October 19, 1999
The County Board of Commissioners met in the Commissioners' Room at 9:00 a.m. Present were Chairperson Al Bennett, Commissioner Tom McLaughlin, Commissioner Colleen Landkamer, Commissioner Alvis More, Commissioner Lin Barnes, County Attorney Ross Arneson, County Administrator David Twa and Deputy Administrator Dennis McCoy.
1. AGENDA REVIEW
Commissioner Landkamer moved and Commissioner More seconded the motion to approve the Agenda. The motion carried. 99-385
2. COMMISSIONERS’ REPORTS ON COMMITTEES
The Commissioners reported on committees that they have attended since the last Board Meeting.
3. ADMINISTRATIVE SERVICES
Mrs. Sandra King, Deputy Administrator/Land Records Director; Mr. Charles Berg, Director of Information Services and Mr. Bill James, Assistant Land Records Director, presented the following Bid for the Boards consideration.

Commissioner Barnes moved and Commissioner Landkamer seconded the motion to approve the Tax Forfeited Land Sale Resolution:
BLUE EARTH COUNTY BOARD RESOLUTION
BE IT RESOLVED, that all parcels of tax-forfeited land listed on List of Tax-Forfeited Land be classified as nonconservation land; that the basic sale price of each parcel on List of Tax-Forfeited Land, which is on file with the Deputy County Administrator/Land Records Director, be approved and authorization for a public sale will be held at 9:00 A.M., Tuesday, November 30, 1999 by the Deputy County Administrator/Land Records Director at the Land Records Conference Room, 2nd Floor, Blue Earth County Nichols Building, 410 Jackson Street, Mankato, MN, for not less than the basic sale price; and that all sales shall be full payment.

4. PLANNING & ZONING
Mr. Scott Salsbury, Land Use Planner, presented the following Planning and Zoning items for the Boards consideration.

RESOLUTION GRANTING A
CONDITIONAL USE PERMIT TO GRADE AND FILL
IN A BLUFF ZONE TO CONSTRUCT A DRIVEWAY
NW 1/4 OF THE NE 1/4
SECTION 19, JAMESTOWN TOWNSHIP
WHEREAS, Wendy Mende, owner of the following real estate in the County of Blue Earth, Minnesota, to wit:
That part of Lot 7, Block 1, Williwaw Knolls Subdivision lying Easterly of the following described line:
Commencing at the Northeasterly corner of Lot 7 in said Block One; thence South 75 degrees 46 minutes 24 seconds West (assumed bearing) along the Northerly line of Lot 7, a distance of 292.87 feet; thence South 53 degrees 57 minutes 14 seconds West along the Northerly line of Lot 7 a distance of 85.25 feet to the point of beginning; thence South 21 degrees 58 minutes 28 seconds East 370 feet, more or less, to the Northerly water’s edge of Lake George and there terminating. Also that portion of a Private Pedestrian Walkway that lies east of said Block one.
has applied for a Conditional Use Permit to grade and fill in a bluff zone for the purpose of constructing a driveway in the Northwest Quarter of the Northeast Quarter of Section 19, Jamestown Township.; and
WHEREAS, the Planning Agency of the County has completed a review of the application and made a report pertaining to said request (PC 65-99), a copy of said report has been presented to the County Board; and
WHEREAS, the Planning Commission of the County on the 6th day of October 1999, following proper notice, held a public hearing regarding the request and, following the hearing, adopted a recommendation that the request for a Conditional Use Permit be granted; and
WHEREAS, the Blue Earth County Board of Commissioners finds:
1. That the proposed use conforms with the County Land Use Plan.
2. That with proper management the proposed use will not degrade the water quality of the County.
3. That with proper management, the proposed use will not adversely increase the quantity of water run-off.
4. That with proper erosion control measures, the soil conditions are adequate to accommodate the proposed use.
5. That the proposed use does not create a potential pollution hazard.
6. That adequate utilities, access roads, drainage and other necessary facilities have been or are being provided.
7. That adequate measures have been or will be taken to provide sufficient off-street parking and loading space to serve the proposed land use.
8. That facilities are provided to eliminate any traffic congestion or traffic hazard which may result from the proposed use.
9. That the Conditional Use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted.
10. That the establishment of the Conditional Use will not impede the normal and orderly development and improvement of surrounding vacant property for the predominant uses in the area.
NOW THEREFORE BE IT RESOLVED, by the Blue Earth County Board of Commissioners, that the request for a Conditional Use Permit to Grade and Fill in an Rural Residence District, is granted with the following conditions:
1. That all grading cuts, and fills for the access road shall comply with the attached plans.
2. That silt fences and straw bales be installed along the bluff and at the base of the bluff to prevent any erosion.
3. That all exposed slopes shall be vegetated and seeded within 30 days of completion of driveway construction.
4. That all steep slopes and bluff areas outside of the access road shall be left in their natural state.
5. That existing, natural vegetation shall be maintained in the undisturbed areas of the bluff.
6. That only the two trees along the course of the proposed driveway may be removed.
- That a sewage treatment system be installed in conformance with County and State Regulations by November 19, 1999.
- That all of the solid waste and hazardous waste stored on the property must be removed and properly disposed of.
- That Environmental Services must receive verification from the State Board of Electricity that the necessary modifications have been made to the electrical system servicing the cabin, and that it meets with the minimum requirements of the State Board of Electricity before it is occupied.
10. Violations of any of the above conditions may lead to a review of the Conditional Use Permit by the Planning Commission and County Board of Commissioners.
This resolution shall become effective immediately upon its passage and without publication.

Mr. Roger Durst, representing Tri-State Outdoor Media Group, stated he was present to answer any questions.
Commissioner Barnes moved and Commissioner McLaughlin seconded the motion to approve the following Conditional Use Permit:
RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO ALLOW AN EXISTING OFF-PREMISES ADVERTISING SIGN TO BE MOVED FROM THE CENTER OF LOREN DRIVE, A NEWLY PLATTED STREET, AND RECONSTRUCTED FIFTY FEET TO THE EAST ALONG TH 60 IN THE B-3, HIGHWAY BUSINESS ZONED DISTRICT, IN THE NE 1/4 OF THE SW 1/4, SECTION 19, SOUTH BEND TOWNSHIP
WHEREAS, Shamp A, Patton L, and Neilsen A, % Audrey J. Shamp, owners of the following real estate in the County of Blue Earth to wit:
Outlot A, Crane Subdivision, South Bend Township, Blue Earth County
and Roger Durst, representing Tri-State Outdoor Advertising Media Group, are requesting a conditional use permit to move an existing off-premise, advertising sign located in the center of what is now Loren Drive, Crane Subdivision to a location fifty (50) feet east along the TH 169/60 right-of-way to the east of the existing location; and,
WHEREAS, the Planning Agency of the County has completed a review of the application and made a report pertaining to said request (PC 66-99), a copy of said report has been presented to the County Board; and,
WHEREAS, the Planning Commission of the County on the 6th Day of October, 1999, following proper notice, held a public hearing regarding the request and, following the hearing, voted unanimously to recommend approval of the request to the County Board; and,
WHEREAS, the Blue Earth County Board of Commissioners, on the 19th Day of October, 1999, following proper notice, held a public hearing regarding the request and, following the hearing, voted unanimously to grant the Conditional Use Permit; and,
WHEREAS, the Blue Earth County Board of Commissioners finds:
1. That the proposed off-premise sign conforms with the County Land Use Plan.
2. That the proposed off-premise sign will not degrade the water quality of the County.
- That the proposed off-premise sign will not adversely increase the quantity of water runoff.
4. That soil conditions are adequate to accommodate the proposed off-premise sign.
5. That the proposed off-premise sign does not create a potential pollution hazard.
6. That the off-premise sign will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted.
7. That the establishment of the off-premise sign will not impede the normal and orderly development and improvement of surrounding vacant property for predominant uses in the area.
8. That adequate measures have been or will be taken to control the lighted sign in such a manner that no disturbance to neighboring properties will result.
9. That site specific conditions and such other conditions are established as required for the protection of the public’s health, safety, and general welfare.
NOW THEREFORE BE IT RESOLVED, by the Blue Earth County Board of Commissioners, that the applicants request for a conditional use permit to move an existing off-premise, advertising sign located in the center of what is now Loren Drive, Crane Subdivision to a location fifty (50) feet east along the TH 169/60 right-of-way to the east of the existing location is granted contingent upon the following conditions:
1 The source light for the purpose of illumination may be indirect or direct and shall not be directed in any way except into the advertising copy.
2. All signs shall be painted and maintained by the owner in a safe condition. A sign shall be repainted whenever its paint begins to fade, chip or discolor. The exposed uprights or superstructure shall be painted a single, neutral color.
3. The area around a ground-mounted off-premise sign shall be appropriately landscaped, kept free of weeds and other debris, and regularly maintained or mowed.
4. The sign shall be maintained without tears or rips at all times.
5. The applicant shall ensure that vandalism, graffiti, and tears or rips to the sign or support structure are properly repaired within 10 days.
6. The applicant shall conform with all setbacks and standards contained in the Blue Earth County Land Use Ordinance, Section 0100.1610, Off-Premise Signs.
7. Any agricultural drainage tile encountered disturbed during the construction process shall be repaired and relocated, and the sign moved to accommodate the drainage tile if necessary.
8. The applicant shall obtain a Construction Permit prior to beginning construction on the sign.
9. Violations of any of the above conditions may lead to a review of the Conditional Use Permit by the Planning Commission and County Board of Commissioners.
- The Conditional Use Permit shall be effective for a period of five years following
County Board approval, whereupon it may be reviewed, renewed, or terminated.
This resolution shall become effective immediately upon its passage and without publication.

Commissioner Landkamer moved and Commissioner Barnes seconded the motion to set November 23, 1999 at 9:30 a.m. in the Boardroom, Courthouse, to hear a request to amend the Blue Earth County Land Use Ordinance; Section 18, Conditional Use Permits: Section 19, Map Amendments; and Section 21, Board of Adjustment, Prohibiting Re-application for Variances, Conditional Use Permits, Subdivisions and Re-zone request for a 12 month period following denial by the Blue Earth County Board of Commissioners or Zoning Board of Adjustment. Commissioner Landkamer moved and Commissioner McLaughlin seconded the motion to accept the grant and reimbursement from the Minnesota Department of Public Safety:
STATE OF MINNESOTA
GRANT CONTRACT FOR
S.T.E.P.
RESOLUTION AUTHORIZING EXECUTION OF GRANT CONTRACT
BE IT RESOLVED that Blue Earth County enters into a Grant Contract with the Minnesota Department of Public Safety, State Patrol Division for the program entitled S.T.E.P. (Strategic Traffic Enforcement Project)
Al Bennett, Board Chairperson, is hereby authorized to execute and sign such Grant Contracts and amendments thereto, as are necessary to implement the program on behalf of Blue Earth County.

Commissioner Barnes moved and Commissioner More seconded the motion to approve the Snowmobile Safety Enforcement Grant Agreement in the amount of $4,510.00 with the State of Minnesota, acting by and through the Commissioner of Natural Resources, for July 1, 1999 through June 30, 2000. The Financial Status Report for September 30, 1999 was presented to the Board as an informational item.
Commissioner Landkamer moved and Commissioner More seconded the motion to set the rate for the Assistant County Bailiffs at $40.00/half day and $75.00/full day. The motion carried. 99-396 (Adjust Budgets Accordingly)
5. TH #83 BRIDGE CROSSING OVER C.D. #25
Mr. Rolin Sinn, District Hydraulics Engineer for MnDOT, presented information on the Trunk Highway #83 bridge crossing over County Ditch #25. Tentative plans are to let the project in late summer of 2001.
6. COMMUNITY CORRECTIONS GRANT
Ms. Kelly Peterson, Corrections Counselor and Mr. Mike McGuire, Juvenile Corrections Supervisor, presented the following items for the Boards consideration.
Commissioner Landkamer moved and Commissioner Barnes seconded the motion to approve the following:
YOUTH INTERVENTION PROGRAM
RESOLUTION OF SPONSORSHIP
BE IT RESOLVED that Blue Earth County act as sponsoring agency or unit of government and grantee for the project titled Blue Earth County Youth Diversion Program to be conducted by Blue Earth County Community Corrections during the period from 1/1/2000 through 12/31/2000.
The County Board Chairperson is hereby authorized to apply to the Workforce Preparation Branch, Department of Economic Security for funding of the project and execute such agreements as are necessary to implement the project on behalf of Blue Earth County.

Commissioner Barnes moved and Commissioner More seconded the motion to approve a Juvenile Detention Services Grant with the Minnesota Department of Corrections. The grant is in the amount of $5,631.00 per year, for the two-year period from July 1, 1999 to June 30, 2001 and is to be used to defray the costs of operating the secure detention placements in the Minnesota River Valley Juvenile Detention Center in New Ulm. 7. HUMAN SERVICES
Mr. Dennis McCoy, Deputy County Administrator; Mr. Bob Meyer, Assistant Human Service Director, and Mr. Paul Schuster, Human Service Advisory Board Chairperson, presented the following Human Service items for the Boards consideration.
Commissioner Landkamer moved and Commissioner More seconded the motion to approve the 2000-2003 Community Health Service Plan for Blue Earth County. The motion carried. 99-399
