The County Board of Commissioners met in the Commissioners' Boardroom, Courthouse, at 9:00 a.m. Present were Chairperson Linley Barnes, Commissioner Colleen Landkamer, Commissioner Al Bennett, Commissioner Alvis More, Commissioner Leon Tacheny, County Attorney Ross Arneson and County Administrator David Twa.

1. AGENDA REVIEW
Commissioner Landkamer moved and Commissioner Bennett seconded the motion to approve the Agenda with the addition of a resolution to increase state funding for comprehensive local water planning and a local government resolution to implement the Department of Trade and Economic Development microgrant. The motion carried. 97-463

Commissioner More moved and Commissioner Landkamer seconded a motion to approve the following resolution:
WHEREAS, Blue Earth County has a state approved Comprehensive Local Water Plan, which has been locally adopted pursuant to Minnesota Statutes Chapter 103B.311 or 103B.255 and covers 100 percent of the land area of the county; and

WHEREAS, each county in the state has added at least a one half time staff person to focus on Water Planning; and

WHEREAS, Comprehensive Local Water Planning has dramatically increased the planning, monitoring and implementation of water resource management in Minnesota and prevented further degradation of our surface and ground waters; and

WHEREAS, counties are asked to provide more resources in the environmental area related to water planning, including an increased focus on watershed management; and

WHEREAS
, to meet the goals of the state, we need resources at the local level to get the work done and these costs have increased since 1991 when Comprehensive Local Water Planning was first funded; and

WHEREAS, the State of Minnesota, acting by and through it's Board of Water and Soil Resources (BWSR), has authority to award Natural Resources Block Grants for the purpose of implementing Comprehensive Local Water Plans, the Wetland Conservation Act, the DNR Shoreland Program, and the MPCA County Feedlot Program, to local government pursuant to Laws of Minnesota 1993, Chapter 172, sec. 6, and Laws of Minnesota 1994, Chapter 632, sec. 3; and

WHEREAS, Blue Earth County may assess a levy under it's general levy authority to match such grants by BWSR pursuant to Minnesota Statutes 103B.335; and

WHEREAS, there has not been an increase in base funding since 1991 when the program was started.

NOW, THEREFORE BE IT RESOLVED that Blue Earth County requests the State of Minnesota to increase the base amount of dollars going to Comprehensive Local Water Planning, through the Natural Resources Block Grant Program, from $37,500 to $50,000 and include a 3 percent cost of living increase each year thereafter; and

BE IT FURTHER RESOLVED, that Blue Earth County will support a proportionate local match increase to support Blue Earth County's Comprehensive Local Water Planning Program.

Commissioner Bennett moved and Commissioner Tacheny seconded the motion to approve the following resolution:
BE IT RESOLVED that Blue Earth County act as the legal sponsor for project(s) contained in the Business and Community Development Application to be submitted and that Chairperson Linley Barnes is hereby authorized to apply to the Department of Trade and Economic Development for funding of this project on behalf of Riverbend Center for Enterprise Facilitation.

BE IT FURTHER RESOLVED that Blue Earth County has the legal authority to apply for financial assistance, and the institutional, managerial, and financial capability to ensure adequate construction, operation, maintenance and replacement of the proposed project for its design life.

BE IT FURTHER RESOLVED that Blue Earth County has not violated any Federal, State, or local laws pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of interest or other unlawful or corrupt practice.

BE IT FURTHER RESOLVED that upon approval of its application by the state, Blue Earth County may enter into an agreement with the state of Minnesota for the above referenced project.

NOW, THEREFORE BE IT RESOLVED that Chairperson Linley Barnes or his successor in office, are hereby authorized to execute such agreements, and amendments thereto, as are necessary to implement the project on behalf of the applicant.

4. PUBLIC HEARING-PLANNING AND ZONING

Pursuant to Publication, the Public Hearing affirming review of the closing statement of Southview Manor Mobile Home Park, NE 1/4, NW 1/4, Section 27, Garden City Township, was opened at 9:30 a.m. by Chairperson Barnes. The hearing was tape recorded. Officials present were the County Board, County Administrator, County Attorney, Mr. Veryl Morrell, Land Use Administrator, and Mr. Bill Goebel, Land Use Specialist.
Comments were heard from Mr. Shannon Northamer and Mr. Emmett Fowler, residents of Southview Manor, and Mr. Christopher Kennedy, Attorney for the owner(s). A discussion about actual relocation fees followed. The Board found that notification requirements have been met and determined that displaced residents need assistance with relocation expenses, thereby meeting Statutory requirements of Chapter 327C.095.
Commissioner Bennett moved and Commissioner Tacheny seconded the motion to approve the following resolution:

RESOLUTION AFFIRMING REVIEW OF THE CLOSING STATEMENT
OF SOUTHVIEW MANOR MOBILE HOME PARK
NE 1/4, NW 1/4, SECTION 27, GARDEN CITY TOWNSHIP

WHEREAS, Michael and Jane Riegert, owner of the following real estate in the County of Blue Earth, Minnesota, to wit:

Commencing at the Southwest Corner of the Northwest Quarter of the Northwest Quarter of said Section, thence South 88 degrees, 40 minutes East, along the center line of County Road No. 13, a distance of 1,559 feet; thence left at an angle of 90 degrees from said center line a distance of 50 feet to the place of beginning; thence continuing in a Northerly direction and perpendicular to the center line of said County Road No. 13, a distance of 450 feet; thence right at a 90 degree angle and parallel with the center of County Road No. 13 a distance of 530 feet; thence at a right angle and in a Southerly direction perpendicular to the center line of County Road No. 13, a distance of 450 feet to the North right-of-way line of County Road No. 13; thence North 88 degrees 40 minutes West along said North right-of-way of said County Road No. 13, a distance of 530 feet to the place of beginning. have requested that the closing statement for Southview Manor Mobile Home Park dated September 11, 1997, prepared on their behalf by Christopher Kennedy, Attorney-at-Law, be reviewed as required by Minnesota State Statutes, Chapter 327C.095, to determine if required notification has been given, and to determine any impact that the park closing may have on the displaced residents and the park owner; and,

WHEREAS, the Planning Agency of the County has completed a review of the application and made a report to said request (PC 63-97), a copy of said report has been presented to the County Board; and,

WHEREAS, the Blue Earth County Planning Commission held a public hearing on November 5, 1997, to examine the request. At the hearing the planning commission checked the submitted list of names of displaced residents residing within the park against records maintained by the Blue Earth County Land Use Department, and determined that the list was correct and that the nine month notification to all residents and the local planning agency required by Chapter 327C.095, Subp.1 has been received, and that the ten day notice of the hearing to residents has been given as required by Chapter 327C.095, Subp. 3; and,

WHEREAS, at the hearing the Planning Commission considered testimony from displaced residents and park owners to determine the impact that the closing will have on displaced residents and the park owners as required by Chapter 327C.095, Subp. 4. Following the hearing, the Planning Commission forwarded a recommendation to the County Board that relocation fees be paid to displaced residents by the park owners. Said re-location fees are to be determined by the Blue Earth County Board of Commissioners after considering the disparity in relocation costs between a single-wide home and a double-wide home. It is recommended that if relocation costs are awarded, the County Board should require that documentation be provided by the homeowner verifying that the relocation occurred, that the home is owner occupied and serves as the primary residence of the owner, and that the lot rent is current on or before the date the mobile home is removed from the park; and,

WHEREAS, a public hearing was held by the Blue Earth County Board of Commissioners on November 25, 1997. After hearing testimony from park owners and displaced residents, and after considering recommendations from the Planning Commission, the Board determined that all required notification had been given and that relocation fees should be paid to displaced residents.

NOW THEREFORE BE IT RESOLVED, by the Blue Earth County Board of Commissioners that notification requirements have been met, and a determination has been made that displaced residents need assistance with relocation expenses, thereby meeting pertinent Statutory requirements of Chapter 327C.095. The owners of Southview Mobile Home Park are hereby ordered to pay $150.00 in relocation fees to each displaced resident, not to exceed $500.00 per household, and an additional $300.00 to each owner / occupant of a single-wide mobile home who relocates his home. Additional relocation fees shall be $1,100.00 for each owner / occupant who relocates his double-wide mobile home instead of $300.00 as provided for single-wide mobile homes. Prior to payment of the portion of the fee allocated for relocation of the home to another park the displaced resident shall furnish proof of the following:

1.Documentation proving that the relocation occurred.

2.That the mobile home is still owner occupied and that it serves as the primary residence of the owner.

3.That all outstanding rent at Southview Manor was paid on or before the date of removal of the home from the park. Any outstanding lot rent shall be deducted from the awarded re location fees.

No other parties or entities are required to pay relocation costs. The closure date of the Southview Mobile Home Park shall be July 1, 1998.

This resolution shall become effective immediately upon it's passage and without publication.

4. PLANNING AND ZONING

A Public Hearing will be set for December 16, 1997 at 9:30 a.m. to hear a request to amend the Blue Earth County Land Use Ordinance, Section 11, Highway Business District, to accommodate convenience stores with accessory retail gasoline and diesel fuel sales as a conditional use.

WHEREAS, Ron Kruggel, owner of the following real estate in the County of Blue Earth, Minnesota, to wit:

The Southwest Quarter of the Southwest Quarter Section 32, Rapidan Township, T107N, R26W;

have applied for a Conditional Use Permit to construct two total confinement swine barns in an A, Agriculture Zoning District; and

WHEREAS, the Planning Agency of the County has completed a review of the application and made a report pertaining to said request (PC 70-97 ), a copy of said report has been presented to the County Board; and

WHEREAS, the Planning Commission of the County on the 5th day of November, 1997, following proper notice, held a public hearing regarding the request and, following the hearing, adopted a recommendation that the request for a conditional use permit be granted; and

WHEREAS, the Blue Earth County Board of Commissioners finds that:

1.That with proper management of the proposed barns and with proper manure application, the Conditional Use should not be injurious to the use and enjoyment of other property in the immediate vicinity designated for agricultural uses.

2.That with proper management of the proposed barns and with proper manure application, this facility should not constitute a pollution problem.

3.That the predominant use in the area is agriculture and the Conditional Use should not impede the normal and orderly development and improvement of surrounding vacant property for agricultural uses.

4.Adequate utilities, access roads, drainage and other necessary facilities have been or will be provided.

5.Adequate measures will be taken to provide sufficient off road parking and loading space to serve the proposed use.

6.Soil conditions are adequate to accommodate the proposed request.

7.Proper facilities will be provided which will eliminate any traffic congestion or traffic hazard which may result from the proposed use.

8.
The feedlot is not greater than the feedlot standards allowed in the A, Agricultural Zoning District.

9.The proposed use is consistent with the County Land Use Plan.

10.That the proposed use does not include residential development.

3.That the applicant must obtain a Blue Earth County Feedlot Permit and a Certificate of Compliance before any animals are placed in the barn.

That the applicant obtain a Blue Earth County Construction Permit before building begins and within nine months from the date the County Board of Commissioners approves the Conditional Use Permit. The permit shall be rendered invalid if application for a Construction Permit is not made within this nine month period. Time extensions for Conditional Use Permits must be obtained from the County Board of Commissioners subsequent to a public hearing conducted by the Planning Commission.

5.That the applicant obtain a Department of Natural Resources, "Water Appropriations Permit" before any animals are placed in the proposed barns.

6.That a perimeter footing drain tile be located at or below the bottom of the pit footings. The footing tile shall include one inspection pipe for each concrete pit. The native materials must be excavated and walls back filled with granular material (pit run gravel or equivalent).

7. That application of manure be on the land documented in the aerial photos included in the State of Minnesota Application for Construction and Operation of an animal feedlot. The application of manure shall comply with standards set forth in Attachment A-1, Manure Management Summary and Attachment A-4, Manure Application Setbacks, as contained in staff report PC 70-97.

8.That the disposal of dead animals be consistent with the Minnesota Board of Animal Health regulations.

9.That the applicant provide an enclosed location for the pick up of dead animals before any animals are placed in the proposed barns.

.That adequate measures be taken to minimize or control offensive odor, fumes, dust, noise, or vibrations so that none of these will constitute a nuisance.

TO CONSTRUCT ONE TOTAL CONFINEMENT SWINE BARN
AT AN EXISTING FEEDLOT EXPANDING FROM 243 A.U. TO 483 A.U. LOCATED IN THE NORTHWEST QUARTER OF SECTION 24,
VERNON CENTER TOWNSHIP

WHEREAS, Roelof Farms Inc., owner of the following real estate in the County of Blue Earth, Minnesota, to wit:

The Northwest Quarter of Section 24, Vernon Center Township;

has applied for a Conditional Use Permit to construct one total confinement swine barn in an A, Agriculture Zoning District; and

WHEREAS, the Planning Agency of the County has completed a review of the application and made a report pertaining to said request (PC 72-97 ), a copy of said report has been presented to the County Board; and

WHEREAS, the Planning Commission of the County on the 5th day of November, 1997, following proper notice, held a public hearing regarding the request and, following the hearing, adopted a recommendation that the request for a conditional use permit be granted; and

WHEREAS, the Blue Earth County Board of Commissioners finds that:

1.That with proper management of the proposed barn and with proper manure application, the Conditional Use should not be injurious to the use and enjoyment of other property in the immediate vicinity designated for agricultural uses.

2.That with proper management of the proposed barn and with proper manure application, this facility should not constitute a pollution problem.

3.That the predominant use in the area is agriculture and the Conditional Use should not impede the normal and orderly development and improvement of surrounding vacant property for agricultural uses.

4.Adequate utilities, access roads, drainage and other necessary facilities have been or will be provided.

5.Adequate measures will be taken to provide sufficient off road parking and loading space to serve the proposed use.

6.Soil conditions are adequate to accommodate the proposed request.

7.Proper facilities will be provided which will eliminate any traffic congestion or traffic hazard which may result from the proposed use.

8.
The feedlot is not greater than the feedlot standards allowed in the A, Agricultural Zoning District.

9.The proposed use is consistent with the County Land Use Plan.

10.That the proposed use does not include residential development.

11.That the proposed use does not include industrial development.

NOW THEREFORE BE IT RESOLVED, by the Blue Earth County Board of Commissioners, that the request for a Conditional Use Permit, to build one total confinement swine barn in an Agricultural Zoning District, is granted with the following conditions:

1.That the total confinement barn, conforms with the site plan attached to this report PC 72-97.

2.That the feedlot, including all buildings and the proposed building, be located on a single, legally described parcel consisting of a minimum of ten contiguous acres. The parcel shall be a parcel of record, properly recorded in the Blue Earth County Land Records Office.

3.That the applicant must obtain a Blue Earth County Feedlot Permit and a Certificate of Compliance before any animals are placed in the barn.

4.
That the applicant obtain a Blue Earth County Construction Permit before building begins and within nine months from the date the County Board of Commissioners approves the Conditional Use Permit. The permit shall be rendered invalid if application for a Construction Permit is not made within this nine month period. Time extensions for Conditional Use Permits must be obtained from the County Board of Commissioners subsequent to a public hearing conducted by the Planning Commission.

5.That the applicant obtain a Department of Natural Resources, "Water Appropriations Permit" before any animals are placed in the proposed barn.

6.That a perimeter footing drain tile be located at or below the bottom of the pit footings. The footing tile shall include one inspection pipe for each concrete pit. The native materials must be excavated and walls back filled with granular material (pit run gravel or equivalent).

7. That application of manure be on the land documented in the aerial photos included in the State of Minnesota Application for Construction and Operation of an animal feedlot. The application of manure shall comply with standards set forth in Attachment A-1, Manure Management Summary and Attachment A-4, Manure Application Setbacks, as contained in staff report PC 72-97.

7. COUNTY DITCH #36-PUBLIC HEARING
Pursuant to publication, a Public Final Hearing was held for the Improvement of County Ditch #36, as petitioned by Theodore Goettl & Darrell Hylen et al. The Blue Earth County Board of Commissioners, acting as the Drainage Authority pursuant to M.S. 103E.005, Subd. 9, held a Final Hearing, at the Blue Earth County Courthouse on November 25, 1997. The public hearing was opened for public comments by Chairperson Barnes at 1:30 p.m.
Officials present included County Administrator/Acting Land Records Director David Twa, County Attorney Ross Arneson, Ditch Manager Jerry Kallheim, and Engineer Chad Surprenant. A listing of others present is included as part of the record. The proceedings were tape-recorded.
Attorney for the Petitioners, Mr. Kurt Deter, made comments on the project.
Mr. Jerry Kallheim, Ditch Manager, verified that all Jurisdictional Documents and Notices are in order.
Mr. Chad Surprenant, Engineer, made a presentation and provided a written report.
The DNR Commissioner's Advisory Report was read at the Preliminary Hearing, and no revisions have been received.
The Ditch Viewers in attendance were: Mr. Obert Haldorson, Mr. Thomas Behrends, and Mr. Lowell Ross. A report was presented by Mr. Lowell Ross, Albert Lea. A copy of the report has been filed.
All parties present were given an opportunity to express their concerns and opinions. Public Comments were heard from: Mr. Tom Schuster, Ms. Katy Wortel, Ms. Anna Schuster, Mr. Dennis Mikkelson, Mr. Darrell Hylen, Mr. Pete Jones, Mr. Dennis Werkmeister, Mr. LeRoy Olson, Mr. Herb Davis, Mr. Joel Anderson, Mr. John Roberts, Mr. Eldon Jones, Mr. Brad Leiding, Mr. Ron Dahltorp, and Mr. Greg Mikkelson. After discussion, the Board made the following findings:

1. The detailed survey report and viewers' reports have been made and under other proceedings completed under Minnesota Statutes 103E;

2. Reports made or amended are complete and correct;

3. The damages and benefits have been properly determined;

4. The estimated benefits are greater than the total estimated cost, including damages;

5. The proposed drainage project will be of public utility and benefit and will promote the public health; and

6. The proposed drainage project is practicable.

Commissioner More moved and Commissioner Tacheny seconded the motion to approve the proposed drainage project, adopting the use of 48" in-ground tile, according to the Engineers plans; order the Engineer to prepare plans and specs for bidding, and adopt the Viewers Report. 8. CIP PUBLIC HEARING
Pursuant to Public Notice, a Public Hearing was opened at 5:03 p.m. by Chairperson Barnes. Officials present included the County Board, County Administrator, County Attorney, and Mr. Jerry Books, Director of Finance, Blue Earth County. The hearing was tape recorded.
The Board was presented with information about the 1998-2002 Blue Earth County Capital Improvements Program and the recommendation for the sale of $3,000,000 General Obligation Capital Improvement Bonds, Series 1998A and $430,000 General Obligation Drainage Ditch Bonds, Series 1998B. There was no public comment or attendance.
