OFFICIAL PROCEEDINGS OF THE
BOARD OF COMMISSIONERS
BLUE EARTH COUNTY, MINNESOTA

April 7, 1998



The County Board of Commissioners met in the Commissioners' Room at 6:00 p.m. Present were Vice-Chairperson Al Bennett, Commissioner Leon Tacheny, Commissioner Colleen Landkamer, Commissioner Lin Barnes, County Attorney Ross Arneson and County Administrator David Twa.

1. AGENDA REVIEW
Commissioner Barnes moved and Commissioner Landkamer seconded the motion to approve the amended agenda to include an additional small city loan, a gambling license and deleting the Prisoner Transport Contract. The motion carried. 98-134

2. COMMISSIONERS’ REPORTS ON COMMITTEES
The Commissioners reported on committees that they have attended since the last Board Meeting.

3. SMALL CITIES LOAN APPLICATION
Mayor Kip Bruender, City of Eagle Lake and Mr. Jerry Books, Finance Director, presented the following Small Cities Loan Applications for the City of Pemberton.
Mr. Jim Bollman, Owner of Bollman Oil Inc., gave an overview of his application. The loan is to replace two underground storage tanks at the Pemberton Motor Mart.
Commissioner Tacheny moved and Commissioner Barnes seconded the motion to approve the five year, $50,000 loan to the City of Pemberton for the Pemberton Motor Mart. The motion carried. 98-135
Mr. Doug Baer, gave an overview of his application for a car wash and cold storage facility in Pemberton.
Commissioner Landkamer moved and Commissioner Barnes seconded the motion to approve the five year, $50,000 loan to the City of Pemberton for the Baer Car Wash and Cold Storage. The motion carried. 98-136

4. ADMINISTRATIVE SERVICES
Mr. David Twa, County Administrator, presented the following items for the Boards consideration.
Commissioner Landkamer moved and Commissioner Tacheny seconded the motion to approve the March 24, 1998 Board Minutes. The motion carried. 98-137
Commissioner Landkamer moved and Commissioner Barnes seconded the motion to approve the following Bills:

Commissioner Barnes moved and Commissioner Landkamer seconded the motion to approve the following Personnel item:
Extension of probation for Lois Schweim, Clerk II (A13) from April 9, 1998 to July 9, 1998. (Human Services)

Commissioner Tacheny moved and Commissioner Landkamer seconded the motion to approve the following Tax Abatements for taxes payable in 1998: Minnesota Office Investments, Inc., 12 Civic Center Plaza, Suite 2110, Mankato, MN R01-09-18-104-051 K-330813; Pham Tuan, Le Tu & Pham Quy, 210 Branson Street, Mankato, MN R01-09-18-255-007 K-23842; Mankato Towers Corp., 115 Echo Street, Mankato, MN R01-09-17-103-005 K-57244 and Ms. Janice Fish, 201 South 6th Street, Mankato, MN R01-09-18-252-001 K-30861. Commissioner Landkamer moved and Commissioner Tacheny seconded the motion to approve the following:

RESOLUTION
REQUESTING A PRESIDENTIAL DECLARATION
OF A MAJOR DISASTER


WHEREAS the County of Blue Earth has sustained severe losses of major proportion, caused by a tornado on the date of Sunday, March 29, 1998; and
WHEREAS Blue Earth County is a public entity within the State of Minnesota; and

WHEREAS substantial damage to public and private property, as outlined in the attached damage assessment forms; and

WHEREAS the cost of recovery from this disaster is beyond the resources available within the county, and state and federal resources are necessary; and

NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners, for and on behalf of the citizens of Blue Earth County, request the Governor of the State of Minnesota to petition the President of the United States to declare the County of Blue Earth, Minnesota, to be a major disaster area, through appropriate channels.

Be it further resolved that this request is for:

1. The Public Assistance (Infrastructure Support) and Human Service Programs as offered through P.L. 93-288.

2. The Hazard Mitigation Program, as offered through P.L. 93-288.

Be it further resolved that the County Emergency Management Director is authorized to coordinate the damage survey teams with local government, and assist in the administration of the disaster recovery process, as needed.

Commissioner Barnes moved and Commissioner Tacheny seconded the motion to approve a Renewal of Consumption and Display Permit to L.B.’s Inc., Route 2, Box 85, Lake Crystal, MN. The motion carried. 98-142
Commissioner Tacheny moved and Commissioner Landkamer seconded the motion to approve an Application for Authorization for Exemption from Lawful Gambling to Ducks Unlimited Chapter 201 Riverbend Womens to be held May 18, 1998 at Applewood Restaurant, Mankato, MN. The motion carried. 98-143

5. PUBLIC WORKS
Mr. Al Forsberg, Public Works Director, presented the following items for the Boards consideration.
Commissioner Barnes moved and Commissioner Tacheny seconded the motion to approve the following resolution:

COUNTY OF BLUE EARTH
RESOLUTION


IT IS RESOLVED that the County of Blue Earth enter into Mn/DOT Agreement No. 77224 with the State of Minnesota, Department of Transportation for the following purposes:

To provide for a lump sum payment by the State to the County of the State’s share of the costs of the grading, surfacing and bituminous overlay construction and other associated construction to be performed upon County State Aid Highways No. 17 and No. 55 adjacent to Trunk Highway No. 14 & 60 from Eagle Lake to Mankato under State Project No. 0702-94 (T.H. 14=007).

IT IS FURTHER RESOLVED that the Vice-Chairperson and the County Administrator are authorized to execute the Agreement.

Commissioner Tacheny moved and Commissioner Landkamer seconded the motion to approve the Blue Earth County Transportation Plan. The motion carried. 98-145
Commissioner Landkamer moved and Commissioner Tacheny seconded the motion to make a correction of a deed for parcel acquired for the CR 149 Project. The motion carried. 98-146
Commissioner Tacheny moved and Commissioner Barnes seconded the motion to approve a Cooperative Agreement with Mankato Township for maintenace improvments to TR 167 (Shostag Road) from TH 22 to CSAH 16 and authorization for the Chairperson to sign the agreement. The motion carried. 98-147
A discussion was held on the preliminary plans and construction schedule of CSAH 55. Public comments were heard from: Mayor Kip Bruender, Eagle Lake; Mr. Mike Keefe, Eagle Lake; Mr. LeRoy Derosier, Eagle Lake and Mr. Steven Helget, City Administrator of Eagle Lake. After discussion the project was put on the schedule for 1999.
Commissioner Tacheny moved and Commissioner Barnes seconded the motion to adjourn at 8:00 p.m. The motion carried. 98-148
