The County Board of Commissioners met in the Commissioners' 

Room at 6:00 p.m. Present were Chairperson Colleen Landkamer, 

Commissioner Leon Tacheny, Commissioner Lin Barnes, Commissioner 

Al Bennett, Commissioner Alvis More, County Attorney Ross Arneson 

and County Administrator David Twa.



Commissioner Bennett moved and Commissioner Barnes seconded 

the motion to approve the amended Agenda. The motion carried.

The Commissioners reported on committees that they have 

attended since the last Board Meeting.



Commissioner Barnes moved and Commissioner Bennett seconded 

the motion to approve the April 23, 1996 Board Minutes. The 

motion carried. 96-157



Commissioner Tacheny moved and Commissioner More seconded 

the motion to approve the following Bills: 



Bills for Week of April 29 - May 3, 1996 



Grand Total $787,226.71



Bills for Week of May 6-10, 1996

Commissioner Tacheny moved and Commissioner Bennett seconded 

the motion to approve the following Personnel items: 



Promotion of Karen Nickels, from Senior Account Clerk 

(B22) to a Child Support Officer (C41), with a salary 

adjustment from $12.62 to $13.44 per hour effective 

June 3, 1996. (Human Services)



Authorization to initiate recruitment for a Senior 

Account Clerk (B22). (Human Services)

Commissioner Barnes moved and Commissioner Bennett seconded 

the motion to reappoint Mr. Al Forsberg as Blue Earth County 

Engineer for a four (4) year period commencing May, 1996 through 

April, 2000. The motion carried. 96-160



Commissioner Barnes moved and Commissioner Bennett seconded 

the motion to approve an On-Sale Application For Retailer's Non- 

Intoxicating Malt Liquor License and a Renewal of Consumption & 

Display Permit to Mr. Kenneth Bohks d/b/a Minneopa Golf Club, 

South Bend Township. The motion carried. 96-161 



Commissioner Barnes moved and Commissioner Tacheny seconded 

the motion to approve Off-Sale Application For Retailer's Non- 

Intoxicating Malt Liquor License to Donald Olsen, D & R Marketing 

d/b/a LeHillier Quick Mart, Highway 169 South & Hawley Street, 

LeHillier. The motion carried. 96-162



Commissioner Bennett moved and Commissioner More seconded 

the motion to re-appoint Mr. Keith Stoltzman, Amboy, as Blue 

Earth County's representative on MRCI's Board of Directors. The 

motion carried. 96-163



Commissioner More moved and Commissioner Barnes seconded the 

motion to approve and to have the Chairperson and County 

Administrator sign the AFSCME Union Contracts. The motion 

carried. 96-164



Mr. David Twa, County Administrator, presented the Uniform 

Baseline and Settlement Form as an informational item. 



The Certification of Local Performance Measures for Local 

Performance Aid payable in 1997 was presented to the Board as an 

informational item.



Commissioner Barnes moved and Commissioner Bennett seconded 

the motion to approve a tax abatement to Mr. Douglas Marble, RR 

6, Box 655, South Bend Township, R50-08-34-200-010 K-22238, 

payable in 1996. The motion carried. 96-165 



Commissioner More moved and Commissioner Bennett seconded 

the motion to approve the following Proclamation: 



WHEREAS, Shirley Higginbotham has dedicated the last 

twenty-five years to a career as a Library Director in 

Mankato and has now announced that she will retire on 

June 28, 1996; and



WHEREAS, Shirley is an active participant in the 

KEYC-TV Community update program and KEYC-TV 

Read-More-About-It library promotions; is a member of 

the Elder in First Presbyterian Church and chair of 

Personnel Committee; Habitat for Humanity Family 

Selection Committee; Internal Review/Human Rights 

Committee, MRCI; Blue Earth County Historical Society; 

Friends of Minnesota Valley Regional Library, Summit 

Center; Red Cross; and



WHEREAS, She has served on many boards and 

organizations. They include past presidents of Harry 

Meyering Center Board of Directors, Horizon Homes Board 

of Directors, Merely Players Community Theatre; and 

president and treasurer of the Zonta Club of Mankato 

Area. She served on the Chamber of Commerce 

Ambassadors and Government Relations Committee; United 

Way Board of Directors; American Association of 

University Women; Mankato/North Mankato Bicentennial 

Commission; State Advisory Council for the Minnesota 

Braille and Sight-Saving School, Leadership Mankato; 

March of Dimes; and was a former board president, 

treasurer of the YWCA; and received the YWCA 

LeaderDinner Award in 1990; and



WHEREAS, Shirley will be honored at an Open House on 

Thursday, May 16, 1996;



NOW THEREFORE, BE IT RESOLVED, By the Blue Earth County 

Board of Commissioners that Shirley Higginbotham be 

honored on behalf of the entire County of Blue Earth on 

her achievements.



BE IT FURTHER RESOLVED, that May 16, 1996 is hereby 

proclaimed



"SHIRLEY HIGGINBOTHAM DAY!"

Commissioner More moved and Commissioner Bennett seconded 

the motion to re-appoint Ms. Ruth Nicolai, Janesville, MN to the 

Minnesota Valley Regional Library Board. The motion carried.

Mr. Mark Scheidel, Region Nine, presented the following 

items for the Board consideration.



Mr. Ken Bunde, Mankato, made comments and asked questions 

regarding the next item. Commissioner Barnes moved and 

Commissioner More seconded the motion to approve the following 

resolution.



RESOLUTION

WHEREAS: The Minnesota River Scenic Byway has been 

designated on routes between Mankato and Granite Falls. 



WHEREAS: There are Federal Scenic Byway funds 

available for 80% of cost of a corridor plan. 



WHEREAS: A corridor plan is needed to be eligible for 

Scenic Byway funds.



WHEREAS: A corridor plan is needed in order to 

identify what the governments, agencies and other 

interested parties would like to see done in the Byway 

Corridor.



WHEREAS: The Minnesota River Task Force was successful 

in getting the Minnesota River Basin Joint Powers Board 

to be the official applicant.



WHEREAS: The MRBJPB needs $16,000 for the 20% local 

match to apply for funds to do an $80,000 corridor 

plan.



WHEREAS: The affected counties are being asked to 

provide the local share and a reasonable amount for 

Blue Earth County is $1,000.



NOW THEREFORE BE IT RESOLVED that Blue Earth County 

will pay up to $1,000 for local share of the Minnesota 

River Scenic Byway Corridor Plan.

Commissioner More moved and Commissioner Barnes seconded the 

motion to approve the following:



RESOLUTION SUPPORTING

THE SUBMITTAL OF AN APPLICATION FOR

THE MINNESOTA SCENIC BYWAY PROGRAM



WHEREAS, The Sibley County Delegation has been working 

with neighboring Counties and communities to discuss 

the submittal of an application to designate a scenic 

byway between T.H. 25 near Belle Plaine and Mankato; 

and



WHEREAS, Designation of a scenic byway would promote 

travel and recreation along the identified route 

resulting in additional tourism dollars for the County; 

and



WHEREAS, The Tourism Committee is working to identify 

natural, cultural, historic, archaeological and 

recreational resources in Blue Earth County to include 

on the map; and



WHEREAS, Participation in the submittal of an 

application could result in economic development for 

the region; and



WHEREAS, It is understood that signs may be attached to 

existing route markers.



NOW, THEREFORE, BE IT RESOLVED BY THE BLUE EARTH COUNTY 

BOARD OF COMMISSIONERS, THAT:



The County supports the submittal of an application to 

designate a scenic byway(s) from T.H. 25 near Belle 

Plaine to Mankato.

Mr. Jerry Books, Finance Director, presented the following 

item for the Boards consideration.



Commissioner More moved and Commissioner Bennett seconded 

the motion to authorize Mr. Jerry Books, Finance Director, to 

designate depositories per Minnesota Statutes Chapter 118. The 

motion carried. 96-170



Mr. Al Forsberg, Public Works Director, presented the 

following items for the Boards consideration. 



Commissioner Tacheny moved and Commissioner Bennett seconded 

the motion to approve the following resolutions: 



COUNTY OF BLUE EARTH RESOLUTION



BE IT RESOLVED that the County of Blue Earth enter into 

Agreement No. 74711 with the State of Minnesota, 

Department of Transportation for the following 

purposes, to wit:



To provide for payment by the State to the County for 

the use of County State Aid Highway No. 47 as a Trunk 

Highway No. 68 detour for the removal of Bridge No. 

5431 and replacemnt of Bridge No. 5435 with Bridge No. 

07045 and other associated construction to be performed 

upon, along and adjacent to Trunk Highway No. 68 in 

accordance with State plans, specifications and/or 

special provisions designated as State Project No. 

0710-07045 (T.H. 68=083).



BE IT FURTHER RESOLVED that the proper County officers 

are hereby authorized and directed to execute such 

agreement.



and the following resolution:



COUNTY OF BLUE EARTH RESOLUTION



BE IT RESOLVED that the County of Blue Earth enter into 

Agreement No. 74937 with the State of Minnesota, 

Department of Transportation for the following 

purposes, to-wit:



To provide for payment by the State to the County for 

the use of County State Aid Highways No. 17 and No. 37 

as a Trunk Highway No. 60 detour for grading, 

surfacing, bridge construction and other associated 

construction to be performed upon, along and adjacent 

to Trunk Highway No. 14 in accordance with State plans, 

specifications and/or special provisions designated as 

State Project No. 0702-96 (T.H. 14=007). 



BE IT FURTHER RESOLVED that the proper County officers 

are hereby authorized and directed to execute such 

agreement.

Commissioner Bennett moved and Commissioner More seconded 

the motion to increase Blue Earth County Camping rates from $9.00 

per day to $10.00 per day and increase the boat rental rates from 

$2.00 per hour to $3.00 per hour. The motion carried. 96-172 



Pursuant to publication, bids were received, opened and 

reviewed for the followng public works project, with the 

following results:

Commissioner Tacheny moved and Commissioner More seconded the 

motion to award the bid to Dulas Excavating, Wells, MN in the 

amount of $86,230.00. The motion carried. 96-173 



Pursuant to advertisement, a public hearing was held to 

amend the County Land Use/Zoning Ordinance. The public hearing 

was opened by Chairperson Landkamer at 7:00 p.m., May 7, 1996. 

Mr. Rick Hanna, Land Use & Natural Resources Administrator, Ms. 

Julie Conrad, Land Use & Natural Resources Planner and Mr. Scott 

Fichtner, Environmental Services Director, presented the proposed 

changes. Chairperson Landkamer opened the public hearing for 

public comments. Those speaking were: Ms. Diane Ruedy, Good 

Thunder, submitted a letter from Henry Quade, Beauford Township; 

Mr. Earl Preston, Mapleton; Mr. Charles Schmidt, Garden City 

Township; Ms. Katy Wortel, Mankato Township; Mr. Wayne Dodge; Ms. 

Sandy Hooker, Mapleton, submitted a letter from the Medo Township 

Board; Ms. Alice Meier, Pleasant Mound Township; Mr. Scott 

Hislop, Mapleton, Blue Earth County Pork Producers President and 

Mr. Warren Smith, Mankato. Chairperson Landkamer officially 

closed the public hearing at at 8:38 p.m., May 7, 1996. 



After Board discussion Commissioner Tacheny moved and 

Commissioner Bennett seconded the motion to adopt the ordinace. 

The motion carried. A transcript of this hearing is on file at 

the County Administrator's Office, Courthouse, Mankato. MN.

Mr. Blaine Phillips and Mr. Harold Phillips expressed 

concerns on County Ditch 77. Staff will work with them to answer 

their questions.



Commissioner Bennett moved and Commissioner Barnes seconded
