The County Board of Commissioners met in the Commissioners'
Room at 9:00 a.m. Present were Chairperson Lin Barnes,
Commissioner Colleen Landkamer, Commissioner Al Bennett,
Commissioner Alvis More, County Attorney Ross Arneson and County
Administrator David Twa.

authorization for a public sale of this land be granted,

4. PLANNING AND ZONING
Mr. Veryl Morrell, Land Use and Natural Resources
Administrator and Mr. Bill Goebel, Land Use Specialist, presented
the following Planning and Zoning items for the Boards
consideration.
Commissioner Bennett moved and Commissioner More seconded the
motion to approve the following:
RESOLUTION EXTENDING A CONDITIONAL USE PERMIT
FOR GRAVEL EXTRACTION IN A CONSERVATION ZONING DISTRICT
SECTION 13, GARDEN CITY TOWNSHIP and SECTION 18, RAPIDAN
TOWNSHIP
WHEREAS, Donald and Joyce Friedrichs owner of the following
real estate in Blue Earth County to wit:
- The North half of the Northwest Quarter in Section 18 of
Rapidan Township said tract containing 74.80 acres, and
- The Northeast Quarter of the Northeast Quarter except the
Power Company's 14.05 acres in Section 13 of Garden City
Township said tract containing 25.950 acres
and W. Hodgman & Sons, Inc., property lessee, have applied for a
permit to extract gravel in a Conservation Zoning District; and
WHEREAS, the Planning Agency of the County, on the 3rd day
of September, adopted a recommendation that the request for an
extension of the Conditional Use Permit be granted; and
WHEREAS, the Blue Earth County Board of Commissioners finds
that:
- 1. That the proposed use conforms with the County Land Use
Plan.
- 2. That the proposed use will not degrade the water quality
of the County
- 3. That the proposed use will not adversely increase the
quantity of water runoff.
- 4. That soil conditions are adequate to accommodate the
proposed use.
- 5. That the proposed use does not create a potential
pollution hazard.
- 6. That adequate utilities, access roads, drainage and
other necessary facilities have been or are being
provided.
- 7. That the Conditional Use will not be injurious to the
use and enjoyment of other property in the immediate
vicinity for the purposes already permitted.
- 8. That the establishment of the Conditional Use will not
impede the normal and orderly development and
improvement of surrounding vacant property for
predominant uses in the area.
NOW THEREFORE BE IT RESOLVED, by the Blue Earth County
Board of Commissioners, that the request for a Conditional Use
Permit, in a Conservation Zoning District is granted contingent
upon the following conditions:
General Conditions
(1) The mining operations shall be conducted in compliance with
the laws of the State of Minnesota and Federal Government,
especially related to safety standards, Blue Earth County
ordinances and resolutions, amended from time to time, and in
compliance with the furtherance of the approved reclamation
plan for the affected land.
(2) Clearing of the mining site shall conform to the development
and reclamation plan whenever possible. Existing trees and
shrubs shall remain in their natural state and not
prematurely stripped.
(3) Trucks used in hauling materials from the site shall be
loaded in such a manner to minimize spillage onto public
highways. Any spillage resulting from overloading or from
adhering to truck tires shall be removed at regular
intervals.
(4) The amount of overburden removed shall not be in excess of
that required to undertake operations in an economically
feasible manner. Less than 10 acres shall be considered
economically feasible. Development toward the final plan
shall be carried on as excavation progresses.
(5) Existing trees and ground cover along public road frontage
shall be preserved, maintained, and supplemented for the
depth of the required roadside setback.
(6) Proposed graded and back filled areas or banks as conforming
to approved reclamation plan shall be covered with sufficient
topsoil, based on the availability of existing topsoil, to
provide for revegetation. When back sloping is proposed on
the reclamation plan, the rate of slope shall be covered with
topsoil and seeded.
(7) Upon replacement of topsoil, trees, shrubs, legumes, grasses,
or other ground cover shall be planted upon the area in order
to avoid erosion, in accordance with the approved reclamation
plan.
(8) Operating procedures will be utilized to control dust and
noise so not be in conflict with adjoining property.
(9) Mining operations shall not be conducted closer than 50 feet
to the boundary of an adjoining property line, unless the
written consent of the owner of such adjoining property is
first secured.
(10) A reclamation performance bond in the amount of $1,000 per
acre shall be presented to the County to guarantee that
either upon termination of the permit or of the operations,
the ground surface of the land used shall be restored in
conformity with the reclamation plan.
Special Conditions
Hours of Operation
1. Hours of operation shall be limited to from 6:00 am through
8:00 pm, Monday through Saturday. There shall be no
operations on New Year's Day, Memorial Day, Fourth of July,
Labor Day, Thanksgiving Day, Christmas Eve, and Christmas
Day.
Safety
2. Speeds shall not exceed 20 mph when children are present or
30 mph at other times. "Trucks Hauling" signs shall be
placed at the intersection of the township haul road and
County Road 34.
Access
3. Access roads shall be maintained at and returned to pre
mining condition, during all phases of mining.
4. Dust control measures, including dust suppressing, surficial
treatments and reduced speed limits, shall be observed
regularly, in order to prevent nuisance dust conditions to
residences along access routes.
5. Rapidan Township, Garden City Township, and the County may
require controlled access measures in the form of signs and
gates, in the event illegal dumping or safety issues become a
concern.
Required permits
6. The operator shall maintain an MPCA mining permit and MPCA
permit to operate a hot mix plant.
7. If mining takes place within 300 feet of the Blue Earth
River, a permit shall be obtained from the DNR for mining
within the shoreland area.
Reclamation
8. Reclamation shall be completed within one year after the
gravel extraction is completed.
9. Excavated and stripped topsoil shall be preserved and stored
out of the floodplain. Measures to control run-off and
sedimentation shall be implemented. These measures include
seeding the stored topsoil, sedimentation fencing and run-off
barriers.
10. The first cell to be mined will be closed and reclamation
completed before the second cell is opened.
Road Restoration Bond
11. A road restoration bond in an amount determined by the County
Engineer per mile and assigned to Rapidan Township and the
County jointly for the purpose of assuring road restoration
and maintenance.
Site
12. The operator shall notify the Zoning Administrator within the
first 30 days of beginning operations to allow for a site
review.
13. Property lines shall be located and marked to assure that
setbacks from adjacent properties are maintained.
14. No extraction of gravel or operation of the hot mix plant
shall take place until after road restrictions have been
lifted each year.
15. This permit shall be valid for extracting up to 100,000 tons
of gravel until September 23, 1999 and for reclamation until
September 23, 2000.
This resolution shall become effective immediately upon its
passage and without publication.

RESOLUTION GRANTING A CONDITIONAL USE PERMIT
TO ESTABLISH A LEVEL II HOME OCCUPATION
IN A C-1, CONSERVATION ZONED DISTRICT
IN THE NE 1/4 SECTION 3O, LIME TOWNSHIP
WHEREAS, John H. Schwertfeger, owner of the following real estate
in the County of Blue Earth, Minnesota, to wit:
- all that part of the Northeast Quarter of Section No. 30,
Township No. 109 North, Range 26 West, described as follows:
Assuming that the West line of the Northeast Quarter of said
Section No. 30 is North and South - Commencing at the center
of said Section No. 30, thence North on the West line of said
Northeast Quarter 1152.70 feet, thence South 89 degrees 00
minutes East 1020.40 feet to the place of beginning; thence
South 87 degrees 58 minutes 27 seconds East 295.17 feet,
thence North 487.15 feet, thence South 84 degrees 00 minutes
West 294.00 feet, thence South 00 degrees 20 minutes West,
446.00 feet to place of beginning.
The applicant is applying for a conditional use permit to operate
a level II home occupation from his residence in Lime Township;
and,
WHEREAS, the Planning Agency of the County has completed a review
of the application and made a report pertaining to said request
(PC 57-97), a copy of said report has been presented to the County
Board; and,
WHEREAS, the Planning Commission of the County on the 3rd day of
September, 1997, following proper notice held a public hearing
regarding the request, and following the hearing, adopted a
recommendation that the request be granted; and,
WHEREAS, the Blue Earth County Board of Commissioners finds:
1. That the proposed use conforms with the Land Use Plan.
2. That with proper management, the proposed use will
not degrade the water quality of the County.
3. That with proper management, the proposed use
will not adversely increase the quantity of
water runoff.
4. That soil conditions are adequate to
accommodate the proposed use.
5. That the proposed use does not create a
potential pollution hazard.
6. That adequate utilities, access roads, drainage and
other necessary facilities have been or are being
proposed.
7. That the Conditional Use will not be injurious
to the use and enjoyment of other property in
the immediate vicinity for the purposes
already permitted.
8. That the establishment of the Conditional Use
will not impede the normal and orderly
development and improvement of surrounding
vacant property for the predominant uses in the area.
9. That adequate measures have been or will be
taken to prevent or control offensive odor,
fumes, dust, noise, and vibration, so that
none of these will constitute a nuisance, and
to control lighted signs and other lights in
such a manner that no disturbance to neighboring properties will result.
NOW THEREFORE BE IT RESOLVED, by the Blue Earth County Board
of Commissioners, that the request for approval of the Conditional
Use Permit for the Level II Home Occupation is hereby granted
contingent upon the following conditions.
1. The level II home occupation must be conducted entirely
within the dwelling or accessory building and shall be
carried on by the inhabitants thereof. No more than six
employees other than the inhabitants shall be allowed.
2. The total maximum floor area shall not exceed
5,000 square feet of floor space.
3. Only one non-illuminated sign shall be allowed. Said
sign shall be located on the property, and be limited to
not more than 32 square feet in area.
4. There shall be no indication of offensive noise,
vibration, smoke, dust, heat, or glare at or beyond the
property line.
5. The operation of the home occupation shall begin no
earlier than 8:00 a.m. and end no later than 5:00 p.m.
6. There shall be no outside storage of materials and
equipment.
7. Adequate off-street parking, including required
handicapped accessible parking, shall be provided.
8. The photo studio shall not include a photo lab for the
developing of photographs.
9. No hazardous wastes shall be generated by the home
occupation.
10. All wastes generated by the home occupation shall be
properly disposed of.
11. If the operation becomes or creates a public nuisance or
is out of compliance with the terms of the Conditional
Use Permit or other required permits, the County Board

this nine month period. Time extensions for Conditional Use

RESOLUTION TO ESTABLISH MARKET PRICE
FOR THE STATE SOLID WASTE MANAGEMENT TAX
WHEREAS, the new solid waste management tax requires
political subdivisions to identify by resolution a
market price if the political subdivision:
a. Subsidizes the cost of service at a facility; or
b. Directly bills on a property tax statement for
organized collection of mixed municipal solid
waste; and
WHEREAS, the political subdivision will be liable for
any solid waste management tax based only on the market
price amount identified through the resolution; and
WHEREAS, the market price is identified in state
statute as the "lowest price available in the area"; and
WHEREAS, Blue Earth County has performed research to
identify the lowest price available in the area;
NOW THEREFORE BE IT RESOLVED, that the Blue Earth
County Board of Commissioners declares a market price of
$50.40 per ton for a facility, based on a tipping fee
amount of $21.00 per ton at the Dickinson County
Landfill near Spirt Lake, Iowa and additional
transportation costs of $29.40 per ton.

RESOLUTION ON USE TAX FOR MIXED MUNICIPAL
SOLID WASTE MANAGEMENT SERVICES
WHEREAS, the Minnesota Department of Revenue (DOR) has
requested a voluntary audit of Blue Earth County's mixed
municipal solid waste management revenues and
expenditures for January 1, 1997 through June 30, 1997;
and
WHEREAS, the DOR has requested a voluntary audit and
report of Blue Earth County's mixed municipal solid
waste revenues from 1992 through 1996; and
WHEREAS, the voluntary audit includes a response
deadline of September 30, 1997, or penalties and
interest on potential tax liabilities may be imposed;
and
WHEREAS, the audit in mid-year will require counties to
audit now and again at year end; and
WHEREAS, there is ongoing confusion and controversy
over the DOR's interpretation of which county revenues
are taxable and which are not; and
WHEREAS, this self-audit states that county service fee
revenue included on property tax statements is taxable;
and
WHEREAS, this interpretation negates the Legislature's
intended effect of the SCORE Use Tax moratorium.
THEREFORE BE IT FURTHER RESOLVED, that Blue Earth
County formally requests the Minnesota Department of
Revenue to suspend the current deadline for responding
to the self-review to such a time in 1998 that will
require all counties to complete this review once to
comply with the moratorium enacted as part of Chapter
231 (1997 Omnibus Tax Bill).

information on different experimental sewage treatment systems

7. JUVENILE DETENTION GRANT
Mr. Mike McGuire, Juvenile Corrections Supervisor, presented
the following item for the Boards consideration.
Commissioner Landkamer moved and Commissioner Bennett
seconded the motion to approve a grant with the State of Minnesota
Department of Corrections to continue participating in the
Juvenile Detention Services Subsidy Program. The grant is
effective July 1, 1997, through June 30, 1999. The grant is used
to pay for operating our non-secure facility, placements in the
secure detention facility in New Ulm, and for electronic home
monitoring of certain juvenile offenders. The motion carried.

Mr. Dennis McCoy, Deputy County Administrator, presented the

Approval of an agreement with Midwest Welfare Fraud
Investigations for the period October 1, 1997 through
June 30, 1998.
Approval of the Local Service Unit Plan to provide
employment and training services for the period January
1, 1997 through June 30, 1999. This plan is the first
step in Welfare Reform and it is important to accomplish
the TANIF requirements.
Approval of an agreement with Copeland, Glenn, and
Associates, Inc. to develop, analyze, and report on the
potential for maximizing Medicaid reimbursements.
Approval of the 1998 MRCI rates for Blue Earth County.
Approval of a contract with MRCI to periodically clean
the "crisis apartment" between tenants. This agreement
runs through July 1, 1998.
Approval of the Community Health Services Plan.
Approval of the following agreements under the Elderly
Waiver Services, Alternative Care Services, Community
Alternative Care Services, or Community Alternatives for
Disabled Individual Services programs. This off-cycle
adjustment is required because of the Legislative change
to the rates allowed effective July 1, 1997. These

Mr. Al Forsberg, Public Works Director, presented the

Commissioner Bennett moved and Commissioner More seconded the
motion to reject the bid for the CSAH 69 Bridge Replacement,
Channel Relocation, Highway Relocation and Park Access Road
Project:
WHEREAS, only one bid was received and it was 41% over
the Engineer's estimate, and
WHEREAS, the Minnesota DNR, as partner in the project,
recommends the County reject the bid,
NOW THEREFORE, the County rejects the bid from S.M.C.
for construction of the CSAH 69 project.

the motion to approve the Victory Drive Extension and TH 14/CSAH 3
Interchange Feasibility Study:
WHEREAS, both the City of Mankato and Blue Earth County
wish to further explore the feasibility of extending
Victory Drive north from Madison Avenue to TH 14 and
construction of an interchange at this Victory Drive
Extension and TH 14; and
WHEREAS, the recently completed MATAPS96 Study
recommended that the County assume the jurisdiction of
this roadway,
NOW THEREFORE, the County Engineer is authorized to
enter into an agreement with the City and SRF to develop
a feasibility study for the project with BEC providing
50% of the $60,000 study costs.

WHEREAS, the amount of the grant has been determined to
be $4,330.87 by reason of the lowest responsible bid.
NOW THEREFORE, BE IT RESOLVED; that the County of
Blue Earth does hereby affirm that any cost of the
bridge in excess of the grant will be appropriated from
the funds available to the County of Blue Earth, and
that any grant monies appropriated for the bridge but
not required, based on the final estimate, shall be
returned to the Minnesota State Transportation Fund.

HEARING

Special Board Meeting to open bids for County Ditch #86 Main

Pursuant to publication, a Public Final Hearing was continued
from August 5, 1997 for the improvement of Branch 1 of County
Ditch #86. The Blue Earth County Board of Commissioners, acting
as the Drainage Authority pursuant to M.S. 103E.005, Subd. 9, held
a continuation of the Final Hearing, Pursuant to M.S. 103E.261 at
the Blue Earth County Courthouse on September 23, 1997. The
public hearing was opened for public comments by Chairperson
Barnes at 1:30 p.m.
Officials present included County Administrator/Acting Land
Records Director David Twa, County Attorney Ross Arneson, Ditch
Manager Jerry Kallheim, and Engineer Doug Parrott. A listing of
others present is included as part of the record. The proceedings
were tape-recorded.
Mr. Chuck Peterson, Attorney for the Petitioners, made
comments on the project.
Mr. Jerry Kallheim, Ditch Manager, verified that all
Jurisdictional Documents and Notices are in order.
Mr. Doug Parrott, Engineer, gave an update on the project and
provided a written report.
The DNR Commissioner's Advisory Report was read at the August
5, 1997 hearing, and no revisions have been received.
The Ditch Viewers report was presented at the August 5, 1997
Final Hearing and was confirmed by Mr. Obert Haldorson, Albert
Lea, at this continued Final Hearing. A copy of the report has
been filed.
All parties present were given an opportunity to express
their concerns and opinions. Public Comments were heard from: Mr.
David Wendorf, Attorney for Mr. Steel; Mr. Blaine Phillips; Mr.

2. Reports made or amended are complete and correct;
3. The damages and benefits have been properly determined;
4. The estimated benefits are greater than the total
estimated cost, including damages;
5. The proposed drainage project will be of public utility
and benefit and will promote the public health; and
6. The proposed drainage project is practicable.
Commissioner More moved and Commissioner Bennett seconded the
motion to approve the proposed drainage project, according to the
above findings; order the Engineer to prepare plans and specs for
bidding, and adopt the amended Viewers Report. The Findings will
be filed with the County Administrator/Acting Land Records

11. COUNTY DITCH #28
Pursuant to publication, a Public Final Hearing was held for
the Improvement of Main Line of Judicial Ditch #28. The Blue
Earth County Board of Commissioners, acting as the Drainage
Authority pursuant to M.S. 103E.005, Subd. 9, held a Final
Hearing, at the Blue Earth County Courthouse on September 23,
1997. The public hearing was opened for public comments by
Chairperson Barnes at 3:00 p.m.
Officials present included County Administrator/Acting Land
Records Director David Twa, County Attorney Ross Arneson, Ditch
Manager Jerry Kallheim, and Engineer Chad Surprenant. A listing
of others present is included as part of the record. The
proceedings were tape-recorded.
Mr. Chuck Peterson, Attorney for the Petitioners, made
comments on the project.
Mr. Jerry Kallheim, Ditch Manager, verified that all
Jurisdictional Documents and Notices are in order.
Mr. Chad Surprenant, Engineer, made a presentation and
provided a written report.
The DNR Commissioner's Advisory Report was read at the
Preliminary Hearing, and no revisions have been received.
The Ditch Viewers report was presented by Mr. Lowell Ross,
Albert Lea. A copy of the report has been filed.
All parties present were given an opportunity to express
their concerns and opinions. Public Comments were heard from:
Mr. Wayne Knewtson; Ms. Diane Ruedy; Mr. Bob Hoppe; and Ms. Edith
Herzberg.
