The County Board of Commissioners met in the Commissioners'
Room at 9:00 a.m. Present were Chairperson Lin Barnes,
Commissioner Leon Tacheny, Commissioner Colleen Landkamer,
Commissioner Al Bennett, Commissioner Alvis More, County Attorney
Ross Arneson and County Administrator David Twa.
1. AGENDA REVIEW
Commissioner Landkamer moved and Commissioner Bennett
seconded the motion to approve the Agenda. The motion carried.
97-103
2. COMMISSIONERS' REPORTS ON COMMITTEES
The Commissioners reported on committees that they have
attended since the last Board Meeting.
4. PLANNING AND ZONING
Mr. Veryl Morrell, Land Use & Natural Resources
Administrator and Ms. Julie Conrad, Land Use & Natural Resources
Planner, presented the following Planning and Zoning items.
Commissioner More moved and Commissioner Bennett seconded
the motion to approve the following Conditional Use Permit:RESOLUTION GRANTING A
CONDITIONAL USE PERMIT
TO CONSTRUCT ONE TOTAL CONFINEMENT SWINE BARN
SECTION 34, MEDO TOWNSHIP
WHEREAS, Ronald Olson, owner of the following real estate in
the County of Blue Earth, Minnesota, to wit:
South Half, of the Northwest Quarter, of Section
34, Medo Township, T.106N.-R.25W.,
has applied for a Conditional Use Permit to build one total
confinement swine barn in an A, Agriculture Zoning District; and
WHEREAS, the Planning Agency of the County has completed a
review of the application and made a report pertaining to said
request (PC 06-97 ), a copy of said report has been presented to
the County Board; and
WHEREAS, the Planning Commission of the County on the 5th
day of March, 1997, following proper notice, held a public
hearing regarding the request and, following the hearing, adopted
a recommendation that the request for a Conditional Use Permit be
granted; and
WHEREAS, the Blue Earth County Board of Commissioners finds:
1. That with proper management of the proposed barn and with
proper manure application, the Conditional Use should not be
injurious to the use and enjoyment of other property in the
immediate vicinity designated for agricultural uses.
2. That with proper management of the proposed barn and with
proper manure application, this facility should not constitute
a pollution problem.
3. That the predominant use in the area is agriculture and the
Conditional Use should not impede the normal and orderly
development and improvement of surrounding vacant property for
agricultural uses.
4. Adequate utilities, access roads, drainage and other necessary
facilities have been or will be provided.
5. Adequate measures will be taken to provide sufficient off-road
parking and loading space to serve the proposed use.
6. Soil conditions are adequate to accommodate the proposed
request.
7. Proper facilities will be provided which will eliminate any
traffic congestion or traffic hazard which may result from the
proposed use.
8. The feedlot is not greater than the feedlot standards allowed
in the A, Agricultural Zoning District.
9. The proposed use is consistent with the County Land Use Plan.
10. That the proposed use does not include residential
development.
11. That the proposed use does not include industrial development.
NOW, THEREFORE, BE IT RESOLVED, by the Blue Earth County
Board of Commissioners, that the request for a Conditional Use
Permit, to build a total confinement swine barn at an existing
swine facility in an Agriculture Zoning District, is granted with
the following conditions:
1. That the total confinement barn, conforms with the site plan
attached to this report PC 06-97.
2. That the new barn, be located on a single, legally described
parcel consisting of a minimum of ten contiguous acres. The
parcel shall be a parcel of record, properly recorded in the
Blue Earth County Land Records Office.
3. That a Certificate of Compliance Permit be issued before a
Blue Earth County Construction Permit is issued.
4. That the applicant obtain a Blue Earth County Construction
Permit before building begins and within nine months from
the date the County Board of Commissioners approves the
Conditional Use Permit. The permit shall be rendered
invalid if application for a Construction Permit is not made
within this nine month period. Time extensions for
Conditional Use Permits must be obtained from the County
Board of Commissioners subsequent to a public hearing
conducted by the Planning Commission.
5. That the applicant obtain a Blue Earth County Feedlot Permit
before animals are placed in the barn.
6. That the applicant obtain a Department of Natural Resources,
"Water Appropriations Permit" before any animals are placed
in the proposed barn.
7. That a perimeter footing drain tile be located at or below
the bottom of the pit footings. The footing tile shall
include one inspection pipe for each concrete pit. The
native materials must be excavated and walls back filled
with granular material (pit run gravel or equivalent).
8. That application of manure be on the land documented in the
aerial photos included in the State of Minnesota Application
for Construction and Operation of an animal feedlot. The
application of manure shall comply with standards set forth
in Attachment A-1, Manure Management Summary and Attachment
A-4, Manure Application Setbacks, as contained in staff
report PC 06-97.
9. That the disposal of dead animals be consistent with the
Minnesota Board of Animal Health regulations.
10. That the applicant provide an enclosed location for the pick
up of dead animals before any animals are placed in the
proposed barn.
11. That adequate measures be taken to minimize or control
offensive odor, fumes, dust, noise, or vibrations so that
none of these will constitute a nuisance.
This resolution shall become effective immediately upon its
passage and without publication.

Commissioner Bennett moved and Commissioner More seconded
the motion to approve the following:
RESOLUTION GRANTING A

WHEREAS, Michael Jaeger, owner of the following real estate
in the County of Blue Earth, Minnesota, to wit:
Beginning at the Southeast corner of the Southwest
Quarter of Section 8, Mapleton Township T. 105
N.,- R. 26 W.; thence North 995 feet along the
center line of the township road to the point of
beginning; thence West 588 feet: thence North 745
feet: thence East 588 feet more or less to the
center of the County Road 192, thence South along
the center line of said road to the point of
beginning.
has applied for a Conditional Use Permit to build one total
confinement swine barn addition in an A, Agriculture Zoning
District; and
WHEREAS, the Planning Agency of the County has completed a

WHEREAS, Roger Matzke, owner of the following real estate in
the County of Blue Earth, Minnesota, to wit:
All that part of the Northwest Quarter of Section
15, Rapidan Township, T. 107 N.-R. 27 W., that
lies West of the Chicago, Milwaukee, St. Paul and
Pacific Railway, excepting therefrom that certain
tract of land described as follows, to-wit:
beginning at a point 580 feet North of the
Southwest corner of the Northwest Quarter of said
Section 15, in said Township and Range; thence due
East 330 feet; thence due North 150 feet; thence
due West 330 feet; thence South 150 feet to the
place of beginning.

Commissioner Tacheny moved and Commissioner Bennett seconded
the motion to approve the following Conditional Use Permit with
the amendment that the Board waived the fee ($200) because it was
involved with a disaster (fire):
RESOLUTION GRANTING A
CONDITIONAL USE PERMIT
FOR TEMPORARY USE OF A MOBILE HOME
SECTION 12, RAPIDAN TOWNSHIP
WHEREAS, Dorothy and Gerald Coopman, owners of the following
real estate in the County of Blue Earth, Minnesota, to wit:
The South 300 Feet of the North 650 Feet of the East 300
Feet of the Northeast Quarter of the Northeast Quarter of
Section 12, Rapidan Township, T 107 N, R 27 W;
have applied for a Conditional Use Permit for temporary use of a
mobile home in an Agricultural Zoning District while constructing
a permanent, single family home to replace a dwelling destroyed
by fire, and
WHEREAS, the Planning Agency of the County has completed a
review of the application and made a report pertaining to said
request (AH 02-97), a copy of said report has been presented to
the County Board; and
WHEREAS, the Planning Agency of the County on the 24th day
of March, 1997, following proper notice, held an administrative,
public hearing regarding the request; and
WHEREAS, the Blue Earth County Board of Commissioners finds
that:
1. The proposed use conforms with the County Land Use
Plan.
2. The applicant has demonstrated a need for the proposed
use.
3. The proposed use will not degrade the water quality of
the County.
4. The proposed use will not adversely increase the
quantity of water runoff.
5. The soils are adequate to accommodate the proposed use.
6. The proposed use does not create a potential pollution
hazard.
7. Adequate utilities, access roads, drainage and other
necessary facilities have been or are being provided.
8. Adequate measures have been or will be taken to provide
sufficient off-road parking space to serve the proposed
use.
9. The Conditional Use will not be injurious to the use
and enjoyment of other property in the immediate
vicinity for the purposes already permitted.
10. Establishment of the Conditional Use will not impede
the normal and orderly development and improvement of
surrounding vacant property for the predominate uses in
the area.
11. Density of the proposed residential development is not
greater than the density of the surrounding
neighborhood or applicable zoning district.
NOW THEREFORE BE IT RESOLVED, by the Blue Earth County Board
of Commissioners, that the request for a Conditional Use Permit
for temporary use of a mobile home, in an Zoning District, is
granted with the following conditions:
1. That the manufactured home be installed in conformance
with State of Minnesota manufactured home installation
requirements.
2. That the mobile home be removed from the property
within six months of the completion of the permanent
home.
This resolution shall become effective immediately upon its
passage and without publication.
The amendment and motion carried. 97-108
Commissioner Landkamer moved and Commissioner More seconded
the motion to approve the following:
RESOLUTION TO UPDATE THE
COUNTY COMPREHENSIVE WATER PLAN
WHEREAS, Minnesota Statutes, Chapter 103B.301, Comprehensive
Local Water Management Act, authorizes Minnesota Counties to
develop and implement a Comprehensive Local Water Management
Plan, and
WHEREAS, the Act requires that a County update and revise
their Comprehensive Local Water Management Plan on a periodic
basis, and
WHEREAS, the Act requires that plans and official controls
of other local governmental units be consistent with the
Comprehensive Local Water Management Plan, and
WHEREAS, Blue Earth County has determined that the revision
and continued development of a Comprehensive Local Water
Management Plan will help promote the health and welfare of the
citizens of Blue Earth County.
NOW, THEREFORE BE IT RESOLVED, that the Blue Earth County
Board of Commissioners resolve to revise and update its current,
Comprehensive Local Water Management Plan.
BE IT FURTHER RESOLVED, that Blue Earth County will
coordinate its efforts in the revision and update of its plan
with all local units of government within the county and will
incorporate where appropriate, any existing plans and rules which
have been developed and adopted by watershed districts having
jurisdiction wholly or in part within Blue Earth County into its
Comprehensive Local Water Management Plan.
BE IT FURTHER RESOLVED, that the Blue Earth County Board of
Commissioners authorizes the establishment of a water management
advisory committee with the responsibility of revising and
updating the plan and who shall report to the County Board on a
periodic basis.
BE IT FURTHER RESOLVED, that the Blue Earth County Board of
Commissioners delegates the Environmental Services Department the
responsibility of coordinating, assembling, and writing the
revised, Comprehensive Local Water Management Plan pursuant to
Minnesota Statute 103B.301 and Minnesota Resolution 9300.

Mr. David Twa, County Administrator, presented the following
items for the Boards consideration.

the motion to approve the March 11, 1997 Board Minutes. The

the motion to approve the following Bills:

Commissioner Tacheny moved and Commissioner Landkamer
seconded the motion to approve the following Personnel items:
Increase of hours for Kellie Manderfeld, Social Worker
(C42), from .5 FTE to 1 FTE effective March 26, 1997.
This reflects the South Central Children's Project
Joint Powers Board action taken on March 17, 1997.
This time will accomplish the responsibilities of the
Local Collaborative Time Study (LCTS) Coordinator
position. (Human Services)

Commissioner More moved and Commissioner Bennett seconded
the motion to approve Renewal of Consumption & Display Permits
and Retailer's On-Sale/Off-Sale Non-Intoxicating Malt Liquor
Licenses to Ms. Beverly Hansen, d/b/a Last Chance, Route 9, Box
97, South Bend Township; Mr. Larry Blachowske, d/b/a L.B.'s,
Route 2, Box 85, Lake Crystal and Ms. Tracey Bohks, d/b/a
Minneopa Golf Club, Route 9, Box 133, Mankato received only an
On-Sale license. The motion carried. 97-113
Commissioner Landkamer moved and Commissioner Bennett
seconded the motion to raise from $1,300 to $2,500 the amount
that employees can deduct for medical related expenses in the
Flexible Benefits Program. The motion carried. 97-114

The County Board of Commissioners met in the Commissioners'
Room at 9:00 a.m. Present were Chairperson Lin Barnes,
Commissioner Leon Tacheny, Commissioner Colleen Landkamer,
Commissioner Al Bennett, Commissioner Alvis More, County Attorney
Ross Arneson and County Administrator David Twa.

5. HIGHWAY BID OPENING
Mr. Ron Olson, Road Supervisor and Mr. Joe Styndl,
Maintenance Superintendent, presented the following Bids for the
Boards consideration.
Pursuant to publication, bids were received, opened and
reviewed for the following Public Works equipment, with the
following results:
EQUIPMENT: Riveted and/or Spiral Metal Culverts
The complete list of prices per foot, connection bands
and aprons are on file at the Blue Earth County
Administrator's Office, Courthouse, Mankato, MN.

the motion to accept the bid from Peterson Motor Grader Services,

6. HUMAN SERVICES
Mr. Dennis McCoy, Deputy Administrator, presented the
following Human Service items.
Commissioner Landkamer moved and Commissioner Bennett
seconded the motion to approve the following:
Approval of the Sexual Assault Service Program grant
application to continue this program. This
continuation funding is received from the State
Department of Corrections.
Approval to submit a Sexual Assault Service grant
application to the Department of Corrections for no
more than $11,000 for preventive and educational
services in the area of sexual assault.
Renewal agreement with St. Peter Regional Treatment
Center for psychiatric services. The terms of this
contract are from April 1, 1997, through March 31,
1998, and call for the purchase of 832 hours of
services from a Board eligible or Board certified
psychiatrist at the rate of $107.00 per hour.
Approval of renewal agreements with the State of
Minnesota for the SAIL program. These continuation
agreements extend the four-county SAIL Project into
1998.

The meeting recessed at 12:00 p.m. to attend the Zero Sick
Leave luncheon.
The meeting reconvened at 1:40 p.m.
Mr. David Twa, County Administrator, presented items for the
1997 Planning Workshop.
8. INFORMAL HEARING ON JD #22
Mr. Jerry Kallheim, Land Records Director, informed the
Board that this is an informational hearing and that no petition
has been submitted to date.
Commissioner More gave an overview of the history of the
Judicial Ditch #22 system. Public comments were heard by: Mr.
Dale Sargent, Janesville; Mr. Gerry Bade, Janesville; Mr. Jim
Riese, Eagle Lake; Mr. James Loeffler, Eagle Lake.
9. WALKING TOUR OF NICHOLS OFFICE BUILDING
Mr. Steve Michel, Physical Plant Director, gave a tour of
the Nichols Office Building.
10. 1997 PLANNING WORKSHOP
Mr. David Twa, County Administrator continued the 1997
Planning Workshop at the Holiday Inn, Mankato.
Commissioner Tacheny moved and Commissioner Bennett seconded
the motion to adjourn the meeting at 6:45 p.m. The motion
