BLUE EARTH COUNTY, MINNESOTA

January 21, 1997





The County Board of Commissioners met in the Commissioners' 

Room at 9:00 a.m. Present were Acting Chairperson Al Bennett, 

Commissioner Leon Tacheny, Commissioner Colleen Landkamer, County 

Attorney Ross Arneson and County Administrator David Twa. 



Commissioner Landkamer moved and Commissioner Tacheny 

seconded the motion to approve the amended Agenda to include a 

Disaster Declaration Resolution and a grant from the Center for 

Enterprise Facilitation. The motion carried. 97-26 



The Commissioners reported on committees that they have 

attended since the last Board Meeting.



Commissioner Tacheny moved and Commissioner Landkamer 

seconded the motion to approve the January 7, 1997 Board Minutes.

Commissioner Landkamer moved and Commissioner Tacheny 

seconded the motion to approve the following Bills: 



Bills for Week of January 13-17, 1997

Commissioner Landkamer moved and Commissioner Tacheny 

seconded the motion to approve the following Personnel items: 



Authorization to initiate recruitment for a Land Use 

Planner I (C42). (Environmental Services) 



Employment of Laurie Berg, as a License Center 

Specialist II (B22), with a starting salary of $10.69 

per hour effective January 22, 1997. (License Center)

Ms. Jody Bloemke, Administrative Assistant, presented the 

following item for the Board's consideration. 



Commissioner Landkamer moved and Commissioner Tacheny 

seconded the motion to approve being the fiscal agent for a two 

year grant in the amount of $41,215 from the State of Minnesota. 

The grant will expand the WE-LEAD Leadership Program, a regional 

leadership training involving Blue Earth, LeSueur, Nicollet, 

Sibley and Waseca Counties and their Extension Departments. The 

motion carried. 97-30



Commissioner Tacheny moved and Commissioner Landkamer 

seconded the motion to reappoint Mr. Bernard Cranston, Mankato 

and Ms. Joan Eichers, Mankato, for a three year term to the 

Extension Committee. The motion carried. 97-31 



Commissioner Landkamer moved and Commissioner Tacheny 

seconded the motion to approve the following Extension Department 

items:



PAYMENT ADJUSTMENT TO THE

MEMORANDUM OF AGREEMENT

BETWEEN THE UNIVERSITY OF MINNESOTA

EXTENSION SERVICE

AND BLUE EARTH COUNTY

FOR EMPLOYING COUNTY EXTENSION STAFF



In accordance with the terms of our Memorandum of 

Agreement with the University of Minnesota Extension 

Service related to the hiring of county extension 

staff, salary funds for non-union employees and 

department heads in this county were increased by 2% 

during 1996.



This percent increase will be added to the county 

payment for each full time equivalent extension 

educator in the county for 1997.



RESOLUTION BY THE COUNTY BOARD OF COMMISSIONERS 

APPROPRIATING FOR COUNTY EXTENSION WORK



BLUE EARTH COUNTY

YEAR BEGINNING JANUARY 1, 1997



BE IT RESOLVED: That the sum of $151,546 be set apart 

from the General Fund and appropriated subject to the 

order of the Dean and Director of the Minnesota 

Extension Service of the University of Minnesota for 

the support of county extension work in Blue Earth 

County for the year beginning January 1, 1997, in 

accordance with Minnesota Statue, Section 38.33-38.38, 

1990.

Commissioner Landkamer moved to approve a tax abatement to 

Alvis and Carol More for their property located at Rural Route 3, 

Box 139, Mapleton R46-20-07-200-003 K-198663 destroyed by fire, 

the motion died for a lack of a second.



Commissioner Tacheny moved and Commissioner Landkamer 

seconded the motion to approve a contract with the Minnesota 

Department of Corrections Stillwater to house Stillwater 

Prisoners that are eligible for work release programs in the Blue 

Earth County Jail when space is available. The County would be 

paid $50.00 a day for each prisoner. The motion carried. 97-33 



Commissioner Tacheny moved and Commissioner Landkamer 

seconded the motion to approve the following: 



RESOLUTION REQUESTING A PRESIDENTIAL DECLARATION 

OF A MAJOR DISASTER



WHEREAS, the County of Blue Earth Minnesota has 

sustained severe losses of a major proportion, brought 

on by blizzard conditions from January 10, 1997, and 

continuing.



WHEREAS, the County of Blue Earth Minnesota has had 

record snowfalls resulting in plowing and removal 

expenditures far beyond our capability.



WHEREAS, Blue Earth County is a public entity within 

the state of Minnesota.



WHEREAS, the following conditions exist in Blue Earth 

County as a result of the disaster. The control of 

snow accumulations have exhausted the snow removal 

budget of the County.



NOW THEREFORE BE IT RESOLVED that the Board of County 

Commissioners, for and on behalf of the citizens of 

Blue Earth County, request the Governor of the state of 

Minnesota to petition the President of the United 

States to declare the County of Blue Earth, Minnesota 

to be a major disaster area through appropriate 

channels.



BE IT FURTHER RESOLVED, that this request is for the 

Infrastructure Support Program as offered through P.L. 

93-288.



BE IT FURTHER RESOLVED, that the County Emergency 

Management Director is authorized to coordinate the 

damage survey teams with local government and assist in 

the administration of the disaster recovery process as 

needed.

Commissioner Landkamer moved and Commissioner Tacheny 

seconded the motion to accept and send an invoice for a grant of 

$10,500 from the Center for Enterprise Facilitation for Blue 

Earth Center for Enterprise Facilitation Program. The motion 

carried. 97-35



Mr. Veryl Morrell, Land Use & Natural Resources 

Administrator, presented the following Planning and Zoning items. 



After hearing from the property owner Mr. Jack Regan, 

Commissioner Landkamer moved and Commissioner Tacheny seconded 

the motion to approve the following:



RESOLUTION

APPROVING A CERTIFICATE OF PLAT CORRECTION 

HAVEN HILLS NO. 2

MANKATO TOWNSHIP



WHEREAS, Carol Regan, has submitted a Certificate of 

Correction, to rename the private driveway, as shown on Haven 

Hills No. 2, as Haven Hills Road , for approval; and 



WHEREAS, the Certificate of Correction was reviewed by the 

Blue Earth County Planning Commission on January 8, 1997; and 



WHEREAS, the Blue Earth County Planning Commission 

recommended approval of said Certificate of Correction; and 



NOW THEREFORE BE IT RESOLVED, that the Blue Earth County 

Board of Commissioners hereby approve the Certificate of 

Correction of Haven Hills No. 2, and that this resolution 

authorizes the Chair of the Board of Commissioners and the County 

Administrator to sign said Certificate of Correction. 



This resolution shall become effective immediately upon its 

passage and without publication.

Commissioner Tacheny moved and Commissioner Landkamer 

seconded the motion to approve the following Conditional Use 

Permit:

RESOLUTION GRANTING A

CONDITIONAL USE PERMIT

FOR A MANUFACTURED HOME

LOTS 10, 11, AND 12, BLOCK 21, RIVERSIDE PARK ADDITION 

SECTION 14, SOUTH BEND TOWNSHIP



WHEREAS, Dean and Julie Mettler, owners of the following 

real estate in the County of Blue Earth, Minnesota, to wit: 



Lots 10, 11, and 12, Block 21, Riverside Park Addition, Le 

Hillier Townsite, Section 14, T 108 North, R 27 West, South 

Bend Township;



have applied for a Conditional Use Permit to place a manufactured 

home in an RT, Rural Townsite Zoning District, and 



WHEREAS, the Planning Agency of the County has completed a 

review of the application and made a report pertaining to said 

request (AH 01-97), a copy of said report has been presented to 

the County Board; and



WHEREAS, the Planning Agency of the County on the 9th day of 

January, 1997, following proper notice, held an administrative, 

public hearing regarding the request; and 



WHEREAS, the Blue Earth County Board of Commissioners finds 

that:



1. The proposed use conforms with the County Land Use 

Plan.



2. The applicant has demonstrated a need for the proposed 

use.



3. The proposed use will not degrade the water quality of 

the County.



4. The proposed use will not adversely increase the 

quantity of water runoff.



5. The soils are adequate to accommodate the proposed use. 



6. The proposed use does not create a potential pollution 

hazard.



7. Adequate utilities, access roads, drainage and other 

necessary facilities have been or are being provided. 



8. Adequate measures have been or will be taken to provide 

sufficient off-road parking space to serve the proposed 

use.



9. The Conditional Use will not be injurious to the use 

and enjoyment of other property in the immediate 

vicinity for the purposes already permitted. 



10. Establishment of the Conditional Use will not impede 

the normal and orderly development and improvement of 

surrounding vacant property for the predominate uses in 

the area.



11. Density of the proposed residential development is not 

greater than the density of the surrounding 

neighborhood or applicable zoning district. 



NOW THEREFORE BE IT RESOLVED, by the Blue Earth County 

Board of Commissioners, that the request for a Conditional Use 

Permit for temporary use of a mobile home, in an RT, Rural 

Townsite Zoning District, is granted with the following 

conditions:



1. That the manufactured home be installed in conformance 

with State of Minnesota manufactured home installation 

requirements.



2. That there shall be a full basement beneath the living 

quarters of the manufactured home.



3. That the addition be constructed concurrent with the 

homes s installation.



This resolution shall become effective immediately upon its 

passage and without publication.

Mr. Scott Fichtner, Environmental Services Director, 

presented the following items for the Boards consideration. 



Commissioner Landkamer moved and Commissioner Tacheny 

seconded the motion to approve Addendum No. 3 to the Foth & Van 

Dyke agreement. This addendum covers the general consulting 

services associated with the operation of the Ponderosa Landfill 

during 1997. The motion carried. 97-38



Commissioner Tacheny moved and Commissioner Landkamer 

seconded the motion to approve a Joint Powers Agreement with the 

Minnesota Department of Agriculture to be a co-operator in the 

Continuous Waste Pesticide Collection Pilot Project. The motion 

carried. 97-39



Commissioner Tacheny moved and Commissioner Landkamer 

seconded the motion to approve an agreement with Southern 

Minnesota Construction Company Inc., to operate, for the benefit 

of the residents of Blue Earth County, a facility for the 

composting of yard waste. The Agreement will commence on January 

1, 1997, and shall expire on December 31, 2001. The motion 

carried. 97-40



Mr. Dennis McCoy, Deputy County Administrator, presented the 

following Human Service items for the Boards consideration. 



Commissioner Landkamer moved and Commissioner Tacheny 

seconded the motion to approve the following contracts: 



Approval of an agreement which renews the Waivered 

Service Contract with the Lutheran Home Inc./Cedar 

Haven, Mankato; Country Neighbors Inc., Mapleton; 

Meadowbrook Board and Home Care/Lori Zeik, Mankato; 

Country Neighbors Inc., Lake Crystal; and Sibley 

Manor/Kevin Anderson, Mankato to provide Elderly Waiver 

Services. The time-frame for the agreements is 

February 1, 1997 through December 31, 1997. 



Approval of the 1997 Cooperative Agreement for Child 

Support Administrative Process between the Department 

of Human Services, the Court Administrator, the Blue 

Earth County Sheriff and the Blue Earth County Human 

Services Department.

Commissioner Landkamer moved and Commissioner Tacheny 

seconded the motion to adjourn at 10:45 a.m. The motion carried.
