The County Board of Commissioners met in the Commissioners'
Room at 9:00 a.m. Present were Chairperson Leon Tacheny,
Commissioner Colleen Landkamer, Commissioner Lin Barnes,
Commissioner Al Bennett, Commissioner Alvis More, County Attorney
Ross Arneson and County Administrator David Twa.
Commissioner Barnes moved and Commissioner Bennett seconded
the motion to approve the amended Agenda. The motion carried.

The Commissioners reported on committees that they have
attended since the last Board Meeting.
Commissioner More moved and Commissioner Barnes seconded the
motion to approve the amended December 12, 1995 Board Minutes.

Commissioner Bennett moved and Commissioner More seconded
the motion to approve the Minnesota Valley Action Council's Blue
Earth County Housing Rehab Report. The motion carried. 95-421
Mr. Jerry Haley, Community Corrections Chief, presented the
1996 Comprehensive Plan.
Commissioner Barnes moved and Commissioner Bennett seconded
the motion to approve the Community Corrections Annual
Comprehensive Plan written by the Community Corrections Advisory
Board and authorize the chairs' signature on the plan. The

Ms. Julie Conrad, Land Use & Natural Resources Planner,
presented the following Planning and Zoning items for the Boards
consideration.
Commissioner More moved and Commissioner Bennett seconded
the motion to approve the following:
RESOLUTION GRANTING A
CONDITIONAL USE PERMIT
EXPANSION OF A SWINE FINISHING OPERATION
SECTION 32, MCPHERSON TOWNSHIP
WHEREAS, Delmar C. And Norma J. Preston, owners and Scott
Preston, operator of the following real estate in the County of
Blue Earth, Minnesota, to wit:
South ´ of Southwest 1/4 of Section 26, McPherson
Township, T107N-R25W,
have applied for a Conditional Use Permit to expand a total
confinement hog operation in an A-1, Prime Agriculture Zoning
District, and
WHEREAS, the Planning Agency of the County has completed a
review of the application and made a report pertaining to a request
(CO 51-95), a copy of said reports has been presented to the County
Board; and
WHEREAS, the Planning Commission of the County on the 6th day
of December, 1995, following proper notice, held a public hearing
regarding the request and, following the hearing, adopted a
recommendation that the request for a conditional use be granted;
and
WHEREAS, the Blue Earth County Board of Commissioners finds
that:
1. With proper management of the proposed barn, manure
storage facilities, and manure application the
Conditional Use will not be injurious to the use and
enjoyment of other property in the immediate vicinity for
the purposes already permitted, within 1,500 feet of the
proposed barn.
2. Expansion of the Conditional Use will not impede the
normal and orderly development and improvement of
surrounding vacant property for the predominant uses in
the area.
3. Adequate utilities, access roads, drainage and other
necessary facilities have been or are being provided.
4. Adequate measures have been taken to provide sufficient
off road parking and loading space to serve the proposed
use.
5. Soil Survey of Blue Earth County indicates that the soils
on site have a severe potential to erode.
6. Proper facilities are provided which would eliminate any
traffic congestion or traffic hazard which may result
from the proposed use.
7. The proposed use is not greater than the intensity
characteristics allowed in the A-1, Agricultural Zoning
District.
8. The proposed use is consistent with the County Land Use Plan.
NOW THEREFORE BE IT RESOLVED, by the Blue Earth County Board
of Commissioners, that the request for a Conditional Use Permit to
expand a total confinement hog operation, in an A-1 Zoning
District, is granted with the following conditions:
1. Confinement building conform with the site plan attached
to this report;
2. Detailed construction plan which meet or exceed Midwest
Plan Service standards be submitted to and approved by
the Blue Earth County Environmental Services before a
Blue Earth County Construction Permit is issued;
3. An MPCA Certificate of Compliance and a Blue Earth County
Feedlot Permit be issued before a Blue Earth County
Construction Permit is issued for the proposed building;
4. An erosion control plan for construction be submitted and
approved before a Blue Earth County Construction Permit
is issued;
5. A Blue Earth County Construction Permit is issued before
construction begins;
6. A minimum of one footing tile inspection pipe is included
in the building design and construction of concrete pit.
MPCA requires that perimeter drain tile should be located
at least (1) foot deeper than the pit bottom;
7. Land application of manure shall be on the land described
in the Preliminary Manure Management Plan and complies
with standards set forth in Attachments A-1, Manure
Management Summary, and A-4, Manure Application Setbacks;
8. Disposal of dead animals shall be consistent with the
Minnesota Board of Animal Health regulations. Applicant
shall provide an enclosed location for the pick up of
dead animals;
9. Applicant obtain a Department of Natural Resources,
Water Appropriations Permit ; and,
10. Applicant ensure that adequate measures are taken to
minimize offensive odor, dust, and noise, so that none of
these constitute a nuisance.
This resolution shall become effective immediately upon its passage
and without publication.

motion to approve the following:
RESOLUTION GRANTING A
CONDITIONAL USE PERMIT
EXPANSION OF A NURSERY SWINE OPERATION
SECTION 36, RAPIDAN TOWNSHIP
WHEREAS, Karl Tischer, owner of the following real estate in
the County of Blue Earth, Minnesota, to wit:
North Half of the Northwest Quarter of Section 36, Rapidan
Township, T107N-R27W,
has applied for a Conditional Use Permit to expand a total
confinement swine operation in an A-1, Prime Agriculture Zoning
District, and
WHEREAS, the Planning Agency of the County has completed a
review of the application and made a report pertaining to said
request (CO 61-95), a copy of said reports has been presented to
the County Board; and
WHEREAS, the Planning Commission of the County on the 6th day
of December, 1995, following proper notice, held a public hearing
regarding the request and, following the hearing, adopted a
recommendation that the request for a conditional use permit be
granted; and
WHEREAS, the Blue Earth County Board of Commissioners finds
that:
1. That with proper management of the proposed barn, manure
storage facilities and manure application, the Conditional
Use will not be injurious to the use and enjoyment of the
other property in the immediate vicinity of the site.
2. That the predominate use in the area is agriculture and that
the Conditional Use will not impede the normal and orderly
development and improvement of surrounding vacant property
for the agricultural uses in the area.
3. Adequate utilities, access roads, drainage and other
necessary facilities have been or will be provided.
Access will be from a (5 ton limit) Township Road.
4. Adequate measures will be taken to provide sufficient off-
road parking and loading space to serve the proposed use.
5. Soil conditions are adequate to accommodate the proposed
use.
6. Proper facilities will be provided which will eliminate any
traffic congestion or traffic hazard which may result from
the proposed use.
7. The feedlot is not greater than the feedlot standards
allowed in the A-1, Prime Agriculture Zoning District.
8. The proposed use is consistent with the County Land Use
Plan.
9. That the proposed conditional use does not include
residential development.
10. That the proposed conditional use does not include
industrial development.
NOW THEREFORE BE IT RESOLVED, by the Blue Earth County Board of
Commissioners, that the request for a Conditional Use Permit to
expand a total confinement swine operation, in A-1 Zoning District,
is granted with the following conditions:
1. The confinement barn conforms with the site plan attached to
this report.
2. An MPCA Certificate of Compliance is issued before a
construction permit is issued on the proposed request.
3. A Blue Earth County Feedlot Permit is issued before a
construction permit is issued for the total confinement
barn.
4. A Blue Earth County construction permit is issued before
building begins.
5. A minimum of one footing tile inspection pipe is included in
the building design and construction of the concrete pit.

6. The land application of manure be on the land described and

Commissioner Bennett and Barnes seconded the motion to approve
the following Conditional Use Permit:
RESOLUTION GRANTING A CONDITIONAL USE PERMIT
TRANSFER OF NON-FARM DEVELOPMENT RIGHTS
SECTION 4, JUDSON TOWNSHIP
WHEREAS, James and Gertrude McGinness, owners of the following real
estate located in Blue Earth County, Minnesota, to wit:
South 30 acres of the Southeast Quarter of the Southeast
Quarter, T108N, R29W,
have requested a Conditional Use Permit to transfer development
rights from the Northeast Quarter of the Northeast Quarter of
Section 9, T108N R29W to the Southeast Quarter of the Southeast
Quarter of Section 4, T108N R29W,
WHEREAS, The Blue Earth County Planning Commission, on December 6,
1995, following proper notice, held a public hearing to discuss
said request (CO 62-95), and following the hearing recommended
approval of the Conditional Use Permit; and
WHEREAS, The County Board of Commissioners finds that:
1. The Conditional Use will not be injurious to the use and
enjoyment of other property already permitted in the
immediate vicinity.
2. Establishment of the Conditional Use will not impede the
normal and orderly development and improvement of
surrounding vacant property for the predominate,
agricultural uses in the area.
3. Adequate utilities, access roads, drainage and other
necessary facilities have been or are being provided.
4. Adequate measures have been or will be taken to provide
sufficient off-road parking space to serve the proposed
use.
5. Soil conditions are adequate to accommodate the proposed
use.
6. The proposed residential development is not greater than
the density of the surrounding neighborhood and will
require a transfer of development rights.
7. The proposed use is consistent with the County Land Use
Plan.
8. The applicant needs the Conditional Use Permit for a
Transfer of Development Rights in order to construct a
home in the southern half of this parcel.
NOW, THEREFORE BE IT RESOLVED, that the Blue Earth County Board of
Commissioners hereby approve the conditional Use Permit for
transfer of non-farm development rights, with the following
conditions:
1. The applicants subdivide and record all divisions of land
in accordance with the provisions of the County
Subdivision Ordinance.
2. The applicants obtain a Blue Earth County construction
permit before any building begins.
This resolution shall become effective immediately upon its passage
and without publication.
The motion carried. 95-425Commissioner Landkamer moved and Commissioner Bennett seconded
the motion to approve the 1996 Budget:
1996 BUDGET
WHEREAS, Minnesota Statutes 375A.06 provides that the
County Administrator shall prepare and submit to the
County Board a proposed annual budget and long-range
capital expenditure program including detailed estimates
of revenue and expenditures and enforce the provisions of
the budget when adopted by the County Board, and
WHEREAS, the County Administrator has prepared such
documents and the County Board has met in regular
sessions for the purpose of adopting an adequate budget
for maintenance of the administrative agencies of county
government for fiscal year 1996, and
WHEREAS, the County Board has come to the conclusion that
the budget so prepared is adequate and according to from
prescribed by Minnesota Statutes;
NOW, THEREFORE BE IT RESOLVED, that the final budget of
$49,911,291.00 be adopted and certified to the County
Finance Director this 19th Day of December, 1995:

Commissioner Barnes moved and Commissioner More seconded the
motion to approve the 1996 Tax Levy:
1996 LEVY
WHEREAS, Minnesota Statutes 375A.06 require that the
final property tax levy for the coming year be certified
to the County Finance Director by December 28, and
WHEREAS, the County Administrator has prepared and the
County Board has adopted the final 1996 County budget
including the property tax levy;
NOW THEREFORE BE IT RESOLVED, that the following 1996
adopted property tax levy of $12,639,751 be certified to
the Blue Earth County Finance Director.

Commissioner Landkamer moved and Commissioner Bennett seconded
the motion to approve the following:
RESOLUTION BY THE COUNTY BOARD OF COMMISSIONERS
APPROPRIATING FOR COUNTY EXTENSION WORK
BLUE EARTH COUNTY
YEAR BEGINNING JANUARY 1, 1996
BE IT RESOLVED: That the sum of $149,022.00 be set apart
from the General Revenue Fund and appropriated subject to
the order of the Dean and Director of the Minnesota
Extension Service of the University of Minnesota for the
support of county extension work in Blue Earth County for
the year beginning January 1, 1996, in accordance with
Minnesota Statute, Section 38.33-38.3, 1990.

Commissioner Bennett moved and Commissioner More seconded the
motion to approve the following:
PAYMENT ADJUSTMENT TO THE
MEMORANDUM OF AGREEMENT
BETWEEN THE UNIVERSITY OF MINNESOTA
EXTENSION SERVICE
AND BLUE EARTH COUNTY
FOR EMPLOYING COUNTY EXTENSION STAFF
In accordance with the terms of our Memorandum of
Agreement with the University of Minnesota Extension
Service related to the hiring of county extension staff,
salary funds for non-union employees and department heads
in this county were increased by 2% during 1995.
This percent increase will be added to the county payment
for each full time equivalent extension educator in the
county for 1996.

Commissioner Barnes moved and Commissioner Landkamer seconded
the motion to support the following resolution and forward a copy
to area legislators:
RESOLUTION
OF THE BLUE EARTH COUNTY BOARD OF COMMISSIONERS
OF THE MINNESOTA RIVER BASIN JOINT POWERS BOARD (MRBJPB)
SUPPORTING THE CONTINUANCE OF REINVEST IN MINNESOTA (RIM)
RESERVE PROGRAM FOR 1996
WHEREAS, The Minnesota River has become extremely
polluted over the past 50 years, for a variety of
reasons; and
WHEREAS, The MRBJPB agreement between the counties in the
Minnesota River Basin initiates a new model of governance
to provide a coordinated effort to preserve and restore
the Minnesota River; and
WHEREAS, The RIM Reserve Program removes marginal
agricultural land from production and restores fragile
ecosystems which, in turn, improves water quality; and
WHEREAS, The improvement of water quality within the
Minnesota River Basin is a directive of the Citizens
Advisory Committee of the Minnesota River Assessment
Project; and
NOW, THEREFORE, BE IT RESOLVED that the Blue Earth County
Board of Commissioners as members of the MRBJPB, support
and endorse the continuance of funding for the RIM
Reserve Program to the appropriate agencies and
localities to be used to protect fragile lands within the
Minnesota River Basin.

Mr. Al Forsberg, Public Works Director, presented the
following items for the Boards consideration.
Commissioner Bennett moved and Commissioner More seconded the
motion to make final payment to Loveall Construction for Aggregate
Base and Bituminous Surfacing on CSAH's 504, 5531, 553, 174, 16, 71
and 7 (#1295760908) and CSAH's 22, 9, 30 and CR 107, 120
(1295760708). The motion carried. 95-432
Commissioner Landkamer moved and Commissioner Barnes seconded
the motion to approve the following:
RESOLUTION OF SUPPORT FROM DESIGNATED AGENCY
Be it resolved that Blue Earth County act as sponsoring
agency for a "Transportation Enhancements" project
identified as Minneopa Trail and acknowledges herewith
that it is willing to be the project sponsor; knowing
full well that such sponsorship includes a willingness to
secure and guarantee the local share of costs associated
with this project and responsibility for seeing this
project through to its completion, with compliance of all
applicable laws, rules and regulations.
Be it further resolved that Alan Forsberg is hereby
authorized to act as agent on behalf of this applicant.
AGREEMENT TO MAINTAIN FACILITY
WHEREAS: The Federal Highway Administration (FHWA)
requires that states agree to operate and maintain
facilities constructed with federal transportation funds
for the useful life of the improvement and not change the
use of right of way or property ownership acquired
without prior approval from the FHWA; and
WHEREAS: Transportation enhancement projects receive
federal funding from the Surface Transportation Program
(STP) of the Intermodal Surface Transportation Efficiency
Act (ISTEA) of 1991; and
WHEREAS: The Minnesota Department of Transportation
(Mn/DOT) has determined that for projects implemented
with enhancement funds, this requirement should be
applied to the project proposer; and
WHEREAS: Blue Earth County is the project proposer for
the transportation enhancements project identified as
Minneopa Trail.
THEREFORE BE IT RESOLVED THAT the Project Proposer hereby
agrees to assume full responsibility for the operation
and maintenance of property and facilities related to the
aforementioned enhancement project.

Commissioner More moved and Commissioner Landkamer seconded
the motion to approve the following:

BLUE EARTH COUNTY SUPPORTS MATAPS96
IMPLEMENTATION
Blue Earth County is committed to the development of a
quality Transportation Plan for the Greater Mankato Area.
This Plan will provide a better understanding of our
transportation needs and improve cooperation and
coordination between the area's public transportation
corridors and result in a cooperative investment plan to
implement the recommended projects.
We are confident that Blue Earth County, as well as the
other Study partners, will make a good faith effort to
implement the results of the Study.
We do recognize that each partner represents a different
geographic area and vision for the future and will have
to review the individual projects to ensure they are
compatible with that agency's resources and competing
demands.
We also recognize that the future brings changes which
can not be anticipated now. For the plan to effectively
reach into the future, ongoing collaboration between the
agencies will be needed to regularly update the plan.

motion to approve an application for a Minnesota Lawful Gambling
Application for Authorization for an Exemption from Lawful Gambling
License to Lura Lake Association, Winnebago, MN to be held on May
18, 1996 at Daly Park, Mapleton, MN. The motion carried. 95-435
Commissioner Barnes moved and Commissioner Bennett seconded
the motion to approve a Renewal of Liquor License to Richard
McMonagle, d/b/a Junction Inn, Route 9, Box 192, Mankato, MN. The

Commissioner Barnes moved and Commissioner Landkamer seconded
the motion to set Board members' per diems at $50.00 and Committee
members' per diems at $35.00. The motion carried. 95-437
Mr. Dennis McCoy, Deputy County Administrator, presented the
following Human Services items for the Boards consideration.
Commissioner Landkamer moved and Commissioner More seconded
the motion to approve the following contracts:
The 1996 Immunization Action Plan Grant between the
Minnesota Department of Health and Blue Earth County.
An agreement to purchase psychiatric services from Thomas
Stapleton, M.D., to replace the services provided when
another psychiatrist terminated his relationship with the
agency.
A contract addendum extending the host-county contract
between the Blue Earth County Court Administrator's
Office, the State of Minnesota, and Blue Earth County
Human Services Department to provide child support
enforcement services.
An agreement between Mankato State University Department
of Social Work and Blue Earth County Human Services for
consultation and an outcome evaluation plan for the
Southern Mental Health Initiative and the Developmental
Disabilities Services Cooperative Initiatives.
A contract addendum to the existing host-county contract
between MRCI--Mankato and Blue Earth County Human
Services extending the agreement for the period January
1, 1996, to December 31, 1996, and establishing the
following rates:
a. Facility-based employment services
$69.17 per month
b. Community-based employment services
$80.42 per month
c. Combined employment services
$74.80 per month
d. EASE Program -- $83.55 per month
e. EASE Program without DRS funding
$283.25 per month
f. Community-based services without DRS
funding -- $20.01 per day
A home health aide services contract with the Mankato
Lutheran Home Care Division for the period January 1,
1996, through December 31, 1997. This allows the County
to meet Medicare certification requirements.
An agreement with the Blue Earth County Sheriff's Office
to provide jail health services in the County Jail for
calendar years 1996 and 1997.
A Contract with John W. Lester M.D., to serve as the
Community Health Department's medical consultant at the
same rate as the previous agreement for calendar years
1996 and 1997.
An agreement with Minnesota Valley Action Council to
provide senior dining program services under the Medical
Assistance Waivered Service Program for calendar years
1996 and 1997.
An agreement with Medi-Rental Inc. to provide home health
care supplies and equipment under the DHS Waivered
Services Program for calendar years 1996 and 1997.
An agreement with Centex--Kensington to provide Elderly
Waivered services under the Waivered Service Program for
calendar years 1996 and 1997 at funding levels directed
by the State of Minnesota.
Waivered service contracts at funding levels determined
by the State with the following individuals to provide
services under the Waivered Service Program for calendar
years 1996 and 1997:
A. Gertrude O'Connor--Mapleton, Adult Foster Care
B. Eloise Woitas--Minnesota Lake, Adult Foster Care
C. Diane Baley--Mankato, Adult Foster Care
D. Clark VanHorn--Mapleton, Adult Foster Care
An agreement with Mary Jo Thorne/Country Neighbors to
provide residential care under the Waivered Service
Program for calendar years 1996 and 1997.
An agreement with Lutheran Home/Cedar Haven to provide
residential care under the Waivered Service Program for calendar
years 1996 and 1997.
An agreement with Kevin Anderson/Sibley Manor to
provide residential care under the Waivered Service
Program for calendar years 1996 and 1997.
An agreement with Lori Zeik/Meadow Brook Board and Home
Care to provide residential care under the Waivered
Service Program for calendar years 1996 and 1997.
An agreement with Prairie River Personal Care
Associates to provide personal care attendant services
for calendar years 1996 and 1997 at no change in rates.
A Waivered Service Program agreement with Home Nursing
Services Inc. of Mankato to provide services for the
period January 1, 1996, through December 31, 1997, at
no change in rates.
A Waivered Service Program agreement with Mankato
Lutheran Adult Day Services to provide services during
calendar years 1996 and 1997 with no change in rates.
A Waivered Service Program agreement with Mankato
Lutheran Home Care to provide professional nursing
services and other services for calendar years 1996 and
1997 at no change in rates.
A Waivered Service Program agreement with MBW Company
to provide personal care attendant and other services
for calendar years 1996 and 1997 with no change in
rates.
An agreement with Immanuel-St. Joseph's Hospital Home
Health Services for calendar years 1996 and 1997 to
provide home care services with no change in rates.
An agreement with Immanuel-St. Joseph's Hospital--
Auxiliary Lifeline Program to provide Waivered Program
services in calendar years 1996 and 1997 with no change
in rates.
A Waivered Service Program agreement with Madelia
Hospital Home Care for calendar years 1996 and 1997
with no change in rates.
A Waivered Service Program agreement with HealthStaf
Nursing Services to provide Waivered Program services
for calendar years 1996 and 1997 with no change in
rates.
An agreement with Becklund Home Health Care to provide
Waivered Program services for calendar years 1996 and
1997 with no change in rates.
An agreement with Alliance Health Care to provide
Waivered Program services with no change in rates for
calendar years 1996 and 1997.
An agreement with Angelo Llana, M.D., to provide eight
(8) hours of psychiatric time per week for calendar
years 1996 and 1997.
An agreement with Horizon Homes for the period January
1, 1996, through December 31, 1996, to provide services
at the rate of $51.09 per day.
An agreement with Delmer Eggert, M.D., to provide
psychiatric time for calendar years 1996 and 1997.
The Administrative Process Contract between the State
of Minnesota, Blue Earth County Human Services, the
Blue Earth County Sheriff, and the Court
Administrator's Office for calendar year 1996 to
provide administrative process support services to the
Child Support Enforcement Program.
An agreement with Addiction Recovery Technologies to
provide outpatient chemical dependency services for the
period January 1, 1996 through December 31, 1997.
An agreement with the Psychiatric Clinic of Mankato to
provide psychiatric services for calendar years 1996
and 1997.
14 new appointments and 24 reappointments to Human
Service Task Forces and the Human Service Advisory
Committee.
An agreement with Immanuel-St. Joseph's Hospital to
provide chemical dependency services at the same rate
as 1995 for calendar years 1996 and 1997.
A grant agreement with DHS to receive a one time
planning grant of $30,000 for the Counties of Rice,
LeSueur, Freeborn and Blue Earth for adult mental
health systems initiatives pilot.

Pursuant to Publication, a public hearing was held regarding
the Crysteel Redevelopment Project. The public hearing was
opened for public comments by Chairperson Tacheny at 2:15 p.m.,
December 19, 1995. Mr. Roger Guenette, Advanced Resource,
updated the Board on the project. No public was present.
Chairperson Tacheny officially closed the public hearing at 2:46
p.m.
Commissioner Bennett moved and Commissioner More seconded
the motion to approve the following:
RESOLUTION OF THE COUNTY BOARD OF THE COUNTY OF BLUE EARTH
APPROVING BLUE EARTH COUNTY CRYSTEEL REDEVELOPMENT PROJECT
PLAN MODIFICATION
WHEREAS, the County Board of Blue Earth County (herein
called the Board) has held a public hearing to receive
input regarding the modification of the Blue Earth
County Crysteel Redevelopment Project Plan as provided
in a report, dated December 19, 1995 (herein called the
Plan), and
WHEREAS, the Blue Earth County Housing and
Redevelopment Authority by resolution has requested
approval of the Plan, and
WHEREAS, the Blue Earth County Planning Commission has
reviewed the Plan and finds that the Plan conforms to
the general plan for the development of the
municipality as a whole.
THEREFORE, the County Board of Blue Earth County
resolves:
1. That the areas described in said Plan are a
Redevelopment Project within the meaning of
Minnesota Statutes, Section 469.002,
Subdivision 14, and are described and
designated in Exhibit A attached hereto.
The Modified boundary of the Blue
Earth County Crysteel Redevelopment
Project is to encompass
approximately 430 acres of land in
Judson Township described as
follows:
All that part of Section 27,
Township 108 North, Range 28 West
lying north and west of Minnesota
Trunk Highway 60.
and
The east one half of Section 28,
Township 108, North Range 28 West
lying north and west of Minnesota
Trunk Highway 60.
2. That said Plan and Project will carry out the
purpose and policy of the Housing and
Redevelopment Act of the State of Minnesota
(Minnesota Statutes, 469.001 to 469.047) as
set forth in Minnesota Statutes, Section
469.001.
3. That the land in the Project Area would not
be made available for redevelopment without
the financial aid to be sought.
4. That the Redevelopment Plan For the Project
Area will afford maximum opportunity,
consistent with sound needs of the county as
a whole, for the redevelopment of such areas
by private enterprise.
5. That is it hereby found and determined that
the Redevelopment Plan for the Project area
set forth in the Plan Booklet conforms to the
general plan for the development of the
County as a whole.
6. That the Blue Earth County Board does hereby
approve the Blue Earth County Crysteel
Redevelopment Project Plan Modification as
presented in the Plan booklet.
RESOLUTION OF THE COUNTY BOARD OF THE COUNTY OF
BLUE EARTH APPROVING CRYSTEEL REDEVELOPMENT TAX INCREMENT
DISTRICT NO. 1 FINANCE PLAN MODIFICATION
WHEREAS, The County Board of the County of Blue Earth
(herein called the "Board") has held a public hearing
to receive input regarding the modification of the
Crysteel Redevelopment Tax Increment Districts No. 1
Finance Plan as provided in a report, dated December
19, 1995 (herein called the Plan), and
WHEREAS, It is desirable and in the public interest
that the Board modify the Crysteel Redevelopment Tax
Increment District No. 1 and adopt a tax increment
financing plan pursuant to Minnesota Statutes, Section
469, encompassing the area which is more particularly
described in exhibit A attached hereto and made a part
here of;
The following boundaries comprise the Tax
Increment Financing District:
That part of the Northwest Quarter of Section
27, Township 108 North, Range 28 West, Blue
Earth County, Minnesota, described as:
Commencing at the center of Section 27;
thence West (assumed bearing) 775.50 feet to
the intersection with the northerly right-of-
way line of the CHicago and Northwestern
Railroad; thence South 89 degrees 46 minutes
32 seconds West, 473.28 feed to the point of
beginning; thence North 0 degrees 56 minutes
30 seconds west 525.00 feet; thence North 89
degrees 46 minutes 32 seconds East 157.64
feet; thence South 0 degrees 56 minutes 30
seconds East 525.00 feet; thence South 89
degrees 46 minutes 32 seconds West 157.64
feet to the point of beginning. Containing
1.9 acres.
WHEREAS, The Blue Earth County Housing and
Redevelopment Authority by resolution has requested
approval of the Plan, and
WHEREAS, The Plan sets forth the estimate of the fiscal
and economic impact of tax increment financing on the
net tax capacities of all taxing jurisdictions in which
the District is located, and
WHEREAS, The Judson Township Board has been notified of
the public hearing for the review of the Plan Booklet,
and
WHEREAS, The School Board of Independent School
District No. 2071 has been notified of the public
hearing for the review of the Plan Booklet, and
WHEREAS, The County Board has received and considered
the comments of the Judson Township Board, and the
School Board of School District No. 2071, respecting
the contents of the Plan Booklet, and
WHEREAS, The Board, on December 19, 1995, after having
published notice of public hearing in the official
newspaper, conducted a public hearing on the Plan
Booklet and received public comments on the same;
NOW, THEREFORE, BE IT RESOLVED, by the Blue Earth
County Board:
1. That it is hereby found and determined that
there is a need for the Project activities in
the Tax Increment District.
2. That it is hereby found and determined that
the Project activities set forth in the Plan
Booklet will establish, for the County of
Blue Earth, the opportunity to eliminate
blight, promote redevelopment and promote
economic development of vacant, unused and
underused land. This development will create
jobs and enhance the local tax base.
3. That the Tax Increment District is a
Redevelopment Districts pursuant to Minnesota
Statute 469.174, Subdivision 10. The basis
for these determinations and qualifications
having been made by the Board in 1985. The
supporting facts for these findings were set
out in the resolutions pertaining to creation
of the District at the time of adoption. The
County is not expanding the size of the
District as a result of the present
modification and therefore reaffirms the
findings which were previously resolved.
4. That the proposed development, in the opinion
of the Board, would not reasonably be
expected to occur solely through private
investment within the reasonably foreseeable
future and therefore, the use of tax
increment financing is deemed necessary.
5. That the tax increment financing plan will
afford maximum opportunity, consistent with
sound needs of the County as a whole, for the
development of the Project by private
enterprise.
6. That it is hereby found and determined that
the tax increment financing plan set forth in
the Plan Booklet conforms to the general plan
for the development of the Project by private
enterprise.
7. That the reasons and supporting facts for
findings 3, 4 & 5 as set forth on pages 5 and
6 of the Plan Booklet are by this reference
confirmed and adopted.
8. That the County Administrator is hereby
directed to file a copy of this resolution
and a copy of the Plan Booklet with the
Department of Revenue.
9. That the Board hereby states its intention to
use all of the captured net tax capacity for
purposes of tax increment financing as per
the conditions set forth in the Plan Booklet.
10. That the Blue Earth County Board does hereby
approve the Crysteel Redevelopment Tax
Increment Finance District No. 1 Plan
Modification.
