The County Board of Commissioners met in the Commissioners' Room at 9:00 a.m. Present were Chairperson Al Bennett, Commissioner Tom McLaughlin, Commissioner Colleen Landkamer, Commissioner Alvis More, Commissioner Lin Barnes, County Attorney Ross Arneson and Deputy County Administrator Dennis McCoy.
1. AGENDA REVIEW
Commissioner Barnes moved and Commissioner Landkamer seconded the motion to approve the Agenda.

The Commissioners reported on committees that they have attended since the last Board Meeting.
4. PLANNING AND ZONING
Mr. Veryl Morrell, Land Use & Natural Resources Administrator, Mr. Scott Salsbury, Land Use Planner and Mr. Bill Goebel, Land Use Specialist, presented the following Planning and Zoning items for the Boards consideration.

After discussion, Commissioner More moved and Commissioner McLaughlin seconded the motion to approve the following Conditional Use Permit:
RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO TRANSFER A DEVELOPMENT RIGHT FROM THE NW 1/4 OF THE NW 1/4, SECTION 4, SHELBY TOWNSHIP TO THE SE 1/4 OF THE NW 1/4, SECTION 4, SHELBY TOWNSHIP
WHEREAS, Marlyn Lewellyn Wendt, owner of the following real estate in the County of Blue Earth, Minnesota, to wit:

have applied for a Conditional Use Permit to Transfer a Residential Development Right from the Northwest Quarter of the Northwest Quarter Section 4, Shelby Township to the Southeast Quarter of the Northwest Quarter Section 4, Shelby Township for the purpose of adding a home to a quarter-quarter section with an existing house.
WHEREAS, the Planning Agency of the County has completed a review of the application and made a report pertaining to said request (PC 55-99), a copy of said report has been presented to the County Board; and
WHEREAS, the Planning Commission of the County on the 4th day of August 1999, following proper notice, held a public hearing regarding the request and, following the hearing, adopted a recommendation that the request for a Conditional Use Permit be granted; and
WHEREAS, the Blue Earth County Board of Commissioners finds:
- That the Transfer of Development Rights conforms with the County Land Use Plan.
- That the Transfer of Development Rights will not degrade the water quality of the County.
- That the Transfer of Development Rights will not adversely increase the quantity of water runoff.
- That soil conditions are adequate to accommodate the Transfer of Development Rights.
- That the Transfer of Development Rights does not create a potential pollution hazard.
- That adequate utilities, access roads, drainage and other necessary facilities have been or are being provided.
- That the Transfer of Development Rights will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted.
- That the establishment of the Transfer of Development Rights will not impede the normal and orderly development and improvement of surrounding vacant property for predominant uses in the area.
- That site specific conditions and such other conditions are established as required for the protection of the public’s health, safety, morals, and general welfare.
- That when the applicant made application for the Conditional Use Permit, the proposal met all required setbacks.
- That the Notification Amendment to the Agricultural District States: “Owners of property, residents, other users of property in the agricultural zone, and neighboring properties adjacent to the agricultural zone may be subjected to inconvenience or discomfort arising from normal and accepted agricultural practices and operations including, but not limited to; noise, odors, dust, operation of aircraft and late night operation of farm machinery, the storage and application of manure, fertilizers, soil amendments, herbicides, and pesticides associated with normal agricultural operations.
Owners of property, residents, other users of property in the agricultural zone, and neighboring properties adjacent to the agricultural zone, should be prepared to accept such inconveniences or discomfort from normal operations, and are hereby put on official notice, pursuant to Minnesota Statutes, Chapter 561.19, that this declaration may prevent them from obtaining a legal judgement against such normal operations;”
NOW THEREFORE BE IT RESOLVED, by the Blue Earth County Board of Commissioners, that the request for a Conditional Use Permit to Transfer Development Rights in an Agricultural District, is granted with the following condition:
- The applicant must subdivide and record all divisions of land in accordance with the provisions of the County Subdivision Ordinance.
This resolution shall become effective immediately upon its passage and without publication.

Ms. Sharon Mulenburg, Applicant; Mr. Bill Dickmeyer, Mankato; Mr. Jerry Stenzel; Duck Lake, spoke in favor of the next request.
After discussion, Commissioner Landkamer moved and Commissioner More seconded the motion to approve the following:
RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO RE-CONSTRUCT A NONCONFORMING SEASONAL CABIN IN THE RURAL TOWNSITE AND SHORELAND ZONED DISTRICTS ON A GENERAL DEVELOPMENT LAKE IN THE NE 1/4, NW 1/4, SECTION 27, JAMESTOWN TOWNSHIP
WHEREAS, Gregory Schmidt, Julie Bohnert, and Sharon Mulenburg, owners of the following real estate in the County of Blue Earth to wit:
Unit No. 408, Common Interest Community No. 19, a Planned Community, Doran’s Estates.
are requesting a conditional use permit to allow replacement of a seasonal cabin, in the Rural Townsite and Shoreland Districts on Duck Lake, which was destroyed by a wind storm on May 15, 1998; and,
WHERAS,In a letter dated July 19, 1999, Mymique Baxter, DNR Acting Area Hydrologist, states: “Please inform the Board of Adjustment that DNR Waters is agreeable to this Variance provided the replacement structure is of neutral, or earth-tone colors, and does not exceed the building footprint of the original cabin (380 square feet). Additional vegetative screening should consist of a mixture of deciduous and conifer plantings throughout the area between the lake and the structure. It should be made clear to the applicant that no deck is permitted on the lake side of the new structure since they will already be at the edge of the shore impact zone”; and,
WHERAS, the Planning Agency of the County has completed a review of the application and made a report pertaining to said request (PC 56-99), a copy of said report has been presented to the County Board; and,
WHERAS, the Planning Commission of the County on the 4th Day of August, 1999, following proper notice, held a public hearing regarding the request and, following the hearing, voted unanimously to recommend approval of the request to the County Board; and,
WHEREAS, the Blue Earth County Board of Commissioners, on the 24th Day of August, 1999, following proper notice, held a public hearing regarding the request and, following the hearing, voted unanimously to grant the Conditional Use Permit; and,
WHEREAS, the Blue Earth County Board of Commissioners finds:
- The cabin owners have advised that their insurance company has totaled the cabin. The cabin has already been removed from the property.
- A Conditional Use Permit is required to rebuild non-conforming structures when they are more than 50 % destroyed as a result of disaster.
- The proposed use conforms with the County Land Use Plan.
- The proposed use will not degrade the water quality of the county.
- The proposed use will not adversely increase the quantity of water runoff.
- Soil conditions are adequate to accommodate the proposed use.
- The proposed use does not create a pollution hazard.
- Adequate access roads, drainage, and other necessary facilities have been or are being provided.
- The Conditional Use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted.
- The Conditional Use will not impede the normal and orderly development and improvement of surrounding vacant property for predominant uses in the area.
- Permits are being issued for holding tanks when septic system upgrades are required pursuant to Shoreland regulations. Holding tanks are seen as a temporary solution to sewage problems for existing non-conforming uses when lot size or soils conditions prevent installation of an on-site sewage treatment system. This practice is consistent with the common goal of eliminating substandard septic systems and sources of pollution to surface waters.
- Site specific conditions and such other conditions are established as required for the protection of the public's health, safety, and general welfare.
- The Conditional Use Permit is reasonable in this case due the prior use of the site, even if it may not fully comply with current zoning standards and is being “grand-fathered in” due to unique, fact specific circumstances.
NOW THEREFORE BE IT RESOLVED, by the Blue Earth County Board of Commissioners, that the
applicants request for a conditional use permit to allow replacement of a destroyed seasonal cabin is granted contingent upon the following conditions:
- No construction may commence until construction permits have been obtained.
- A temporary holding tank must be installed to serve the cabin until municipal utilities become available. Records pertaining to maintenance and pumping of the tank will be kept and made available to the County Sanitarian upon request.
- The existing outhouse will be cleaned, properly abandoned, and removed from the property.
- The applicant agrees to connect to municipal utilities when they become available.
- No above grade decks shall be placed in front of the cabin.
- Vegetative screening (at least six feet tall) shall be planted between the lake and the cabin.
- The cabin shall be painted in neutral or earth-tone colors to blend into the natural environment.
This resolution shall become effective immediately upon its passage and without publication.
The motion carried. 99-307 Commissioners Barnes and Bennett voted nay.
Commissioner More moved and Commissioner Barnes seconded the motion to approve the following Conditional Use Permit:
REQUEST FOR A CONDITIONAL USE PERMIT FOR A LEVEL II HOME OCCUPATION TO AUTHORIZE EXPANSION OF AN EXISTING WELDING SHOP IN AN AGRICULTURAL ZONED DISTRICT IN THE NE 1/4, SW 1/4, SECTION 11, STERLING TOWNSHIP
WHEREAS, Leon Lieferman, dba Maple River Welding, owner of the following real estate in the County of Blue Earth to wit:
Commencing at a point 313.5 feet South of the Northeast Corner of the Northeast Quarter of the Northeast Quarter (NE 1/4) of the Southwest Quarter (SW 1/4) of Section 11, Township 105 North, Range 27 West, thence due West; thence due South, parallel with the South line of said section, a distance of 940.5 feet; thence due East; parallel with the South line of said section, a distance of 528 feet; thence due North, parallel with the West line of said section, a distance of 940.5 feet to the point of beginning.
has requested a Conditional Use Permit to authorize expansion of an existing welding shop as a Level II Home Occupation in an Agricultural Zoned District in the NE 1/4, SW 1/4, Section 11, Sterling Township. The request is being made to bring the operation into compliance with requirements of the County Land Use Ordinance; and,
WHERAS, the Planning Agency of the County has completed a review of the application and made a report pertaining to said request (PC 57-99), a copy of said report has been presented to the County Board; and,
WHERAS, the Planning Commission of the County on the 4th Day of August, 1999, following proper notice, held a public hearing regarding the request and, following the hearing, voted unanimously to recommend approval of the request to the County Board; and,
WHEREAS, the Blue Earth County Board of Commissioners, on the 24th Day of August, 1999, following proper notice, held a public hearing regarding the request and, following the hearing, voted unanimously to grant the Conditional Use Permit; and,
WHEREAS, the Blue Earth County Board of Commissioners finds:
- That the proposed use conforms with the Land Use Plan.
- That with proper management, the proposed use will not degrade the water quality of the County.
- That with proper management, the proposed use will not adversely increase the quantity of water runoff.
- That soil conditions are adequate to accommodate the proposed use.
- That the proposed use does not create a potential pollution hazard.
- That adequate utilities, access roads, drainage and other necessary facilities have been or are being proposed.
- That the Conditional Use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted.
- That the establishment of the Conditional Use will not impede the normal and orderly development and improvement of surrounding vacant property for the predominant uses in the area.
- That adequate measures have been or will be taken to prevent or control offensive odor, fumes, dust, noise, and vibration, so that none of these will constitute a nuisance, and to control lighted signs and other lights in such a manner that no disturbance to neighboring properties will result.
- The intensity of the proposed use is not greater than the intensity of the surrounding land uses.
NOW THEREFORE BE IT RESOLVED, by the Blue Earth County Board of Commissioners, that the request to grant a Conditional Use Permit to authorize expansion and continuation of a welding shop as a Level II Home Occupation in an Agricultural Zoned District in the NE 1/4, SW 1/4, Section 11, Sterling Township, is hereby approved contingent upon the following conditions.
- Construction and septic permits be obtained before beginning construction.
- The Level II Home Occupation must be conducted entirely within the dwelling or accessory building and shall be carried on by the inhabitants thereof. No more than six (6) employees shall be allowed other than the inhabitants.
- The total maximum floor area shall not exceed 5,000 square feet.
- Signage shall be limited to a 32 square foot non-illuminated sign located on the property.
- There shall be no indication of offensive noise, vibration, smoke, dust, heat, or glare at or beyond the property line.
- The operation of the home occupation shall begin no earlier than 8:00 a.m. and end no later than 9:00 p.m.
- Materials and equipment shall be stored in an enclosed building or screened area.
- Adequate off-street parking shall be provided.
- If the operation becomes or creates a public nuisance or is out of
compliance with the terms of the Conditional Use Permit or other required
permits, the County Board may review the Conditional Use Permit.
- This Conditional Use Permit shall be effective for a period of five years, after which it will be reviewed by the Blue Earth County Board.
This resolution shall become effective immediately upon its passage and without publication.

Commissioner Barnes moved and Commissioner More seconded the motion to approve the following:
RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO CONSTRUCT ONE TOTAL CONFINEMENT SWINE BARN EXPANDING AN EXISTING FEEDLOT FROM 269 A.U. TO 331 A.U. LOCATED IN THE NORTHEAST QUARTER OF SECTION 9, VERNON CENTER TOWNSHIP
WHEREAS, Henry Roelofs, owner of the following real estate in the County of Blue Earth, Minnesota, to wit:
Commencing at the Northeast corner of the Southeast Quarter (SE1/4) of Section 9, Township 106, Range 28, thence South 795' to the point of beginning; thence continuing South on the North/South section line to the point of intersection with the center thread of County Ditch # 78; thence westerly and northerly along the center thread of County Ditch No. 78 to a point due West of the point of beginning; thence East to the point of beginning.
has applied for a Conditional Use Permit to construct a total confinement hog operation in an A, Agriculture Zoning District; and
WHEREAS, the Planning Agency of the County has completed a review of the application and made a report pertaining to said request (PC-58-99 ), a copy of said report has been presented to the County Board; and
WHEREAS, the Planning Commission of the County on the 4th day of August, 1999, following proper notice, held a public hearing regarding the request and, following the hearing, adopted a recommendation that the request for a Conditional Use Permit be granted; and
WHEREAS, the Blue Earth County Board of Commissioners finds that:
- That with proper management of the proposed barn and with proper manure application, the Conditional Use should not be injurious to the use and enjoyment of other property in the immediate vicinity designated for agricultural uses.
- That with proper management of the proposed barn and with proper manure application, this facility should not constitute a pollution problem.
- That the predominant use in the area is agriculture. The Conditional Use should not impede the normal and orderly development and improvement of surrounding vacant property for agricultural uses.
- Adequate utilities, access roads, drainage and other necessary facilities have been or will be provided.
- Adequate measures will be taken to provide sufficient off-road parking and loading space to serve the proposed use.
- Soil conditions are adequate to accommodate the proposed request.
- Proper facilities will be provided which will eliminate any traffic congestion or traffic hazard which may result from the proposed use.
- The feedlot is not greater than the feedlot standards allowed in the A, Agricultural Zoning District.
- The proposed use is consistent with the County Land Use Plan.
- That the proposed use does not include residential development.
- That the proposed use does not include industrial development.
NOW THEREFORE BE IT RESOLVED, by the Blue Earth County Board of Commissioners, that the request for a Conditional Use Permit, to build one total confinement swine barn in an Agriculture Zoning District, is granted with the following conditions:
- That the total confinement barn, conforms with the site plan attached to this report PC 58-99.
- That the feedlot, including all buildings and the proposed barn, be located on a single, legally described parcel consisting of a minimum of ten contiguous acres. The parcel shall be a parcel of record, properly recorded in the Blue Earth County Land Records Office.
- That the applicant must obtain a Blue Earth County Feedlot Permit and a Certificate of Compliance before any animals are placed in the barn.
- That the applicant obtain a Blue Earth County Construction Permit before building begins and within one year from the date the County Board of Commissioners approves the Conditional Use Permit. The permit shall be rendered invalid if application for a Construction Permit is not made within this one year period. Time extensions for Conditional Use Permits must be obtained from the County Board of Commissioners subsequent to a public hearing conducted by the Planning Commission.
- That the applicant obtain a Department of Natural Resources, “Water Appropriations Permit” before any animals are placed in the proposed barn.
- That a perimeter footing drain tile be located at or below the bottom of the pit footings. The footing tile shall include one inspection pipe for each concrete pit. The native materials must be excavated and walls back filled with granular material (pit run gravel or equivalent).
- That application of manure be on the land documented in the aerial photos included in the State of Minnesota Application for Construction and Operation of an animal feedlot. The application of manure shall comply with standards set forth in Attachment A-1, Manure Management Summary and Attachment A-4, Manure Application Setbacks, as contained in staff report PC 58-99.
- That the disposal of dead animals be consistent with the Minnesota Board of Animal Health regulations.
- That the applicant provide an enclosed location for the pick up of dead animals before any animals are placed in the proposed barn.
- That adequate measures be taken to minimize or control offensive odor, fumes, dust, noise, or vibrations so that none of these will constitute a nuisance.
- That all manure storage structures must be designed by a registered engineer. A copy of the designed plans must be submitted to Blue Earth County Environmental Services prior to the issuance of a construction permit.
This resolution shall become effective immediately upon its passage and without publication.

RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO CONSTRUCT ONE TOTAL CONFINEMENT SWINE BARN EXPANDING AN EXISTING FEEDLOT FROM 960 A.U. TO 1,200 A.U. LOCATED IN THE NORTHEAST QUARTER OF SECTION 9, VERNON CENTER TOWNSHIP
WHEREAS, Henry Roelofs, owner of the following real estate in the County of Blue Earth, Minnesota, to wit:

5. HUMAN SERVICES
Mr. Dennis McCoy, Deputy County Administrator, presented the following Human Service items for the Boards consideration.
Commissioner Landkamer moved and Commissioner Barnes seconded the motion to approve the following:
Approval of an agreement with Community Partners Incorporated to provide wraparound training services.
The County Board previously agreed to be a Minnesota Care enrollment site and provide case management services to Minnesota Care enrollees. DHS subsequently announced a 12-day training requirement for staff conducting this function as well as other administrative requirements. Approve to rescind the previous action and decline becoming a Minnesota Care enrollment site.
Approve the FY2000 grant agreement for the Sexual Violence Resource Center with the State of Minnesota. This is a renewal agreement for a total of $62,000 for the period July 1, 1999, through June 30, 2000.
Approve the draft Community Social Service Act plan.
Approval of the child protective services screening criteria. The document describes the procedural handling of child protection reports; how the intake process functions; the criteria to be used for determining when the child protection assessment is necessary; as well as the statutory definitions of physical abuse, neglect, and sexual abuse. The document also describes what information may be shared and with whom.
Approval of an agreement with the Sheriff’s Youth Program to provide a children’s day treatment program for the time frame September 1, 1999, through August 31, 2000.
Approval of an agreement with Independent School District No. 77 (Mankato) to provide a day treatment program for the period September 1, 1999, through August 31, 2000.
Approval of an agreement with the Department of Health for the Woman, Infants, and Children (WIC) Program administration for the period October 1, 1999, through September 30, 2001.
Approval of an agreement with Alliance Health Care to provide waivered services under the Medicaid Program.

6. COUNTY DITCH UPDATE
Mr. Chad Surprenant, I & S Engineers and Architechts, updated the Board on the construction of County Ditch #36.
Mr. Greg Mikkelson and Mr. Darrell Hylen, asked questions concerning the project.
After discussion, Commissioner Barnes moved and Commissioner More seconded the motion to approve Application for Payment #6 from Brunz Construction and withhold $150,000 at the end of the contract until all conditions are met on County Ditch #36.
