioner More moved and Commissioner Tacheny seconded the motion to
approve the following Conditional Use Permit: 

RESOLUTION GRANTING A CONDITIONAL USE PERMIT FOR 
THE CONSTRUCTION OF AN EARTHEN BASIN
IN AN AGRICULTURE ZONING DISTRICT
SECTION 1, MAPLETON TOWNSHIP

WHEREAS, David and Jan Massop, owners of the following real estate located
in Blue Earth County, Minnesota, to wit: 

The East 537 feet of the South 633 feet of the North 1,668 feet of the
Northwest Quarter of Section 1, Township 105 North, Range 26 West, said
parcel containing 7.80 acres 

have applied for a conditional use permit to allow the construction of an
earthen basin in an A-1, Prime Agriculture Zoning District; and

WHEREAS, the Planning Agency of the County has completed a review of the
application and made a report pertaining to said request (CO 75-94), a copy
of said report has been presented to the County Board; and

WHEREAS, the Planning Commission of the County on the 7th day of December,
1994, following proper notice, held a public hearing regarding the request
and, following the hearing, adopted a recommendation that the request for a
conditional use permit be granted; and

WHEREAS, the Blue Earth County Board of Commissioners finds:

Commissioner More moved and Commissioner Barnes seconded the motion to
approve the following Conditional Use Permit: 

RESOLUTION GRANTING A CONDITIONAL USE PERMIT FOR THE CONSTRUCTION OF A
TOTAL CONFINEMENT HOG OPERATION 
IN A CONSERVATION ZONING DISTRICT
SECTION 31, DECORIA TOWNSHIP

WHEREAS, Loren and Dean Sohre, owners of the following real estate located
in Blue Earth County, Minnesota, to wit: 

The Northeast Quarter of the Northeast Quarter of Section 31, Township 107
North, Range 26 West, said parcel containing 40.000 acres.

have applied for a conditional use permit to allow the construction of a
confined feedlot in an C-1, Conservation Zoning District; and

WHEREAS, the Planning Agency of the County has completed a review of the
application and made a report pertaining to said request (CO 76-94), a copy
of said report has been presented to the County Board; and

WHEREAS, the Planning Commission of the County on the 7th day of December,
1994, following proper notice, held a public hearing regarding the request
and, following the hearing, adopted a recommendation that the request for a
conditional use permit be granted; and

WHEREAS, the Blue Earth County Board of Commissioners finds: 

1. That the proposed use conforms with the Zoning 
Ordinance.

2. That the proposed use conforms with the Land Use Plan. 

3. That the proposed use has the required manure storage. 

4. That the proposed use has the spreadable acres required 
for manure application.

5. That the applicants have applied for all required 
permits.

6. That the proposed use will not create a pollution 
hazard.

NOW, THEREFORE, BE IT RESOLVED, by the Blue Earth County Board of
Commissioners, that the request for a conditional use permit for the
expansion of a confined feedlot in an C-1, Conservation Zoning District, is
granted with the following conditions:
General Conditions

1. That the confinement buildings conform with the site 
plan attached to Planning Commission CO 76-94 report. 

2. That the applicants have obtained agreements for 
spreading manure on at least 138 acres.

3. That all required permits, as shown in Attachment A-4 of 
the Planning Commission Report CO 76-94, be issued before a construction
permit is issued.

4. That a Blue Earth County Certificate of Compliance is 
issued before a construction permit is issued on the new barns.

5. That a Blue Earth County construction permit is issued 
before building begins.

6. That a minimum of one footing tile and inspection pipe 
is included in the building design and construction of each concrete pit.
MPCA requires that the footing tile are located at least one (1) foot
deeper than the pit bottom.

7. That the proposed structures have the required setbacks 
as shown in Attachment A-4 in the Planning Commission Report CO 76-94.

8. That the land application of manure shall be on the land 
described in the Preliminary Manure Management Plan and on other land
provided by the applicants. Manure application shall comply with the
standards set forth in Attachments A-1 and A-5 of the Planning Commission
Report CO 76-94.

9. That the applicants shall comply with the provisions of 
the Blue Earth County Livestock Manure Management Ordinance, Number 130,
effective January 4, 1995. 

10. That the applicants must coordinate with, and obtain 
approval from, the Decoria Township Board before construction of any road
access to the site.

Mr. Jerry Haley, Community Corrections Chief and Mr. Dennis McCoy, Deputy
County Administrator presented the following items for the Boards
consideration. Commissioner Barnes moved and Commissioner Landkamer
seconded the motion to approve the Mankato Group Home Contract for 1995
with a per diem of $81.55 per day and continue the lease agreement with
Sheriff's Youth Programs of Minnesota with a 4.2% increase. The motion
carried. 94-666 

Commissioner Barnes moved and Commissioner Landkamer seconded the motion to
approve the Community Corrections Annual Comprehensive Plan written by the
Community Corrections Advisory Board and authorize the chairs' signature on
the plan. The motion carried. 94-667

Mr. Dennis McCoy, Deputy County Administrator, presented the following
items for the Boards consideration.

Commissioner More moved and Commissioner Tacheny seconded the motion to
approve the following Human Service items: 

Approval of a host-county agreement with Progressive Living Inc. to provide
waivered services to persons with mental retardation and related
conditions. This program is Medical Assistance-funded and is for calendar
year 1995.

Approval of an agreement with Lutheran Social Service for calendar year
1995 to provide guardianship services.

Approval of the Cooperative Agreement between the State of Minnesota, the
Human Services Department, and the Blue Earth County Attorney's Office to
provide legal services to the Child Support Enforcement Programs. 

Approval of a Cooperative Agreement between the State of Minnesota, the
Human Services Department, and the Blue Earth County Court Administrator's
Office to establish procedures for the provision of services to the Child
Support Enforcement Program.

The motion carried. 94-669

Mr. Kris Miller, Human Services Advisory Committee Chairperson, discussed
the Human Services Task Force members having a more meaningful contribution
to their committees. 

Commissioner Landkamer moved and Commissioner Barnes seconded the motion to
approve the following fee items: 

Vital Statistic Fees
Passport photos from $10 to $12
Mailing Marriage Licenses from $0 to $7

$15.00 Returned Check Fee
Permit to carry concealed weapon from $5 to $10 Huber Prisoner Fee - $6.00

The Board met with the Nicollet County Board at the Holiday Inn from 12:10
to 2:08 p.m.

The next item the Board considered was the County Attorney's salaries.
Those speaking were: County Attorney Ross Arneson; Mr. Doug Sinclair, Chief
Asst. County Attorney; Mr. Mark Lindahl, Assistant County Attorney and Ms.
Paige Snover, Assistant County Attorney. Counsel to the Board was Mr. Peter
Bergstrom, Ratwik, Roszak Bergstrom & Maloney, P.A. After much discussion
Commissioner Barnes moved and Commissioner Tacheny seconded the motion to
set the County Attorney's salaries at $51,000 for the Chief Asst. County
Attorney, $43,000 for each of the two Assistant County Attorneys and
$39,000 for the newly hired Assistant County Attorney. The County
Attorney's salary would stay the same at $68,848.

After further discussion Commissioner Barnes withdrew his motion.

Commissioner Landkamer moved and Commissioner Tacheny seconded the motion
to set the County Attorney's 1995 salaries to $50,000 for the Chief Asst.
County Attorney, $45,129 for each of the two Assistant County Attorneys and
$39,479 for the newly hired Assistant County Attorney. The County Attorneys
salary would stay the same at $68,848 and the County Attorney agreeing to
waive his right to appeal. With the agreement by the County Attorney to
waive his right to appeal the motion carried. Commissioner Barnes voted
nay. 94-671

The next item to be considered was the Sheriff's 1995 salary. Mr. Brad
Peterson, Sheriff-Elect, and Mr. Robert Smith, Patrol Officer, were
present. After discussion Commissioner Barnes moved and Commissioner More
seconded the motion to set the Sheriff's salary at $48,000 with a $2,000
increase on July 1, 1995 based on performance. The motion carried.
Commissioners Landkamer and Stoltzman voted nay. 94-672 

After much discussion Commissioner Tacheny moved and Commissioner Landkamer
seconded the motion to appoint Officer Robert Smith as Chief Deputy Sheriff
on one year probation, during this period overtime must decrease or the
position will be re-evaluated, also an officer will be hired to fill Brad
Peterson's patrol position. The motion carried. Commissioner More voted
nay. 94-673

Commissioner Barnes moved and Commissioner Tacheny seconded the motion to
set the Chief Deputy Sheriff's salary at $46,010 effective January 1, 1995.
The motion carried. 94-674 

Commissioner Barnes moved and Commissioner Landkamer seconded the motion to
