BLUE EARTH COUNTY, MINNESOTA
February 11, 1997
The County Board of Commissioners met in the Commissioners'
Room at 6:00 p.m. Present were Chairperson Lin Barnes,
Commissioner Leon Tacheny, Commissioner Al Bennett, Commissioner
Colleen Landkamer, Commissioner Alvis More, County Attorney Ross
Arneson and County Administrator David Twa.
1. AGENDA REVIEW
Commissioner Landkamer moved and Commissioner Bennett
seconded the motion to approve the amended Agenda to include a
FEMA Disaster Resolution, Data Practices and Environmental
Services Advisory Committee appointments, River Friendly Farmers
and Agriculture Industry Day Proclamations. The motion carried.

2. COMMISSIONERS' COMMITTE REPORTS
The Commissioners reported on committees that they have
attended since the last Board Meeting.
3. ADMINISTRATIVE SERVICES
Mr. David Twa, County Administrator, presented the following
items for the Boards consideration.
Commissioner Tacheny moved and Commissioner Landkamer
seconded the motion to approve the Board Minutes of January 21,
1997. The motion carried. 97-44
Commissioner Landkamer moved and Commissioner Bennett
seconded the motion to approve the following Bills:
Bills for Week of January 27-31, 1997
Grand Total $3,295,423.94
Bills for Week of February 3-7, 1997
Grand Total $1,271,096.99
Bills for Week of February 10-14, 1997
Grand Total $2,107,311.15

Commissioner Tacheny moved and Commissioner More seconded
the motion to approve the following Personnel items:
Employment of Sara Crocker, as a Probation Officer (.5
FTE) (C42), with a starting salary of $14.34 per hour
effective February 12, 1997. (Community Corrections)
Revision of voluntary reduction in hours for Jeanne
Petroske-Atkinson, Probation Officer (C42), from
February 1, 1997 to February 10, 1997. (Community
Corrections)

Commissioner Tacheny moved and Commissioner Bennett seconded
the motion to approve Tax Abatements to Alvis & Carol More, RR 3,
Box 139, Mapleton, Medo Township R46-20-07-200-003 K-198663 under
the "Disaster Option"; Tonga Inc., 100 North Belmont Drive,
Mankato R01-09-17-258-015 K-388299 for taxes payable in 1995 and
1996; Tony Helder, 604 Richard Road, Lake Crystal, MN M09-0100-
02400 for taxes payable in 1996. The motion carried.
Commissioner More abstained. 97-47
Commissioner More moved and Commissioner Bennett seconded
the motion to approve a Minnesota Lawful Gambling Application for
Authorization for an Exemption from Lawful Gambling License to
Lura Lake Association to be held at Daly Park, Mapleton Township,
on May 24, 1997. The motion carried. 97-48
Commissioner More moved and Commissioner Bennett seconded
the motion to approve a Liquor License to Randy Spear and
Michelle Samuelson d/b/a Windmill Bar, Highway 22 North,
Mapleton, MN. The motion carried. 97-49
Commissioner Tacheny moved and Commissioner Landkamer
seconded the motion to approve a Minnesota Lawful Gambling
Application for Authorization for an Exemption from Lawful
Gambling License to Hospice Family Fundraisers, to be held at the
Mankato Golf Club, Mankato Township on April 12, 1997. The
motion carried. 97-50
Commissioner Tacheny moved and Commissioner Landkamer
seconded the motion to approve an Application for Authorization
to Conduct a One-Day Off-Site Gambling License to the Mankato
Area Hockey Association to be held at the Mankato Golf Club,
Mankato Township on March 4, 1997. The motion carried. 97-51
Commissioner Bennett moved and Commissioner More seconded
the motion to approve an Application for Authorization to Conduct
a One-Day Off-Site Gambling License to Crystal & Loon Lakes
Recreation, Inc. to be held at Loon Lake, Lake Crystal on
February 16, 1997. The motion carried. 97-52
The City of Mankato would like Tax Forfeited property along
the Minnesota River for recreational purposes. They are asking
for a resolution to support special legislation to transfer the
parcel.
Commissioner Landkamer moved to pass the resolution. The
motion failed for a lack of a second.
After discussion, Commissioner Tacheny moved and Commissioner
Bennett seconded the motion to table the request until more
information on the use of the property can be obtained. The
motion carried. 97-53
Commissioner Tacheny moved and Commissioner More seconded
the motion to appoint Commissioner Bennett to the AMC Data
Practices Committee. The motion carried. 97-54
Commissioner More moved and Commissioner Landkamer seconded
the motion to approve the following proclamations:

AGRICULTURE INDUSTRY DAY
PROCLAMATION
Whereas . . .
There is no single industry that has a greater influence on
society than Agriculture.
Whereas . . .
The impact of food and fiber is often the difference between
economic, as well as human, feast or famine.
Whereas . . .
Minnesota's Food and Agriculture Industry accounts for 22%
of the state's exports and accounts for one of every three
jobs in the state.
Whereas . . .
South Central Minnesota is a recognized leader in corn,
soybean, and swine production in Minnesota and has a
significant amount of dairy, beef, poultry, and canning crop
production.
Whereas . . .
Numerous industries and retail businesses in South Central
Minnesota are directly linked to the Food and Agriculture
Industry for their job creation and economic viability.
The Blue Earth County Board of Commissioners designated
March 6, 1997, as South Central "AGRICULTURE INDUSTRY DAY" in
support and recognition of the region's vast and far-reaching
Food and Agriculture Industry.
"RIVER FRIENDLY FARMERS"
BLUE EARTH COUNTY
PROCLAMATION
Whereas . . .
Blue Earth County is participating with thirty-six other
counties in the Minnesota River Basin Joint Powers Board.
Whereas . . .
Blue Earth County supports voluntary efforts to implement
best management agricultural practices to enhance surface
water quality in the Minnesota River Basin.
Whereas . . .
Blue Earth County farm families were provided an opportunity
to apply for the "River Friendly Farmer" program and all
applications were reviewed by a special County Environmental
Education Committee to verify that listed criteria were
achieved.
The Blue Earth County Board of Commissioners supports the
designation of the following Blue Earth County farm families as
"River Friendly Farmers":

3. Patrick and Kristin Duncanson, Mapleton

Commissioner Bennett moved and Commissioner Tacheny seconded
the motion to approve the following resolution:
RESOLUTION AUTHORIZING
EXECUTION OF SUB-GRANT AGREEMENT
Be it resolved that Blue Earth County enter into a Sub-
grant Agreement with the Division of Emergency
Management in the Minnesota Department of Public Safety
for the program entitled Infrastructure Program for
FEMA 1158 DR-MINNESOTA.
Robert Smith, Chief Deputy is hereby authorized to
execute and sign such Sub-grant Agreements and
amendments as are necessary to implement the project on
behalf of Blue Earth County.
The motion carried. 97-56
Commissioner Bennett moved and Commissioner Landkamer
seconded the motion to appoint Mr. Ed Twedt, Mankato, to the
Environmental Services Committee. The motion carried. 97-57
4. MAPLETON ICE ARENA FUNDING
Honorable Jim Swanson, Mapleton Mayor, and Mr. Jeff Annis,
Mapleton, were present to inform the Board of the Mighty Ducks
Grant they have received to renovate the Heather Curling Club's
facility in Mapleton. The club is requesting $15,000 from Blue
Earth County to help match the grant.
Commissioner More moved and Commissioner Landkamer seconded
the motion to approve the donation of $15,000 to the project.
Commissioner Landkamer, Barnes and Bennett voted nay. The
motion failed.
Mr. Ray Phelps, Mapleton, stated that he supports the
project. The Board stated that they supported the project,
however, the concern they had was with the amount to donate.
After discussion, Commissioner Bennett moved and
Commissioner Tacheny seconded the motion to donate $5,000 a year
for two years to be paid out of the Economic Development Fund.
The motion carried. 97-58 (Adjust Budgets Accordingly)
5. BERBI PROJECT
Mr. Ray Phelps, SWCD Supervisor and Ms. Linda Meschke, BERBI
Coordinator, gave an update on the Blue Earth River Basin
Initiative (BERBI) Project. BERBI was officially formed in 1993
as a Joint Powers Organization of the SWCD's in Blue Earth,
Faribault, Martin, Waseca and Watonwan Counties with a Memorandum
of Understanding from all five Counties. These five Counties
include about 80% of the Blue Earth River Watershed. The major
focus of BERBI is implementation and getting conservation
practices on the land.
6. PUBLIC WORKS
Mr. Al Forsberg, Public Works Director, presented the
following items for the Boards consideration.
Commissioner Landkamer moved and Commissioner Bennett
seconded the motion to approve the following resolution:
RESOLUTION AUTHORIZING

Commissioner More moved and Commissioner Landkamer seconded
the motion to approve final payment to Southern Minnesota
Construction, Mankato, for the CSAH 3 Overlay Project that has
been successfully completed (Fin. #1296760307). The motion
carried. 97-60
Commissioner Landkamer moved and Commissioner More seconded
the motion to adjust the compensation for Bailiffs to those who
are licensed to carry firearms at $40.00 for half day and $75.00
for a full day and all other Bailiffs at $30.00 for half day and
$60.00 for a full day, effective March 1, 1997. The motion
carried. 97-61
Commissioner More moved and Commissioner Landkamer seconded
the motion to adjourn at 9:30 p.m. The motion carried. 97-62
