The County Board of Commissioners met in the Commissioners' Room at 9:00
a.m. Present were Chairperson Keith Stoltzman, Commissioner Colleen
Landkamer, Commissioner Leon Tacheny, Commissioner Lin Barnes, Commissioner
Alvis More, County Attorney Ross Arneson and County Administrator David
Twa. 

Commissioner Landkamer moved and Commissioner More seconded the motion to
approve the agenda. The motion carried. 94-533 

Ms. Connie Ireland, MVAC, presented the following items for the Boards
consideration. Commissioner More moved and Commissioner Tacheny seconded
the motion to approve the Blue Earth County Housing Rehab Report and the
following waiver certificate:

COUNTY OF BLUE EARTH
CERTIFICATE OF WAIVER FOR SCDP LOAN REQUIREMENTS 

Due to the nature of this project, the repair costs have exceeded the now
present Small City Development Program guidelines. In order to proceed on
this project, MVAC is asking the Approval Board to waive the below
specified requirements as per the SCDP program policies and procedures.
Specifically this request is for the following changes: waive all equity
and leverage requirements for the Amboy/Good Thunder MURL Program.

Commissioner Tacheny moved and Commissioner More seconded the motion to
approve a tax abatement to Steven and Lynn Hanson, 45 Thro Court, Mankato,
MN R01-09-16-253-007 K-50802. The motion carried. 94-538

Commissioner Barnes moved and Commissioner More seconded the motion to
implement a fee of $30 which would represent the $24 payable to the FBI and
$6 payable to the County for applicant fingerprint cards used for
processing of firearms and related permits. The motion carried. 94-539

Mr. David Twa, County Administrator presented the August Financial Report
as an informational item. 

Ms. Julie Conrad, Land Use and Natural Resources Planner and Mr. Jerry
Floren, Land Use and Natural Resources Feedlot Specialist, presented the
following Planning and Zoning items for the Boards consideration.

to appoint the following individuals to the Water Planning and Feedlot
Subcommittees. Feedlot Subcommittee members:

Commissioner Landkamer moved and Commissioner More seconded the motion to
approve the following:

RESOLUTION VACATING CERTAIN UTILITY EASEMENTS 
OF BLOCKS ONE, FIVE, SIX AND SEVEN
OF CEDAR MEADOWS SUBDIVISION
DECORIA TOWNSHIP

WHEREAS, the owner of Lots 7, 8, and 9 of Block One; Lots 1, 2, and 3 of
Block Five; Lots 1, and 2 of Block Six, and Lots 1, 2, and 3 of Block Seven
of Cedar Meadows Subdivision has requested that the public utility
easements on said lots be vacated; and,

WHEREAS, the plat of Cedar Meadows Subdivision No. 2 overlays the said
utility easements; and, 

WHEREAS, said utility easements are no longer required to convey public
utilities for the plat of Cedar Meadows No. 2; and, 

WHEREAS, the Land Use and Natural Resources Office of the Environmental
Services Department has completed a review of the said public utility
easement vacation and made a report pertaining to said vacation, (CO
07-94), and a copy of said report has been presented to the County Board;
and, 

WHEREAS, the Planning Commission of the County on the 7th day of September,
1994, following proper notice, held a public hearing regarding said plat,
and following the hearing, adopted a recommendation that the final plat of
Cedar Meadows Subdivision No. 2. be approved, and that the said utility
easements be vacated.

NOW, THEREFORE, BE IT RESOLVED, that the Board of Commissioners of Blue
Earth County finds that the utility easements shown on Lots 7, 8, and 9 of
Block One; Lots 1, 2, and 3 of Block Five; Lots 1, and 2 of Block Six, and
Lots 1, 2, and 3 of Block Seven of Cedar Meadows Subdivision no longer
serve a public purpose, and that said public utility easements are vacated.

This resolution shall become effective immediately upon its passage and
without publication.

Commissioner More moved and Commissioner Tacheny seconded the motion to
approve the following:

RESOLUTION APPROVING FINAL PLAT
OF CEDAR MEADOWS SUBDIVISION NO. 2
DECORIA TOWNSHIP

WHEREAS, the owner of the property included in Cedar Meadows Subdivision
No. 2 has prepared a final plat; and, 

WHEREAS, the Land Use and Natural Resources Office of the Environmental
Services Department has completed a review of the final plat of Cedar
Meadows Subdivision No. 2 and made a report pertaining to said plat, (CO
07-94), and a copy of said report has been presented to the County Board;
and, 

WHEREAS, the Planning Commission of the County on the 7th day of September,
1994, following proper notice, held a public hearing regarding said plat,
and following the hearing, adopted a recommendation that the final plat of
Cedar Meadows Subdivision No. 2 be approved; and,

WHEREAS, the said plat conveys, two on-site sewage treatment easements on
each lot, accesses to a public right-of-way, and conforms with the other
applicable standards of the Blue Earth County Zoning Ordinance, Shoreland
Ordinance and Subdivision Ordinance.

NOW, THEREFORE, BE IT RESOLVED, that the Board of Commissioners of Blue
Earth County finds that the said plat conforms with the standards of the
applicable county ordinances, and hereby approves the final plat of Cedar
Meadows Subdivision No. 2 and authorizes the Chairperson of the Board and
the County Administrator to sign said plat.

This resolution shall become effective immediately upon its passage and
without publication.

Commissioner Barnes moved and Commissioner Tacheny seconded the motion to
approve the following Conditional Use Permit: 

RESOLUTION
GRANTING A CONDITIONAL USE PERMIT
OPERATION OF A BANQUET FACILITY
IN AN I-1 LIGHT INDUSTRIAL DISTRICT
LeHILLIER TOWNSITE, SOUTHBEND TOWNSHIP

WHEREAS, Rick Beil, lessee, and George Komardis, owner of the following
real estate in the County of Blue Earth, Minnesota, to wit:

Lots 17, 18, and 19 in Block 25, LeHillier City, Blue Earth County,
Minnesota, except highway and railroad property. 

Also, all of the following described property deeded by the Chicago, St.
Paul, Minneapolis and Omaha Railway Company, a Wisconsin Corporation, to
Arthur W Weite by deed dated July 27, 1964, recorded in Book 191, Blue
Earth County Records, page 609, and described as follows: All that part of

have applied for a Conditional Use Permit to operate a banquet hall in an
I-1 Light Industrial Zoning District, and 

WHEREAS, the Planning Agency of the County has completed a review of the
application and made a report pertaining to said request (CO 48-94), a copy
of said report has been presented to the County Board; and

WHEREAS, the Planning Commission of the County on the 7th day of September,
following proper notice, held a public hearing regarding the request and,
following the hearing, adopted a recommendation that the request for a
conditional user permit be granted; and

WHEREAS, the Blue Earth County Board of Commissioners finds that:

1. The proposed expansion is allowed as a conditional use 
and complies with the standards of the Zoning Ordinance.

2. The proposed use provides adequate parking as required 
by the Zoning Ordinance.

3. The proposed use has an operation plan which provides 
for hours of operation, security, rules of conduct for entertainers and
employees, and parking. 

4. The proposed expansion will not be detrimental to the 
other uses already permitted in the neighborhood. 

NOW THEREFORE BE IT RESOLVED, by the Blue Earth County Board of
Commissioners, that the request for a Conditional Use Permit, in an I-1
Light Industrial Zoning District, is granted with the following conditions:

1. The Conditional Use Permit will be reviewed by the 
Planning Commission after five years.

2. Any expansion of the building shall be cause for review 
of the Conditional Use Permit.

3. Parking spaces measuring a minimum of 9' x 20' each 
shall be provided at the rate of one for every four seats capacity, one for
loading, and one for every two employees, for the life of the Conditional
Use Permit. 

4. That hours the operation is open to the public be 
limited to from 9:00 am to 11:00 pm.

5. All reception/ banquet activities and entertainment be 
limited to inside of the existing structure. 

6. Limousine maintenance, storage and washing shall be 
conducted off site.

7. There shall be no exotic dancers or entertainment 
including but not limited to: motion pictures, show or other presentation
of a play, dance or other exhibition presented before an audience which, in
whole or in part, depicts nudity or sexual conduct.

This resolution shall become effective immediately upon its passage and

Commissioner Tacheny moved and Commissioner More seconded the motion to
approve the following Conditional Use Permit: 

RESOLUTION GRANTING A CONDITIONAL USE PERMIT FOR 
THE EXPANSION OF A CONFINED FEEDLOT
IN A PRIME AGRICULTURE ZONING DISTRICT
SECTION 28, LYRA TOWNSHIP

WHEREAS, Dean and David De Witz, owners of the following real estate
located in Blue Earth County, Minnesota, to wit: 

South one-half of the Southeast Quarter of Section 28, Township 106 North,
Range 27 West, Blue Earth County Minnesota, said parcel containing 80.00
acres. 

have applied for a conditional use permit to allow the expansion of a
confined feedlot in an A-1, Prime Agriculture Zoning District; and

WHEREAS, the Planning Agency of the County has completed a review of the
application and made a report pertaining to said request (CO 49-94), a copy
of said report has been presented to the County Board; and

WHEREAS, the Planning Commission of the County on the 7th day of September,
1994, following proper notice, held a public hearing regarding the request
and, following the hearing, adopted a recommendation that the request for a
conditional use permit be granted; and

WHEREAS, the Blue Earth County Board of Commissioners finds: 

1. That the proposed use conforms with the Zoning Ordinance. 

2. That the proposed use conforms with the Land Use Plan. 

3. That the proposed use has the required manure storage. 

4. That the proposed use has the spreadable acres required 
for manure application.

5. That the applicants have applied for all required 
permits.

6. That the proposed use will not create a potential 
pollution hazard.

NOW, THEREFORE, BE IT RESOLVED, by the Blue Earth County Board of
Commissioners, that the request for a conditional use permit for the
expansion of a confined feedlot in an A-1, Prime Agriculture Zoning
District, is granted with the following conditions:

General Conditions

1. That the confinement building conform with 
the site plan attached to Planning Commission CO 49-94 report.

2. That a Blue Earth County Certificate of 
Compliance be issued before a construction permit is issued.

3. That a Blue Earth County construction permit 
is issued before building begins.

4. That a minimum of one footing tile inspection 
pipe be included in the building design and construction of each concrete
pit.

5. That the land application of manure shall be 
on the land described in this report and shall comply with the Special
Conditions below, and the standards set forth in
Attachments A-1 and A-4 of Planning
Commission Report CO 49-94.

6. That the property owner shall comply with the 
provisions of the Blue Earth County Livestock Manure Management Ordinance,
Number 130, effective January 1, 1995.

Special Conditions

1. That all manure application setbacks be 
adhered to as described in Attachment A-4. 

2. That all manure storage areas are setback at 
least 500 feet from residences other than the operator's, and are setback
at least 50 feet from all property lines.

This resolution shall become effective immediately upon its passage and
without publication.

approve the following:

RESOLUTION GRANTING A CONDITIONAL USE PERMIT FOR 
THE EXPANSION OF A CONFINED FEEDLOT
IN A PRIME AGRICULTURE ZONING DISTRICT
SECTION 35, LYRA TOWNSHIP

WHEREAS, Bruce Stanton, owner of the following real estate located in Blue
Earth County, Minnesota, to wit: 

Southwest Quarter of the Southeast Quarter excluding the south 825 feet of
the west 184.75 feet of Section 35, Township 106 North, Range 27 West, said
parcel containing 36.500 acres.

has applied for a conditional use permit to allow the expansion of a
confined feedlot in an A-1, rime Agriculture Zoning District; and

WHEREAS, the Planning Agency of the County has completed a review of the
application and made a report pertaining to said request (CO 50-94), a copy
of said report has been presented to the County Board; and

WHEREAS, the Planning Commission of the County on the 7th day of September,
1994, following proper notice, held a public hearing regarding the request
and, following the hearing, adopted a recommendation that the request for a
conditional use permit be granted; and

WHEREAS, the Blue Earth County Board of Commissioners finds: 

1. That the proposed use conforms with the Zoning Ordinance. 

2. That the proposed use conforms with the Land Use Plan. 

3. That the proposed use has the required manure storage. 

4. That the proposed use has the spreadable acres required 
for manure application.

2. That a MPCA Certificate of Compliance be 
issued before a construction permit is issued for all manure storage areas
with a capacity of 500,000 gallons or more.

3. That a Blue Earth County Certificate of 
Compliance be issued before a construction permit is issued for manure
storage areas with a capacity of less than 500,000 gallons. 

4. That a construction permit is issued before 
building begins.

5. That a minimum of one footing tile inspection 
pipe be included in the building design and construction of each concrete
pit.

6. That the land application of manure shall be 
on the land described in this report and shall comply with the Special
Conditions below, and the standards set forth in
Attachments A-1 and A-4 of Planning
Commission Report CO 50-94.

7. That the property owner shall comply with the 
provisions of the Blue Earth County Livestock Manure Management Ordinance,
Number 130, effective January 1, 1995.

Special Conditions

1. That all manure application setbacks be 
adhered to as described in Attachment A-4. 

2. That all manure storage areas are setback at 
least 500 feet from residences other than the operator's, and are set back

EXPANSION OF AN EXISTING SWINE OPERATION 
SECTION 35, RAPIDAN TOWNSHIP

WHEREAS, Dean Ulrich, owner of the following real estate in the County of
Blue Earth, Minnesota, to wit: 

Northeast Quarter of the Northwest Quarter and the West Half of the
Northwest Quarter of Section 35, Rapidan Township

has applied for a Conditional Use Permit to expand an existing feedlot in a
C-1 Conservation Zoning District, and 

WHEREAS, the Planning Agency of the County has completed a review of the
application and made a report pertaining to said request (CO 51-94), a copy
of said report has been presented to the County Board; and

WHEREAS, the Planning Commission of the County on the 7th day of September,
following proper notice, held a public hearing regarding the request and,
following the hearing, adopted a recommendation that the request for a
conditional user permit be granted; and

WHEREAS, the Blue Earth County Board of Commissioners finds that:

1. The proposed use conforms with the Zoning Ordinance. 

2. The proposed use conforms with the Land Use Plan. 

3. The proposed use has the spreadable acres required for 
manure application.

4. The applicant has applied for all required permits. 

5. The proposed expansion will not create a pollution 
hazard.

NOW THEREFORE BE IT RESOLVED, by the Blue Earth County Board of
Commissioners, that the request for a Conditional Use Permit, in a C-1
Conservation Zoning District, is granted with the following conditions:

1. The confinement building conform with the site plan 
included with this report.

2. A Certificate of Compliance be issued before a 
construction permit is issued.

3. A footing tile inspection pipe be included in the 
design and construction of each barn.

4. The land application of manure shall be on the land 
described in this report and shall comply with the standards set forth in
A-4.

5. The applicant shall follow the rules and regulations of 
the Blue Earth County Livestock Manure Management Ordinance, effective
January 1, 1995.

6. The applicant shall empty concrete pit beneath the new 
total confinement barn two times per year.

Commissioner Tacheny moved and Commissioner More seconded the motion to
approve the following Conditional Use Permit: 

RESOLUTION OF
THE BLUE EARTH COUNTY BOARD OF COMMISSIONERS

THE EXPANSION OF A CONFINED FEEDLOT
AND EARTHEN MANURE STORAGE BASIN
IN AN A-1, AGRICULTURE ZONING DISTRICT
SECTION 14, LYRA TOWNSHIP

WHEREAS, LaVerne Doering, owner of the following real estate located in
Blue Earth County, Minnesota, to wit: 

South One-half of the Northeast Quarter and the Southeast Quarter of
Section 14, Township 106 North, Range 27 West, said parcel containing 240
acres.

has applied for a conditional use permit to allow the expansion of a
confined feedlot, and construction of an earthen manure storage basin in an
A-1, Agriculture Zoning District; and 

WHEREAS, the Planning Agency of the County has completed a review of the
application and made a report pertaining to said request (CO 52-94), a copy
of said report has been presented to the County Board; and

WHEREAS, the Planning Commission of the County on the 7th day of September,
1994, following proper notice, held a public hearing regarding the request
and, following the hearing, adopted a recommendation that the request for a
conditional use permit be granted; and,

WHEREAS, the Blue Earth County Board of Commissioners finds:

1. The proposed use conforms with the Zoning Ordinance. 

2. The proposed use conforms with the Land Use Plan. 

3. The proposed use has the spreadable acres required for 
manure application.

4. The applicant has applied for all required permits. 

5. The proposed expansion will not create a pollution hazard. 

6. Engineering plans have been prepared according to Soil 
Conservation Service engineering standards. 

NOW, THEREFORE, BE IT RESOLVED, by the Blue Earth County Board of
Commissioners, that the request for a conditional use permit for the
expansion of a confined feedlot and construction of an earthen manure
storage basin in an A-1, Agriculture Zoning District, is granted with the
following conditions: 

Conditions

1. That the earthen manure storage basin conform with the plans 
prepared by the Soil Conservation Service and attached to CO 52-94.

2. That the confinement building conform with the site plan 
attached to CO 52-94.

3. That inspection pipes be installed on the footing tile of 
the earthen basin and the footing tile of the confinement building.

4. An MPCA Certificate of Compliance be issued before a 
construction permit is issued.

5. A construction permit is issued before a building begins. 

6. The land application of manure shall be on the land 
described in this report and shall comply with the standards set forth in
A-1.

7. That the property owner shall comply with the provisions of 
the Blue Earth County Livestock Manure Management Ordinance, Number 130,
effective January 1, 1995.

This resolution shall become effective immediately upon its passage and
without publication.

SECTION 31, MEDO TOWNSHIP

WHEREAS, Randy R. and Ramona A. Will, owners of the following real estate
located in Blue Earth County, Minnesota, to wit:

South 466.7 feet of the West 466.7 feet of the Southeast Quarter, excluding
0.18 acres of County Highway, of Section 31, Township 106 North, Range 25
West, said parcel containing 4.820 acres.

has applied for a conditional use permit to allow the expansion of a
confined feedlot in a A-1, Prime Agriculture Zoning District; and

WHEREAS, the Planning Agency of the County has completed a review of the
application and made a report pertaining to said request (CO 53-94), a copy
of said report has been presented to the County Board; and

WHEREAS, the Planning Commission of the County on the 7th day of September,
1994, following proper notice, held a public hearing regarding the request
and, following the hearing, adopted a recommendation that the request for a
conditional use permit be granted; and

WHEREAS, the Blue Earth County Board of Commissioners finds: 

1. That the existing use and site plan were 
approved by the MPCA.

2. That the proposed use conforms with the land 
use plan.

3. That the proposed use has the required manure 
storage.

4. That the proposed use has the spreadable 
acres required for manure application.

5. That the applicant has applied for all 
required permits.

6. That the proposed expansion will not create a 
potential pollution hazard.

NOW, THEREFORE, BE IT RESOLVED, by the Blue Earth County Board of
Commissioners, that the request for a conditional use permit for the
expansion of a confined feedlot in an A- 1, Prime Agriculture Zoning
District, is granted with the following conditions:

General Conditions

2. That a Blue Earth County Certificate of

5. That the land application of manure shall be 
on the land described in this report and shall comply with the Special
Conditions below, and the standards set forth in

Quarter of the Southwest Quarter of Section 34, Township 106 North, Range
25 West, said parcel containing 3.750 acres.

has applied for a conditional use permit to allow the expansion of a
confined feedlot in a A-1, Prime Agriculture Zoning District; and

WHEREAS, the Planning Agency of the County has completed a review of the
application and made a report pertaining to said request (CO 54-94), a copy
of said report has been presented to the County Board; and

WHEREAS, the Planning Commission of the County on the 7th day of September,
1994, following proper notice, held a public hearing regarding the request
and, following the hearing, adopted a recommendation that the request for a
conditional use permit be granted; and

WHEREAS, the Blue Earth County Board of Commissioners finds: 

1. That the existing use conforms with the 
Zoning Ordinance.

2. That the proposed use conforms with the Land 
Use Plan.

3. That the proposed use has the required manure 
storage.

4. That the proposed use has the spreadable 
acres required for manure application.

5. That the applicant has applied for all 
required permits.

6. That the proposed expansion will not create a 
potential pollution hazard.

NOW, THEREFORE, BE IT RESOLVED, by the Blue Earth County Board of
Commissioners, that the request for a conditional use permit for the
expansion of a confined feedlot in an A-1, Prime Agriculture Zoning
District, is granted with the following conditions:

General Conditions

1. That the confinement building conform with 
the site plan attached to Planning Commission CO 54-94 report.

2. That a MPCA Certificate of Compliance be 
issued before a construction permit is
issued.

3. That a construction permit is issued before 
building begins.

4. That a minimum of one footing tile inspection 
pipe be included in the building design and construction of each concrete
pit.

5. That the land application of manure shall be 
on the land described in this report and shall comply with the Special
Conditions below, and the standards set forth in
Attachments A-1 and A-4 of Planning
Commission Report CO 54-94.

6. That the property owner shall comply with the 
provisions of the Blue Earth County Livestock Manure Management Ordinance,
Number 130, effective January 1, 1995.

Special Conditions

1. That all manure application setbacks be 
adhered to as described in Attachment A-4. 

2. That all manure storage areas are setback at 
least 500 feet from residences other than the operator's, and are set back
at least 50 feet from all property lines.

This resolution shall become effective immediately upon its passage and
without publication.

approve the following committee appointments: Reappoint Ms. Dawn Ulrich,
Mankato and Mr. Michael Laven, Mankato, to a two year term to the Recycling
Education Committee and to appoint Ms. Lisa Cownie, Mankato; Ms. Susan
Fredrison, Mankato; Mr. Joe Metro, Mankato and Ms. Kay Bierma, Mankato to

Commissioner Tacheny moved and Commissioner Landkamer seconded the motion
to approve the following: 

Continuation Agreement with School District No. 77 to operate the Day
Treatment Program for the period September 1, 1994 to August 31, 1995.

Sheriff's Youth Programs of Minnesota to provide therapeutic services for
the Adolescent Day Treatment Program.

Continuation contracts, requiring Board ratification, for home care
services financed by the Elderly Waiver Service Program which is a Medical
Assistance Subprogram.

MBW Inc. for the period July 1, 1994, through December 31, 1995; Mankato
Lutheran Home Adult Day Care for the period July 1, 1994, through December
31, 1995; Mankato Lutheran Home Care Program for the period July 1, 1994,
through December 31, 1995; Immanuel-St. Joseph's Home Health Services for
the period May 1, 1994, through December 31, 1995;
Immanuel-St. Joseph's Home Health Services for the period July 1, 1994,
