The County Board of Commissioners met in the Commissioners' Room at 9:00 a.m.
Present were Chairperson Keith Stoltzman, Commissioner Colleen Landkamer,
Commissioner Leon Tacheny, Commissioner Lin Barnes, Commissioner Alvis More,
County Attorney Ross Arneson and County Administrator David Twa.
Commissioner Barnes moved and Commissioner Landkamer seconded the motion to
approve the amended agenda. The motion carried. 94-570
Commissioner Tacheny moved and Commissioner More seconded the motion to approve
the October 4, 1994 Board Minutes. The motion carried. 94-571

approve the following Personnel items:
Promotion of Wayne Krosch, from a Medium Equipment Operator (B22) to a Heavy
Equipment Operator (B23), with a salary adjustment from $12.25 to $12.69 per
hour effective October 26, 1994. (Highway)
Authorization to initiate recruitment for a .7 FTE 911 Dispatcher (B23).

an informational item.
Commissioner Tacheny moved and Commissioner Landkamer seconded the motion to
approve the following tax abatements: Mr. Stephen Woehrle, 318 South Fourth
Street, Mankato, MN R01-09-18- 133-010 K-28142; and Ms. Gail Sadaka, 920 Madison
Avenue, Mankato, MN R01-09-08-381-028 K-56441. The motion carried. 94- 574

approve the following:
AN ORDINANCE
REZONING CERTAIN PROPERTY
LOCATED IN JUDSON TOWNSHIP
FROM A-1, PRIME AGRICULTURE DISTRICT
TO C-1, CONSERVATION DISTRICT
WHEREAS, the tract of land, hereinafter called "tract," lying and located in the
County of Blue Earth and State of Minnesota, described as follows, to wit:
That part of Government Lot 3, Section 32, Township 108 North, Range 28 West,
Blue Earth County, Minnesota, described as:
Commencing at the North Quarter corner of Section 32; thence South 00 degrees 24
minutes 00 seconds East (assumed bearing) along the North-South centerline of
Section 32, a distance of 1367.70 feet to the point of beginning; thence North
89 degrees 15 minutes 56 seconds East, 458.94 feet; thence South 00 degrees 08
minutes 27 seconds West, 588.60 feet; thence South 89 degrees 12 minutes 13

is currently zoned by Blue Earth County as being an A-1 zoning district; and
WHEREAS, the owner of this tract has petitioned the Blue Earth County Planning
Department for rezoning the tract from an A-1 zoning district to a C-1 zoning
district; and
WHEREAS, the Planning Department has completed a study and made a report
pertaining to such proposed rezoning, [CO 46-94], a copy of which has been
presented to the Blue Earth County Planning Commission; and
WHEREAS, the Blue Earth County Planning Commission, on the 7th Day of September,
1994, following proper notice, held a public hearing, regarding the proposed
rezoning and, following said public hearing, adopted a recommendation that the
propose rezoning be approved; and
WHEREAS, based upon said report, minutes, recommendation of the Planning
Commission, and the presentation made to the County Board at the time of the
public hearing on this ordinance, the County Board hereby finds and determines
that the rezoning of the tract from an A-1 zoning district to C-1 is in the best
interest of the County.
NOW, THEREFORE, BE IT ORDAINED, by the County of Blue Earth that the above
described tract shall be, and hereby is, zoned and classified as a C-1 Zoning
District, in accordance with the Blue Earth County Zoning Ordinance.
This ordinance shall, become effective 20 days after publication of notice and
adoption.

Commissioner Tacheny moved and Commmissioner Barnes seconded the motion to
approve the following:
AN ORDINANCE
REZONING CERTAIN PROPERTY
LOCATED IN GARDEN CITY TOWNSHIP
FROM A-1, PRIME AGRICULTURE DISTRICT
TO C-1, CONSERVATION DISTRICT
WHEREAS, the tract of land, hereinafter called "tract," lying and being in the
County of Blue Earth and State of Minnesota, described as follows, to wit:
The west 10 acres of the Northeast Quarter of the Southeast Quarter of Section
12, Garden City Township; also a tract of land described as follows: commencing
at the Northwest corner of said Northeast Quarter of the Southeast Quarter of
said section 12; thence running south on the line of said 40 acres, 14 chains,
70 links; thence West 26 degrees 15 minutes North 10 chains, 59 links to the
center of the highway; thence on center of Highway North 26 degrees 15 minutes,
East 11 chains and 6 links; thence East 4 chains, 33 links to the place of
beginning, containing in all 19 acres.

WHEREAS, the owners' of this tract have petitioned the Blue Earth County
Planning Department for rezoning to the tract from an A-1 zoning district to a

WHEREAS, based upon said report, minutes, recommendation of the Planning

Commissioner Landkamer moved and Commissioner More seconded the motion to
approve the following plat:
A RESOLUTION
APPROVING FINAL PLAT
SORENSON SUBDIVISION
GARDEN CITY TOWNSHIP
WHEREAS, the owner of the property included in the plat of Sorenson Subdivision
has submitted a final plat for approval; and,
WHEREAS, the final plat was reviewed by the Blue Earth County Planning
Commission and found to be in conformance with the approved preliminary plat;
and,
WHEREAS, the final plat meets the requirements of the Blue Earth County
Subdivision Ordinance.
NOW, THEREFORE, BE IT RESOLVED that the Blue Earth County Board of Commissioners
hereby approve the final plat of Sorenson Subdivision, and authorizes the Chair
of the Board of Commissioners and the County Administrator to sign said plat.
This resolution shall become effective immediately upon its passage and without
publication.

the preliminary plat of a seven lot subdivision located in the Southeast Quarter

approve the Preliminary Plat of a three lot subdivision located in Government

Commissioner Tacheny moved and Commissioner More seconded the motion to approve
the following Conditional Use Permit:
RESOLUTION GRANTING A CONDITIONAL USE PERMIT FOR
A CONFINED FEEDLOT
IN AN AGRICULTURAL ZONING DISTRICT
SECTION 9, VERNON CENTER TOWNSHIP
WHEREAS, Henry Roelofs, owner of the following real estate located in Blue Earth
County, Minnesota, to wit:
Commencing 795 feet South of the Northeast corner of Section 9, Township 106
North, Range 28 West, then West 885 feet to ditch; then Southeast along ditch
East 720 feet to the Section Line; then North 510 feet to the point of
beginning, said parcel containing 9.400 acres.
has applied for a conditional use permit to allow a confined feedlot in an A-2,
Prime Agriculture District; and
WHEREAS, the Planning Agency of the County has completed a review of the
application and made a report pertaining to said request (CO 5-94), a copy of
said report has been presented to the County Board; and
WHEREAS, the Planning Commission of the County on the 2nd day of March, 1994,
following proper notice, held a public hearing regarding the request and,
following the hearing, adopted a recommendation that the request for a
conditional use permit be granted; and
WHEREAS, the Blue Earth County Board of Commissioners finds:
1. That the proposed use and site plan conforms
with the zoning ordinance.
2. That the proposed use conforms with the land
use plan.
3. That the proposed total confinement facility
has the required manure storage.
4. That the proposed use has the spreadable
acres required for manure application.
5. That the proposed use can be managed so it
will not be a potential pollution hazard.
6. That the applicant has applied for all
required permits.
7. The establishment of the conditional use will
not impede nor be incompatible with the
agricultural uses in the area.
8. Conditional use of the site will not be
injurious to the use and enjoyment of other property in the immediate area for
the
purposes already permitted.
NOW, THEREFORE, BE IT RESOLVED, by the Blue Earth County Board of Commissioners,
that the request for a conditional use permit for a confined feedlot in an A-2,
Prime Agricultural District, is granted with the following conditions:
General Conditions
1. That the confinement buildings and open lot
conform with the site plan attached to this report.
2. That MPCA issue a revised Certificate of
Compliance before a construction permit is issued.
3. That a construction permit is issued before
construction begins.
4. That the location of the perimeter tile
around the facility and the outlets be
identified on a USGS 7.5" topographic map.
5. That the land application of manure shall be
on the land described in this report and shall comply with the Special
Conditions below, and the standards set forth in A-1.
6. That the property owner shall comply with the
provisions of the Blue Earth County Livestock Manure Management Ordinance,
Number 130, effective January 1, 1995.
This resolution shall become effective immediately upon its passage and without
publication.

approve the following Conditional Use Permit:
RESOLUTION GRANTING A CONDITIONAL USE PERMIT FOR
THE CONSTRUCTION OF AN EARTHEN BASIN
IN AN AGRICULTURE ZONING DISTRICT
SECTION 20, SHELBY TOWNSHIP
WHEREAS, Keith and Alex Larson, owners of the following real estate located in
Blue Earth County, Minnesota, to wit:
Commencing at the Northeast Corner of the South Half of the Northwest Quarter,
west 36 rods, south 84 rods, east 36 rods, and north 84 rods to the beginning in
Section 20, Township 105 North, Range 28 West, said parcel containing 18.900
acres.
have applied for a conditional use permit to allow the construction of an
earthen pit in an A-1, Prime Agriculture Zoning District; and
WHEREAS, the Planning Agency of the County has completed a review of the
application and made a report pertaining to said request (CO 60-94), a copy of
said report has been presented to the County Board; and
WHEREAS, the Planning Commission of the County on the 12th day of October, 1994,
following proper notice, held a public hearing regarding the request and,
following the hearing, adopted a recommendation that the request for a
conditional use permit be granted; and
WHEREAS, the Blue Earth County Board of Commissioners finds:
1. That the proposed use conforms with the Zoning
Ordinance.
2. That the proposed use conforms with the Land Use Plan.
3. That the proposed use has the required manure storage.
4. That the proposed use has the spreadable acres required
for manure application.
5. That the applicant has applied for all required
permits.
6. That the proposed use will not create a pollution
hazard.
NOW, THEREFORE, BE IT RESOLVED, by the Blue Earth County Board of Commissioners,

plan attached to Planning Commission CO 60-94 report.
2. That a Minnesota Pollution Control Agency
Interim Permit be issued before a
construction permit is issued.
3. That a Blue Earth County construction permit
is issued before building begins.
4. That a minimum of one footing tile inspection
pipe be included in the building design and construction of earthen basin.
5. That the land application of manure shall be
on the land described in the Planning
Commission Report CO 60-94 and shall comply with the standards set forth in
Attachments A-1 and A-4 of Planning Commission Report CO 60-94.
6. That the earthen basin is constructed in
accordance with the Soil Conservation Service plan.
7. That the new earthen basin will be located at
least 500 feet from the nearest neighboring residence and at least 50 feet from

WHEREAS, Willard and Darrell Anderegg, owners of the following real estate
located in Blue Earth County, Minnesota, to wit:
The East Half of the Northeast Quarter of Section 20, Township 108 North, Range
25 West, said parcel containing 80 acres
have applied for a conditional use permit to allow the construction of an
earthen basin and a concrete lot in an A-1, Prime Agriculture Zoning District;
and
WHEREAS, the Planning Agency of the County has completed a review of the
application and made a report pertaining to said request (CO 62-94), a copy of
said report has been presented to the County Board; and
WHEREAS, the Planning Commission of the County on the 12th day of October, 1994,

County, Minnesota, to wit:
Tract commencing 209.5 feet South of the Northwest Corner, thence East 1,164.0

Township 109 North, Range 29 West, said parcel containing 10.340 acres.
has applied for a conditional use permit to allow the expansion of a confined
feedlot in a A-1, Prime Agriculture Zoning District; and
WHEREAS, the Planning Agency of the County has completed a review of the
application and made a report pertaining to said request (CO 63-94), a copy of
said report has been presented to the County Board; and
WHEREAS, the Planning Commission of the County on the 12th day of October, 1994,
following proper notice, held a public hearing regarding the request and,
following the hearing, adopted a recommendation that the request for a
conditional use permit be granted; and
WHEREAS, the Blue Earth County Board of Commissioners finds:
1. That the proposed use conforms with the

General Conditions

2. That a Blue Earth County Certificate of
Compliance be issued before a construction permit is issued.
3. That a Blue Earth County construction permit
is issued before building begins.
4. That a minimum of one footing tile inspection
pipe be included in the building design and construction of the concrete pit.
5. That the land application of manure shall be
on the land described in this report and shall comply with the Special
Conditions below, and the standards set forth in
Attachments A-1 and A-4 of Planning
Commission Report CO 63-94.
6. That the applicant shall comply with the
provisions of the Blue Earth County Livestock Manure Management Ordinance,
Number 130, effective January 4, 1995.
7. That the proposed barn is setback at least
500 feet from a neighboring residence and 50 feet from any property lines.
8. That the applicant has obtained signed,
manure spreading agreement for 670 acres (340 acres were required in the
Planning
Commission Report CO 63-94).

WHEREAS, Dean Sohre, owner of the following real estate located in Blue Earth
County, Minnesota, to wit:
The North Half of the Northwest Quarter of Section 7, Township 106 North, Range
26 West, said parcel containing 79.99 acres.
has applied for a conditional use permit to allow the expansion of a confined
feedlot in a A-1, Prime Agriculture Zoning District; and
WHEREAS, the Planning Agency of the County has completed a review of the
application and made a report pertaining to said request (CO 64-94), a copy of
said report has been presented to the County Board; and
WHEREAS, the Planning Commission of the County on the 12th day of October, 1994,
following proper notice, held a public hearing regarding the request and,
following the hearing, adopted a recommendation that the request for a
conditional use permit be granted; and
WHEREAS, the Blue Earth County Board of Commissioners finds:

5. That the applicant has applied for all
required permits.
6. That the proposed use will not create a
pollution hazard.
NOW, THEREFORE, BE IT RESOLVED, by the Blue Earth County Board of Commissioners,
that the request for a conditional use permit for the expansion of a confined
feedlot in an A-1, Prime Agriculture Zoning District, is granted with the
following conditions:
General Conditions
1. That the confinement building conforms with
the site plan attached to Planning Commission CO 64-94 report.
2. That a Blue Earth County Certificate of
Compliance be issued before a construction permit is issued.
3. That a Blue Earth County construction permit
is issued before building begins.
4. That a minimum of one footing tile inspection
pipe be included in the building design and construction of the concrete pit.
5. That the land application of manure shall be
on the land described in the Planning
Commission Report CO 64-94 and shall comply with the standards set forth in
Attachments A-1 and A-4 of Planning Commission Report CO 64-94.
6. That the applicant shall comply with the
provisions of the Blue Earth County Livestock Manure Management Ordinance,
Number 130, effective January 4, 1995.
7. The new barn will be setback at least 130
feet from the center of Blue Earth County Highway 10 and at least 500 feet from
neighboring residences.
This resolution shall become effective immediately upon its passage and without
publication.

Mr. Dennis McCoy, Deputy County Administrator, presented the following Human
Services items:
Commissioner Landkamer moved and Commissioner More seconded the motion to
approve the following Human Services Contracts:
Energy Assistance Program Modification #4 to complete the 1994 energy year.
Host-County Contract with Horizon Homes Incorporated for the period October 1,
1994, through December 31, 1995. The agreement increased the amount Horizon
Homes pays Blue Earth County for out-of-county residents. This rebate is used to
offset the cost of providing community support services for individuals with
mental illness who reside at Horizon Homes.
Two requests for variance to licensure of adult foster homes requested by
Nicollet County for individuals residing in their own apartments.
Contract addendum for MRCI DT & H Level II and IV programs. These rate changes
would be effective July 1, 1994 through June 30, 1995. The primary funding
source of these programs is Medical Assistance. The Level II full-day rate is
$46.25, the partial-day rate is $34.69, the transportation rate is $6.80. The
Level IV full-day rate is $82.20, the partial day rate is $61.65 and
transportation rate is $7.58.
An agreement with Country Neighbors Home, Inc. of Mapleton to provide waivered
service programs from November 1, 1994 to December 31, 1995. This is a new
agreement and is funded by Medical Assistance.
The Lutheran Home (Cedar Haven) to provide waivered service effective November
1, 1994 through December 31, 1995. The contract increased 3% and is funded by
Medical Assistance.
A grant agreement with the State of Minnesota to plan and design a system of
care utilizing managed care principles for the developmentally disabled. The
agreement is effective November 1, 1994 through June 30, 1995. Blue Earth County
will receive $30,000 under this agreement.
