BLUE EARTH COUNTY, MINNESOTA
July 11, 1995
The County Board of Commissioners met in the Commissioners'
Room at 9:00 a.m. Present were Chairperson Leon Tacheny,
Commissioner Colleen Landkamer, Commissioner Lin Barnes,
Commissioner Al Bennett, Commissioner Alvis More, County Attorney
Ross Arneson and County Administrator David Twa.
Commissioner Barnes moved and Commissioner Bennett seconded
the motion to approve the amended Agenda. The motion carried.

The Commissioners reported on meetings they have attended
since the last Board meeting.
Commissioner Landkamer moved and Commissioner Bennett
seconded the motion to approve the amended June 27, 1995 Board
Minutes. The motion carried. 95-248
Commissioner Barnes moved and Commissioner Landkamer
seconded the motion to approve the following Bills:
Bills for Week of July 3-7, 1995
Grand Total $837,531.67
Bills for Week of July 10-14, 1995
Grand Total $2,835,736.44

Commissioner More moved and Commissioner Barnes seconded the
motion to approve the following Personnel items:
Promotion of Donald Fezler, from Light Equipment
Operator (B21) to Medium Equipment Operator (B22) with
a salary adjustment from $11.62 to $12.62 per hour
effective July 10, 1995. (Highway)
Authorization to initiate recruitment for a Light
Equipment Operator (B21). (Highway)
Employment of Abu Kamara, as a Custody Officer (On-
Call) (B23), with a starting salary of $10.32 per hour
effective June 16, 1995. (Sheriff's)
Employment of Boyd Hansen, as a Custody Officer (On-
Call) (B23), with a starting salary of $10.32 per hour
effective June 13, 1995. (Sheriffs)

Commissioner Landkamer moved and Commissioner Bennett
seconded the motion to approve the following items for the Tax
Forfeiture Sale:
Approval of application for Repurchase of Forfeited
Lands by B.H. Chesley Co. R01-09-06-401-005 K-42910.
Approval of Re-Appraisal of Lands Forfeited to the
State for Non-Payment of Taxes.
Approval of List of Lands Forfeited to the State for
Non-Payment of Taxes which are to be sold.
Resolution
Public Sale For Forfeited Lands
BE IT HEREBY RESOLVED, That the parcels of land
forfeited to the State for non-payment of taxes,
appearing on the list filed with the Director of Land
Records, which have been classified and appraised as
provided by Laws 1935, Chapter 386, as amended, shall
be offered for sale by the Director of Land Records,
said sale to commence at 9:00 a.m. on the Seventh day
of August, 1995, and the Director of Land Records is
hereby directed to publish a notice of sale as provided
by law.
BE IT FURTHER RESOLVED, That the terms of sale shall be
for cash only for $1,000.00 or less at the time of
purchase; or not less than twenty-five (25) per cent of
the purchase price in cash at the time of purchase and
the balance is not to exceed three equal annual
installments with interest at ten (10) per cent per
annum, both principal and interest payable annually on
or before the anniversary date of purchase. Provided,
however, that no standing timber or timber products
shall be removed until an amount equal to the appraised
value of the timber has been paid.

After discussion, the Board deferred action on a Petition
from Mr. Lee Morris, Beauford Township, to add 60 acres of land
into County Ditch System #86.
Mr. Scott Fichtner, Environmental Services Director and Mr.
Paul Schuster, Vice-Chair of Environmental Services Advisory
Committee, presented the County's Solid Waste Plan.
Commissioner Barnes moved and Commissioner Landkamer
seconded the motion to accept the plan.
A RESOLUTION TO APPROVE AND ADOPT THE
BLUE EARTH COUNTY UPDATED SOLID WASTE MANAGEMENT PLAN
WHEREAS, the legislature of the State of Minnesota
requires that Minnesota's counties develop a Solid
Waste Management Plan in accordance with Minn. Stat.
115A.84; Minn. Stat. 115A.914; Minn. Stat. 115A.96,
Subd. 6-7; Minn. Stat. 115A.97 (1990 and supp. 1991),
and all applicable statutes and rules; and
WHEREAS, Minnesota counties recognize the need to plan
for and practice environmentally sound methods of
managing their solid waste stream; and
WHEREAS, in 1989, the legislature of the State of
Minnesota enacted legislation to require that Solid
Waste Management Plans be amended to include the
requirements in Minn. Stat. 115A.55A, 1155A.914, and
115A.96, Subd. 6 (1991), and
WHEREAS, the County of Blue Earth recognizes the need
to plan for and implement waste reduction, recycling,
yard waste composting, and special waste management
strategies;
NOW, THEREFORE, BE IT RESOLVED, that the Blue Earth
County Board of Commissioners hereby approves and
adopts the Blue Earth County Solid Waste Management
Plan Update and supporting documentation dated July 11,
1995.
BE IT THEREFORE FURTHER RESOLVED, that the Blue Earth
County Board of Commissioners agrees to maintain and
implement the Plan as required by Minn. Rules pt.
9215.0530, subp. 1 and 2.
BE IT THEREFORE FURTHER RESOLVED, that the Blue Earth
County Board of Commissioners submits this document to
the Director of the Minnesota Office of Environmental
Assistance for final approval pursuant to applicable
laws and rules.
Adopted this 11th day of July, 1995, by the Blue Earth
County Board of Commissioners.

Mr. Donald Manthei, Mapleton, voiced some concerns to the
Board.
Mr. Al Forsberg, Public Works Director, presented the
following items for the Boards consideration.
Commissioner Barnes moved and Commissioner Landkamer
seconded the motion to design the CSAH #3 project from Trunk
Highway 14 overpass to one mile east of CR #193 as concrete
pavement and from CR #193 to CR #186 as bituminous pavement. The
motion carried. 95-253
Commissioner More moved and Commissioner Bennett seconded
the motion to approve a Retailer's On-Sale Non-intoxicating Malt
Liquor License to the Blue Earth County Agricultural Society,
Blue Earth County Fairgrounds, Garden City, MN. The motion
carried. 95-254
Commissioner Barnes moved and Commissioner Landkamer
seconded the motion to approve a Retailer's On-Sale Non-
Intoxicating Malt Liquor License and an Application for
Consumption and Display (Set-up) Permit to Mr. Kenneth Bohks
d/b/a the Minneopa Golf Course, Route 9, Box 144, Mankato, MN.

Commissioner More moved and Commissioner Bennett seconded
the motion to approve an Application for Authorization for
Exemption from Lawful Gambling License to the Blue Earth County
Agricultural Society, Blue Earth County Fairgrounds, Garden City,
MN. The motion carried. 95-256
Commissioner Barnes moved and Commissioner More seconded the
motion to approve an Application for County On-Sale Intoxicating
Liquor License to Mr. Richard McMonagle d/b/a the Junction Inn,
Route 9, Box 192, Mankato, MN. The motion carried. 95-257
Commissioner Landkamer moved and Commissioner Barnes
seconded the motion to authorize the expenditure of $39,600 plus
tax, towards the purchase of the Rescue Truck by the City of
Mankato. The motion carried. 95-258
Commissioner More moved and Commissioner Bennett seconded
the motion to appoint the Board Chair, Leon Tacheny and Vice-
Chair, Colleen Landkamer to the Canvassing Board for the special
primary and general election for Legislative District 26A. The
motion carried. Commissioner Tacheny voted nay. 95-259
The meeting recessed at 12:22 p.m. to have lunch with the
Nicollet County Commissioners at the Mankato Civic Center.
Commissioner Bennett moved and Commissioner More seconded
the motion to adjourn the Board meeting at 2:40 p.m. The motion
