June 27, 1995



The County Board of Commissioners met in the Commissioners' 

Room at 9:00 a.m. Present were Chairperson Leon Tacheny, 

Commissioner Colleen Landkamer, Commissioner Lin Barnes, 

Commissioner Al Bennett, Commissioner Alvis More, County Attorney 

Ross Arneson and County Administrator David Twa. 



Commissioner Barnes moved and Commissioner Bennett seconded 

the motion to approve the amended Agenda. The motion carried.

The Commissioners reported on meetings they have attended 

since the last Board meeting.



Commissioner Barnes moved and Commissioner Bennett seconded 

the motion to approve the following Proclamation: 



WHEREAS, the D.A.R.E. Program promotes self respect, 

self-worth, and helps convert 'Just Say No' into 

reality, and;



WHEREAS, the D.A.R.E. Program is a tool to help our 

children fight drugs and build a better Society 



WHEREAS, Clements Auto, Heintz Pontiac-Cadillac- 

Toyota, Lager's Chrysler World, Mankato Ford, Mankato 

Honda and Snell Motors have donated a vehicle and given 

it to the Blue Earth County Sheriffs Department to 

promote the D.A.R.E. Program;



Now, Therefore, Be It Resolved, by the Blue Earth 

County Board of Commissioners that it is appropriate to 

designate July 17, 1995 as



"Clements Auto, Heintz Pontiac-Cadillac-Toyota, 

Lager's Chrysler World, Mankato Ford, Mankato Honda 

and Snell Motors Day!"



in Blue Earth County and commend them for their generous donation to the community.

the motion to approve an Application for Authorization to Conduct 

Excluded Bingo to St. Matthew's Church, 200 Kendal Street, Vernon 

Center, MN to be held on August 10-13, 1995 at the Blue Earth 

County Fairgrounds, Garden City, MN. The motion carried. 95-222 



Commissioner Barnes moved and Commissioner Bennett seconded 

the motion to approve the All Seasons Arena Operating Agreement. 

This agreement is on file at the County Administrator's Office, 

Courthouse, Mankato, MN. The motion carried. 95-223 



Commissioner Landkamer moved and Commissioner More seconded 

the motion to approve the following Human Service items: 



Agreements with the Meyering Center for extensions of 

existing contracts from July 1, 1995 to March 31, 1996. 

This action was directed by the Legislature in the 95 

session. Providers will receive a 1.5% COLA at that 

time.



Extension of the existing host county agreement with 

ELM Home from July 1, 1995 to March 31, 1996 due to 

Legislative action.



Contract with the State of Minnesota to establish 

Seniors Agenda for Independent Living (SAIL), effective 

on July 1, 1995 until August 30, 1997.

Mr. Rick Hanna, Land Use & Natural Resources Administrator, 

and Ms. Julie Conrad, Land Use & Natural Resources Planner, 

presented the following Planning and Zoning items. 



After discussion, Commissioner Barnes moved and Commissioner 

Landkamer seconded the motion to table the Conditional Use Permit 

for expansion of a total confinement hog operation to Mr. Bruce 

Stanton, Section 35, Lyra Township, until the July 18, 1995 Board 

Meeting. Mr. Rick Nienow, Mapleton, spoke in favor of the 

permit. The motion carried. 95-225



Commissioner Bennett moved and Commissioner More seconded 

the motion to approve the following:



RESOLUTION GRANTING A

CONDITIONAL USE PERMIT

EXPANSION OF A TOTAL CONFINEMENT HOG OPERATION 

SECTION 4, LYRA TOWNSHIP



WHEREAS, Rahn Farms, owner of the following real estate in 

the County of Blue Earth, Minnesota, to wit: 



East Half of the Southeast Quarter of the Northwest Quarter 

and the Northwest Quarter of the Southeast Quarter of the 

Northwest Quarter and the West Half of the Northeast Quarter 

except the West 10 Acres of the North 550 feet of Section 4, 

Lyra Township, T106N-R27W,



has applied for a Conditional Use Permit to expand a total 

confinement hog operation in an A-2, Limited Agriculture Zoning 

District, and



WHEREAS, the Planning Agency of the County has completed a 

review of the application and made a report pertaining to said 

request (CO 06-95), a copy of said report has been presented to 

the County Board; and



WHEREAS, the Planning Commission of the County on the 1st 

day of March, 1995, following proper notice, held a public 

hearing regarding the request and following the hearing adopted a 

recommendation that the request for a conditional use permit be 

granted; and



WHEREAS, the Blue Earth County Board of Commissioners finds 

that:



1. The proposed use conforms with the Zoning Ordinance. 



2. The proposed use conforms with the Land Use Plan. 



3. The proposed use has the required manure storage. 



4. The proposed use has the spreadable acres required for 

manure application.



5. The applicant is in the process of applying for all 

required permits.



6. The proposed use will not create a pollution hazard. 



NOW THEREFORE BE IT RESOLVED, by the Blue Earth County 

Board of Commissioners, that the request for a Conditional Use 

Permit to expand a total confinement hog operation, in an A-2 

Zoning District, is granted with the following conditions: 



1. The proposed buildings conform with the site plan 

attached to the CO 6-95 report.



2. All required permits are obtained as shown in CO 6-95 

Attachment A-4, Structural Setbacks and Required 

Permits.



3. A Blue Earth County Certificate of Compliance is issued 

before a construction permit is issued on the two 

finishing barns.



4. A Blue Earth County construction permit is issued 

before building begins.



5. A minimum of one footing tile inspection pipe is 

included in the building design and construction of 

each concrete pit. MPCA requires that drain tile 

should be located at least one (1) foot deeper than the 

pit bottom.



6. The proposed structures have the required setbacks as 

shown in CO 6-95 Attachment A-4, Structural Setback 

Distances and Required Permits.



7. The land application of manure shall be on the land 

described in the Preliminary Manure Management Plan and 

complies with standards set forth in CO 6-95 

Attachments A-1, Manure Management Summary, and A-5, 

Manure Application Setbacks.



8. The non-conforming, earthen manure storage pit shall be 

filled in.



9. The applicants comply with the Blue Earth County 

Livestock Manure Management Ordinance, effective 

January 4, 1995.



10. The applicant obtains a Department of Natural Resources 

"Water Appropriations Permit."



11. The disposal of dead animals shall be consistent with 

the Minnesota Board of Animal Health regulations. 



This resolution shall become effective immediately upon its 

passage and without publication.

the motion to approve the following Conditional Use Permit:

SECTION 32, RAPIDAN TOWNSHIP



WHEREAS, Rahn Farms, owner of the following real estate in 

the County of Blue Earth, Minnesota, to wit: 



South 580 feet of the West 750 feet of the East Half of the 

Southeast Quarter of Section 32, Rapidan Township, T107N- 

R27W,



has applied for a Conditional Use Permit to expand a total 

confinement hog operation in an A-1, Prime Agriculture Zoning 

District, and



WHEREAS, the Planning Agency of the County has completed a 

review of the application and made a report pertaining to said 

request (CO 07-95), a copy of said report has been presented to 

the County Board; and



WHEREAS, the Planning Commission of the County on the 1st 

day of March, 1995, following proper notice, held a public 

hearing regarding the request and, following the hearing, adopted 

a recommendation that the request for a conditional use permit be 

granted; and



WHEREAS, the Blue Earth County Board of Commissioners finds 

that:



1. The proposed use conforms with the Zoning Ordinance.

WHEREAS, Rick Nienow, owner of the following real estate in 

the County of Blue Earth, Minnesota, to wit: 



North Half of the Southwest Quarter of Section 35, Beauford 

Township, T106N-R26W,



has applied for a Conditional Use Permit to expand a total 

confinement hog operation in an A-1, Prime Agriculture Zoning 

District, and



WHEREAS, the Planning Agency of the County has completed a 

review of the application and made a report pertaining to said 

request (CO 11-95), a copy of said report has been presented to 

the County Board; and



WHEREAS, the Planning Commission of the County on the 1st 

day of March 1995, following proper notice, held a public hearing 

regarding the request and, following the hearing, adopted a 

recommendation that the request for a conditional use permit be 

granted; and



WHEREAS, the Blue Earth County Board of Commissioners finds 

that:

before a construction permit is issued on the total 

confinement hog finishing barn.



4. A Blue Earth County construction permit is issued 

before building begins.



5. A minimum of one footing tile inspection pipe is 

included in the building design and construction of the 

concrete pit. MPCA requires that drain tile should be 

located at least one (1) foot deeper than the pit 

bottom.



6. The proposed structure has the required setbacks as 

shown in CO 11-95 Attachment A-4, Structural Setback 

Distances and Required Permits.



7. The land application of manure shall be on the land

Commissioner Bennett moved and Commissioner Barnes seconded 

the motion to approve the following:



RESOLUTION GRANTING A

CONDITIONAL USE PERMIT

TO CONSTRUCT A DIKE IN THE FLOODPLAIN

GARDEN CITY TOWNSHIP



WHEREAS, Gregory Wittrock owner of the following real estate in 

the County of Blue Earth, Minnesota, to wit: 



Lots 5, 6, and 7, Block Seven, Garden City Original 

has applied for a conditional use permit to construct a dike in the 

flood plain of a R-2, Suburban Residence Zoning District; and 



WHEREAS, the Planning Agency of the County has completed a 

review of the application and made a report pertaining to said 

request (CO 58-94), a copy of said report has been presented to the 

County Board; and



WHEREAS, the Planning Commission of the County on the 7th day of 

May, 1995, following proper notice, held a public hearing regarding 

the request and, following the hearing, adopted a recommendation that 

the request for a conditional use permit to construct a dike in the 

flood plain be approved; and



WHEREAS, the Blue Earth County Board of Commissioners finds 

that:



1. The proposed use complies with the County Land Use Plan. 



2. The proposed use complies with the County Shoreland 

Ordinance.



3. The proposed use complies with the County Flood Plain 

Ordinance.



4. The proposed use complies with the County Zoning Ordinance. 



5. The Conditional Use will not be injurious to the use and 

enjoyment of other property in the immediate vicinity for 

the purpose already permitted.



6. The establishment of the Conditional Use will not impede 

the orderly development and improvement of surrounding 

vacant property for predominant uses in the area. 



NOW THEREFORE BE IT RESOLVED, by the Blue Earth County Board of 

Commissioners, that the request for a Conditional Use Permit to 

construct a dike in the flood plain in a R-2, Suburban Residence 

Zoning District, is granted with the following conditions: 





1. That only natural fill material be used. 



2. That the final elevation of the berm shall be certified by 

a registered land surveyor, and a description of the 

completed project and "as built" drawings be filed with the 

Land Use and Natural Resources Administrator. 



3. That riprap material, 12 inch Class 3, on filter fabric, 

shall be placed 10 feet out from the base of the berm and 

up slope to the top of the berm.



4. That the final slope shall not exceed a ratio of 6:1. 



5. That siltation fences shall be placed at the base of all 

slopes. and the fill shall be covered with straw or other 

approved material until vegetation is established. 



6. That any modification in the plan must be designed by a 

registered engineer and approved by MnDot and the DNR. 



This resolution shall become effective immediately upon its 

passage and without publication.

Commissioner Landkamer moved and Commissioner Barnes seconded 

the motion to approve the following Final Plat: 



A RESOLUTION

APPROVING FINAL PLAT

EAGLE RIDGE SUBDIVISION

GARDEN CITY TOWNSHIP



WHEREAS, the owner of the property included in the plat of Eagle 

Ridge Subdivision have submitted a final plat for approval; and, 



WHEREAS, the final plat was reviewed by the Blue Earth County 

Planning Commission on the 7th day of June, 1995, and found to be in 

conformance with the approved preliminary plat; and, 



WHEREAS, the final plat meets the requirements of the Blue Earth 

County Subdivision Ordinance.



NOW, THEREFORE, BE IT RESOLVED that the Blue Earth County Board 

of Commissioners hereby approve the final plat of Eagle Ridge 

Subdivision, and authorizes the Chair of the Board of Commissioners 

and the County Administrator to sign said plat. 



This resolution shall become effective immediately upon its passage 

and without publication.

After discussion and comments by Mr. Warren Smith, Survey 

Services, Commissioner Barnes moved and Commissioner Bennett seconded 

the motion to approve a Preliminary Plat Review and a Final Plat 

Review to Mr. Ken Hansen.

A RESOLUTION

APPROVING FINAL PLAT

HANSEN SUBDIVISION

MANKATO TOWNSHIP



WHEREAS, the owner of the property included in the plat of 

Hansen Subdivision has submitted a final plat for approval; and, 



WHEREAS, the final plat was reviewed by the Blue Earth County 

Planning Commission on June 7th, 1995; and, 



WHEREAS, the Blue Earth County Planning Commission recommended 

approval of said final plat; and,



WHEREAS, the final plat meets the requirements of the Blue Earth 

County Subdivision Ordinance.



NOW, THEREFORE, BE IT RESOLVED that the Blue Earth County Board 

of Commissioners hereby approve the final plat of Hansen Subdivision, 

and authorizes the Chair of the Board of Commissioners and the County 

Administrator to sign said plat.



This resolution shall become effective immediately upon its passage 

and without publication.

Commissioner Bennett moved and Commissioner Landkamer seconded 

the motion to approve a Preliminary Plat Review to Mr. Clair Haefner 

for Haefner Subdivision No. 2, Section 30, LeRay Township. The

Commissioner Landkamer moved and Commissioner More seconded the 

motion to approve the following:



RESOLUTION

APPROVING FINAL PLAT

REGISTERED LAND SURVEY NO. 134

SECTION 14, SHELBY TOWNSHIP



WHEREAS, Betty Irvine, the owner of Registered Land Survey No. 

134 has submitted a final plat for approval; and, 



WHEREAS, the final plat was reviewed by the Blue Earth County 

Planning Commission on June 7th, 1995; and, 



WHEREAS, the Blue Earth County Planning Commission recommended 

approval of said final plat; and,



WHEREAS, the final plat meets the requirements of the Blue Earth 

County Subdivision Ordinance.



NOW THEREFORE BE IT RESOLVED, that the Blue Earth County Board 

of Commissioners hereby approve the final plat of Registered Land 

Survey No. 134., and authorizes the Chair of the Board of 

Commissioners and the County Administrator to sign said plat.

Commissioner Landkamer moved and Commissioner Bennett seconded 

the motion to set a public hearing for Alan and Alfred Loeffler on 

July 18, 1995 at 9:30 a.m. for a request for rezoning from C-1 to I-2 

Part of the north half of section 30, Lime Township. The motion

Commissioner Bennett moved and Commissioner More seconded the 

motion to approve the following:



RESOLUTION GRANTING A CONDITIONAL USE PERMIT 

TEMPORARY USE OF A MOBILE HOME

SECTION 12, GARDEN CITY TOWNSHIP



WHEREAS, Keith Wittrock, owner of the following real estate in 

the County of Blue Earth, Minnesota, to wit: 



Northeast Quarter of the Southwest Quarter of the Northeast 

Quarter of Section 12, Garden City Township 



has applied for a Conditional Use Permit for temporary use of a 

mobile home in an A-1, Prime Agriculture Zoning District, and 



WHEREAS, the Planning Agency of the County has completed a 

review of the application and made a report pertaining to said 

request (AH 02-95), a copy of said report has been presented to the 

County Board; and



WHEREAS, the Planning Agency of the County on the 23rd day of 

May, following proper notice, held an administrative, public hearing 

regarding the request; and



WHEREAS, the Blue Earth County Board of Commissioners finds 

that:



1. The proposed use will not impede the normal and orderly 

development and improvement of surrounding vacant property 

for predominate uses in the area.



2. The proposed use will not be injurious to other uses 

already permitted in the area.



3. Adequate utilities, access roads, drainage and other 

necessary facilities have been or are being provided. 



4. Soil conditions are adequate to accommodate the proposed 

use including a legal, on-site sewage treatment system. 



5. The proposed use will not create offensive odor, fumes, 

dust, noise, fumes or vibrations to neighboring properties. 



6. The proposed use will not create traffic congestion. 



7. The density of the proposed residential structure is not 

greater than the density of the surrounding neighborhood or 

greater than the density of the A-1, Prime Agriculture 

Zoning District.



8. The proposed use is consistent with the County Land Use 

Plan.



NOW THEREFORE BE IT RESOLVED, by the Blue Earth County Board of 

Commissioners, that the request for a Conditional Use Permit for 

temporary use of a mobile home, in an A-1, Prime Agriculture Zoning 

District, is granted with the following conditions: 



1. The applicant provide on-site sewage treatment for both the 

mobile home and house.



2. The Conditional Use permit for temporary use of a mobile 

home is effective up to three years until the house is 

ready for occupancy or June 27, 1998, whichever is sooner. 



3. The applicant removes the mobile home from site when the 

permanent structure is ready for occupancy. 



This resolution shall become effective immediately upon its 

passage and without publication.



The motion carried. 95-235



Ms. Lucille Wiemert, Ponderosa Landfill, presented information 

on closure costs for the landfill. Ms. Katie Wortel, Mankato, asked 

questions regarding the landfill.



Mr. Dana Melius, MVAC Community Development Coordinator, 

presented the following items for the Boards consideration. 



Pursuant to advertisement, a public hearing was held to update 

the public on the Minnesota Housing Finance Agency Rehabilitation 

Loan Programs administered by Minnesota Valley Action Council. The 

public hearing was opened for public comments by Chairperson Tacheny 

at 10:30 a.m., June 27, 1995. There were no public comments and 

Chairperson Tacheny officially closed the public hearing at 10:45 

a.m., June 27, 1995. A transcript of this hearing is on file at the 

County Administrator's Office, Courthouse, Mankato, MN. 



Commissioner More moved and Commissioner Landkamer seconded the 

motion to authorize MVAC to apply for MHFA Rehabilitation Loan 

Program:

RESOLUTION AUTHORIZING APPLICATION FOR

MHFA REHABILITATION LOAN PROGRAM FUNDS



WHEREAS, the Minnesota Housing Finance Agency, State of 

Minnesota, has been authorized to undertake a program to 

provide loans to property owners for the purpose of housing 

rehabilitation; and



WHEREAS, Minnesota Valley Action Council has developed an 

application as an Administering Entity for the Minnesota 

Housing Finance Agency Rehabilitation Loan Programs; and 



WHEREAS, Minnesota Valley Action Council has demonstrated 

the ability to perform the required activities of the 

Minnesota Housing Finance Agency Rehabilitation Loan 

Programs;



NOW, THEREFORE, be it resolved, that Minnesota Valley 

Action Council is hereby authorized as an entity to be 

charged with the administration of funds made available 

through the Minnesota Housing Finance Agency Rehabilitation 

Loan Programs, in Blue Earth County.

Commissioner Landkamer moved and Commissioner Bennett seconded 

the motion to approve MVAC's Emergency Shelter Grants Program: 



BLUE EARTH COUNTY

CERTIFICATE OF APPROVAL FOR THE

EMERGENCY SHELTER GRANTS PROGRAM



The County of Blue Earth certified that the project being 

proposed by Minnesota Valley Action Council, being located 

within our jurisdiction, has the county's approval to apply 

directly to the State of Minnesota and the Department of 

Economic Security's Community Based Services Division for 

Emergency Shelter Grants Program funding.

Mr. Scott Fichtner, Environmental Services Director and Mr. Rick 

Hanna, Land Use & Natural Resources Administrator, updated the Board 

on Environmental Services issues.



Mr. David Twa, County Administrator, presented the May 

Financial Report as an informational item. 



Commissioner More moved and Commissioner Bennett seconded the 

motion to approve a Tax Abatement to Matchmaker Realty, for a Mobile 

Home located at 306 Silver Street, Lake Crystal, MN M09-0100-00670 K- 

379977. The motion carried. 95-238



The meeting recessed at 12:06 p.m.

The meeting reconvened at 1:30 p.m.



The County Board of Equalization was continued from June 20, 

1995. Following discussion with Mr. Jerry Kallheim, Deputy 

Administrator/Land Records, and Mr. Jerry Sader, Assistant County 

Assessor, about factors involved with respective properties, the 

following action was taken.



Commissioner Barnes moved and Commissioner More seconded the 

motion to reduce market value from $93,100 to $89,600 to Mr. Raymond 

Cornelius, 609 Rapidan Township, R48-13-03-352-006. The motion

motion to give a 25% reduction on homestead property in the area
