BLUE EARTH COUNTY, MINNESOTA

July 13, 1999



The County Board of Commissioners met in the Commissioners' Room at 9:00 a.m. Present were Chairperson Al Bennett, Commissioner Tom McLaughlin, Commissioner Colleen Landkamer, Commissioner Alvis More, Commissioner Lin Barnes, County Attorney Ross Arneson and County Administrator David Twa.

1. AGENDA REVIEW
Commissioner Landkamer moved and Commissioner More seconded the motion to approve the amended Agenda to include a Gambling License. The motion carried. 99-252

2. COMMISSIONERS’ REPORTS ON COMMITTEES
The Commissioners reported on committees that they have attended since the last Board Meeting.

4. SAFE AND SOBER GRANT
Sheriff Brad Peterson and Deputies Rich Murray and Tom Coulter, presented the following item for the Boards consideration.
Commissioner Barnes moved and Commissioner Landkamer seconded the motion to approve the following Resolution:

RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT

Be it resolved that Blue Earth County Sheriff’s Department enter into a grant agreement with the Minnesota Department of Public Safety, Office of Traffic Safety for the project entitled SAFE & SOBER COMMUNITIES during the period from October 1, 1999 through September 30, 2000.

The Sheriff of Blue Earth County is hereby authorized to execute such agreements and amendments as are necessary to implement the project on behalf of the Blue Earth County Sheriff’s Department.

3. ADMINISTRATIVE SERVICES
Mr. David Twa, County Administrator, presented the following items for the Boards consideration.
Commissioner Landkamer moved and Commissioner McLaughlin seconded the motion to approve the following Personnel items:
Employment of John Kronlokken, Waste Management Specialist (C41), with a starting salary of $14.40 per hour effective July 26, 1999. (Environmental Services)

Employment of Kimberly George, Custody Officer (B23), with a starting salary of $12.09 per hour effective July 20, 1999. (Sheriff)

Promotion of Michele Mulenburg, from Custody Officer (B23) to Jail Resource Coordinator/Custody Officer (B31) with a salary adjustment from $13.20 to $13.59 per hour effective July 14, 1999. (Sheriff)

Promotion of Jodi Appledorn, from Clerk II (A13) to Clerical Specialist II (B22) with a salary adjustment from $9.64 to $11.34 per hour effective July 14, 1999. (Human Services)

Appointment of Brad Schultz, from Captain (C51) to Chief Deputy (D61) with a salary adjustment from $22.11 to $25.16 per hour effective July 14, 1999. (Sheriff)

Authorization to initiate recruitment for a Captain (C51). (Sheriff)

Commissioner Barnes moved and Commissioner More seconded the motion to approve the following Bills:

Commissioner Landkamer moved and Commissioner More seconded the motion to approve a grant agreement with the Minnesota Department of Human Services for the continued implementation of the child welfare reform pilot project. This grant covers two implementation and spending periods of July 1, 1999, through June 30, 2000, for $105,000.00 and July 1, 2000, through June 30, 2001, for $100,000.00. Commissioner Landkamer moved and Commissioner More seconded the motion to authorize the Chairperson and County Administrator to sign an agreement with Community Partners Research, Lake Elmo, MN for $18,000 to conduct a study to gather information about housing in Blue Earth County outside the City of Mankato. Commissioner Barnes moved and Commissioner McLaughlin seconded the motion to approve an Application to Conduct Excluded Bingo License to St. Matthew’s Catholic Church, Vernon Center, to hold bingo at the Blue Earth County Fair, Garden City, on August 12-15, 1999. The motion carried. 99-259

5. NICHOLS ENTRYWAY BIDS
Mr. Steve Michel, Physical Plant Director, presented the following Bid for the Boards consideration.
Pursuant to publication, the following bids were received, opened and reviewed with the following results:

Commissioner Barnes moved and Commissioner McLaughlin seconded the motion to award the low bid of $99,925 to R.W. Carlstrom, Mankato, MN. The motion carried. 99-260

6. MVAC HOUSING LOAN RESOLUTION
Mr. Tom Kopp, Mr. Clyde Haslip and Ms. Sheila Ouf, from Minnesota Valley Action Council (MVAC), presented the following item for the Boards consideration.
Commissioner Barnes moved and Commissioner More seconded the motion to approve the following Resolution:

RESOLUTION AUTHORIZING APPLICATION FOR
MHFA REHABILITATION LOAN PROGRAM FUNDS

WHEREAS, the Minnesota Housing Finance Agency, State of Minnesota, has been authorized to undertake a program to provide loans to property owners for the purpose of housing rehabilitation; and
WHEREAS, Minnesota Valley Action Council has developed an application as an Administering Entity for the Minnesota Housing Finance Agency Rehabilitation Loan Programs; and

WHEREAS,
Minnesota Valley Action Council has demonstrated the ability to perform the required activities of the Minnesota Housing Finance Agency Rehabilitation Loan Programs;
NOW, THEREFORE, BE IT RESOLVED, that Minnesota Valley Action Council is hereby authorized as an entity to be charged with the administration of funds made available through the Minnesota Housing Finance Agency Rehabilitation Loan Programs, in Blue Earth County.

7. PUBLIC WORKS
Mr. Al Forsberg, Public Works Director, presented the following items for the Boards consideration.
Commissioner Landkamer moved and Commissioner More seconded the motion to approve a supplemental agreement with MnDOT for Federal participation in Right-of-Way/Land Acquisition for the Mankato South Route Project:

CSAH 90 RIGHT-OF-WAY SUPPLEMENTAL AGREEMENT

BE IT RESOLVED that Al Bennett, Board Chairman, and David Twa, County Administrator, are hereby authorized and directed for and on behalf of the County to execute and enter into an agreement with the Commissioner of Transportation prescribing the terms and conditions of said federal aid participation as set forth and contained in “Minnesota Department of Transportation Agency Agreement No. 72266 Supplement #1,” a copy of which said agreement was before the County Board and which is made a part hereof by reference.

Commissioner Landkamer moved and Commissioner McLaughlin seconded the motion to approve the following:

RESOLUTION
MINNEOPA TRAIL
MNDNR COOPERATIVE TRAILS GRANT
CONCURRENCE AND FISCAL AGENT

WHEREAS, the Minneopa Trail, a bicycle/pedestrian trail connecting Sibley Park and Minneopa park, would serve as an important link in the regional trail system including the Minnesota River Trail, Sakatah Trail, Red Jacket Trail and South Route Trail and link Minneopa State Park and the City of Mankato’s Sibley Park; and

WHEREAS, Federal TEA-21 enhancement funds in the amount of $600,000 (80% or $480,000 in Federal and 20% or $120,000 local matching funds) have been approved for the year 2000; and

WHEREAS, 50% of the Federal match up to $50,000 has been approved for the State of Minnesota Cooperative Trails grants program and the remaining $70,000 would be some combination of Blue Earth County, MnDot, MnDNR Parks, and City of Mankato funds;

NOW THEREFORE, the Blue Earth County Board concurs with the development of this project; accepts the Cooperative Trails grant of 50% of the Federal matching costs up to a maximum of $50,000; and directs Alan Forsberg, County Engineer, to serve as the fiscal agent for the project.

8. COUNTY DITCH #25 - CONTINUED PRELIMINARY HEARING

Pursuant to publication, a Public Preliminary Hearing was held for the Improvement of County Ditch #25. Blue Earth County Commissioners Colleen Landkamer, Alvis More, Linley Barnes, Tom McLaughlin, and Al Bennett, acting as the Drainage Authority pursuant to M.S. 103E.005, Subd. 9, continued a Preliminary Hearing from May 25, 1999, at the Blue Earth County Courthouse on July 13, 1999. The public hearing was opened for public comments by Chairperson Bennett at 1:30 p.m.
Officials present included County Administrator David Twa, Land Records Director Sandra King, County Attorney Ross Arneson, Ditch Manager Craig Austinson, and Engineer Chad Surprenant. A listing of others present is included as part of the record. The proceedings were tape-recorded.
The DNR Commissioner’s Advisory Report was read into the record by Land Records Director Sandra King.
The Engineer gave a summary of the projects and options that were discussed at the May 25, 1999 hearing.
All parties present were given an opportunity to express their concerns and opinions. Public Comments were heard from: Mr. Chuck Peterson, Attorney representing Mr. Albert Juliar; Mr. Gus Johnson, Attorney representing Ms. Florence Standfest and children and Mr. Albert Juliar.
After Board discussion, Commissioner Barnes moved and Commissioner More seconded the motion to order a detailed survey report and appoint viewers.
Mr. Albert Juliar, applicant, requested to confer with his attorney, before a vote was taken.
After conferring with his attorney, Mr. Juliar requested to withdraw his petition for Improvement on County Ditch #25. He decided to proceed with option #2 “Governmental Programs” through NRCS office.
Commissioner Barnes moved to withdraw his previous motion and instead approve the withdraw of the petition and proceed with Option #2 "Government Programs”, Commissioner Landkamer seconded the motion. The motion carried. 99-264
After discussion with the Engineer, Commissioner More moved and Commissioner Landkamer seconded the motion to have a redetermination of benefits on County Ditch #25 and appoint the following ditch viewers: Mr. Tom Behrends, Mr. Lowell Ross and Mr. Obert Haldorson. The motion carried. Commissioner McLaughlin was not present for the vote. 99-265
Chairperson Bennett closed the public hearing at 2:21 p.m.

9. PUBLIC WORKS WORKSHOP

Mr. Al Forsberg, Public Works Director, presented items for the workshop.

Commissioner Landkamer moved and Commissioner More seconded the motion to

adjourn the Board Meeting at 4:00 p.m. The motion carried. 99-266
