BLUE EARTH COUNTY, MINNESOTA

October 4, 1994


The County Board of Commissioners met in the Commissioners' Room at 1:30 p.m.
Present were Chairperson Keith Stoltzman, Commissioner Colleen Landkamer,
Commissioner Leon Tacheny, Commissioner Lin Barnes, Commissioner Alvis More,
County Attorney Ross Arneson and County Administrator David Twa. 

Commissioner Landkamer moved and Commissioner More seconded the motion to
approve the amended agenda. The motion carried. 94-554

Pursuant to publication a public hearing was opened at 1:30 p.m. by Chairperson
Stoltzman. Mr. Milt Owens, Auditor, and Mr. Dick Bradshaw, Engineer, presented
the petition from Mr. Edgar Urevig, Ceresco Township. Public comments were heard
by Mr. Stanley Bergemann, Ceresco Township; Mr. Edgar Urevig, petitioner; Ms.
Betty Bergemann, Ceresco Township; Mr. Lorentz Gens, Ceresco Township; and Mrs.
Lorentz Gens, Ceresco Township. 

After discussion, Commissioner More moved and Commissioner Barnes seconded the
motion to approve the use of the drainage system as an outlet for County Ditch
#74. The motion carried. Chairperson Stoltzman officially closed the public
hearing at 2:00 p.m., October 4, 1994. A transcript of this hearing is on file

Pursuant to publication a public hearing was opened at 2:15 p.m. by Chairperson
Stoltzman. Mr. Milt Owens, Auditor, and Mr. Dick Bradshaw, Engineer, presented
the petition from Mr. Paul Juergens, Amboy, MN. Public comments were heard by
Mr. Paul Juergens, Petitioner. After discussion Commissioner Tacheny moved and
Commissioner More seconded the motion to approve the petition to use the
drainage system as an outlet for County Ditch #64. The motion carried.
Chairperson Stoltzman officially closed the public hearing at 2:25 p.m., October
4, 1994. A transcript of this hearing is on file at the County Administrator's

The next hearing was a Joint Ditch Hearing with Faribault County. Commissioners
Jerald Niebuhr and Ralph Prescher were the representives from Faribault County
and Commissioners Keith Stoltzman, Alvis More and Lin Barnes were representing
Blue Earth County. Commissioner Prescher moved and Commissioner Niebuhr seconded
the motion to appoint Commissioner Stoltzman as the Chairperson for the Joint
Ditch Authority. The motion carried. 94-557

Pursuant to publication a public hearing was opened at 3:00 p.m. by Chairperson
Stoltzman. Mr. Milt Owens, Auditor, and Mr. Dick Bradshaw, Engineer, presented
the petition from William Wendlandt, Garden City, to transfer part of County
Ditch #64 into Judicial Ditch #49.

Public comments were heard by Mr. William Wendlandt, petitioner; Mr. Chuck
Wingert, Consultant Engineer; Mr. John Blair, Winnebago; Mr Vern Peterson,
Amboy; Mr. Mark Peterson, Amboy; Mr. Nick Lundgren, Winnebago; Ms. Gloria Mack,
Amboy; Mr. Gary Eisenmenger, Amboy; Mr. David Stevens, Emergency Mgmt.; and Mr.
Ken Irvine, Amboy.

After discussion, the petition was denied due to the lack of a motion.
Chairperson Stoltzman officially closed the public hearing at 4:00 p.m., October

The meeting recessed at 4:00 p.m.
The meeting reconvened at 6:00 p.m.

After discussion Commissioner Barnes moved and Commissioner Tacheny seconded the
motion to have Mr. David Twa, County Administrator, contact Mr. Peter Berkstrom,
attorney from Ratwik, Roszak, Bergstrom & Maloney, P.A. Attorneys at Law, to
review County Attorney staff salaries. The motion carried. 94-559 

Commissioner More moved and Commissioner Landkamer seconded the motion to
reconduct the hearing on the petition from Paul Juergens, Amboy, on County Ditch
#64; due to the fact that notices were not received by those who are on the
ditch system. The hearing will be held on November 29, 1994 at 1:30 p.m. in the
Boardroom at the Courthouse. The motion carried. 94-560 

Commissioner Barnes moved and Commissioner More seconded the motion to approve
the September 20, 1994 Board Minutes. The motion carried. 94-561

Commissioner More moved and Commissioner Landkamer seconded the motion to
approve the following Bills: 

Bills for Week of September 26 - 30, 1994 

GRAND TOTAL	$604,126.98

Bills for Week of October 3 - 7, 1994

GRAND TOTAL	$744,659.66

Commissioner Tacheny moved and Commissioner More seconded the motion to approve
the following Personnel items: 

Approval of the amendment to Article X of the Blue Earth County Personnel Rules
regarding
Education/Experience Unpaid Leaves of Absence. 

Resignation of Debra Hanson, Clerical Specialist II (B22), effective October 7,
1994.(Court Administrators) 

Authorization to initiate recruitment for a Clerical Specialist II (B22). (Court
Administrators) 

Transfer of Debra McGinty, Victim Assistance Coordinator (C42), from the
employment of Mankato Rehabilitation Center, Inc., to Blue Earth County,
effective October 1, 1994 at $15.98 per hour. (Human Services)

Extension of probation for Kevin Tucker, Probation Officer (C42), from October
11, 1994 to January 11, 1994. (Community Corrections)

Commissioner More moved and Commissioner Barnes seconded the motion to approve a
tax abatement to Dean and Cindy Wrightson, Route 2, Box 31, Amboy, Minnesota
R42-18-33-400-001 K-180636. The motion carried. 94-564

Commissioner Landkamer moved and Commissioner More seconded the motion to
appoint Mr. Jerry Books, Finance Director, to the Southwest and West Central
Educational Cooperative Service Units Insurance Pool's Joint Powers Group. The
motion carried. 94-565 

Mr. Steve Michel, Physical Plant Director, presented the following item for the
Boards consideration. 

Commissioner More moved and Commissioner Barnes seconded the motion to approve a
letter of intent to Johnson Controls and the following resolution:

RESOLVED, that Keith Stoltzman, Chairperson, on behalf of the Blue Earth County
Board of Commissioners, is hereby authorized to enter into and designated to
sign a contract for the energy investment loan funds as authorized by Minn.
Stat. Section 216c.37 and Laws of Minnesota 1988, Chapter 686, Article 1,
Section 38, and approved by the Commissioner of the Minnesota Department of
Public Service.

BE IT ALSO RESOLVED that the Blue Earth County Board of Commissioners guarantees
it will annually levy or otherwise collect an amount sufficient to make annual
loan repayments of the interest and principal due on the loan amount approved,
which is not to exceed the $300,000.00 requested in the accompanying loan
application. The motion carried. 94-566

Mr. Al Forsberg, Public Works Director, presented the following items for the
Boards consideration. 

Mr. Rodney Boesch, Amboy and Mr. Scott Peterson, Mapleton, discussed the
possibility of a snowmobile trail through Daley Park for a one year trial
period.

Commissioner More moved and Commissioner Tacheny seconded the motion to approve
the following Medo Township Bridge Resolution:

WHEREAS, the County of Blue Earth has applied to the Commissioner of
Transportation for a grant from the Minnesota State Transportation Fund for the
construction of Township Bridge No. 07567 over the Little Cobb River and:

WHEREAS, the amount of the grant has been determined to be $64,137.34 by reason
of the lowest responsible bid. 

NOW THEREFORE, BE IT RESOLVED; that the County of Blue Earth does hereby affirm
that any cost of the bridge in excess of the grant will be appropriated from the
funds available to the County of Blue Earth, and that any grant monies
appropriated for the bridge but not required, based on the final estimate, shall
be returned to the Minnesota State Transportation Fund. 

BE IT FURTHER RESOLVED; that whereas Federal monies are being used to
participate in the cost of the bridge, grant monies as matching funds shall be
transferred directly to the agency account and that the records of the County of
Blue Earth shall so state.

Commissioner More moved and Commissioner Tacheny seconded the motion to set an
administrative fee of $150 for any changes to a ditch system. The motion
carried. 94-568
