The County Board of Commissioners met in the Commissioners' 

Room at 2:00 p.m. Present were Chairperson Leon Tacheny, 

Commissioner Colleen Landkamer, Commissioner Lin Barnes, 

Commissioner Al Bennett, County Attorney Ross Arneson and County 

Administrator David Twa.



Commissioner Landkamer moved and Commissioner Barnes 

seconded the motion to approve the Agenda. The motion carried.

The Commissioners gave updates on the Committee's that they 

serve on.



The 1995 Planning Workshop started at 2:15 with Mr. Scott 

Fichtner, Environmental Services Director; Mr. Dennis McCoy, 

Deputy County Administrator; Mr. Jerry Kallheim, Deputy 

Administrator-Land Records; and Mr. Jerry Books, Finance 

Director, making presentations.



Commissioner Barnes moved and Commissioner Bennett seconded 

the motion to proceed with phase one of the consultant agreement 

with Forth & Van Dyke, Eden Prairie, MN. The motion carried.

Commissioner Landkamer moved and Commissioner Bennett 

seconded the motion to continue with the same coverage for the 

Blue Earth County Employees July 1, 1995 health insurance renewal 

except for a $10 Office Copay to be added to the aware gold 

portion. The motion carried. 95-152



Mr. Dennis McCoy, Deputy County Administrator, presented the 

following Human Service items for the Boards consideration. 



Commissioner Landkamer moved and Commissioner Barnes 

seconded the motion to approve the following items: 



Agreement with Southern Minnesota Independent Living 

Enterprises and Services (SMILES) to provide semi- 

independent living services from May 1, 1995 to April 

30, 1996.



Agreement with the Minnesota Valley Action Council 

(Senior Dining Program) to provide Meals on Wheels 

under the Waivered Service Program from May 1, 1995 

through December 31, 1995.

Mr. Rick Hanna, Land Use & Natural Resources Administrator, 

presented the following item for the Board's consideration. 



Commissioner Bennett moved and Commissioner Barnes seconded 

the motion to approve the following Conditional Use Permit: 



RESOLUTION GRANTING A

CONDITIONAL USE PERMIT

FOR A MANUFACTURED HOME

SECTION 29, JAMESTOWN TOWNSHIP



WHEREAS, Philip Rothmeier and Anita Bisch, owners of the following 

real estate in Blue Earth County, Minnesota, to wit: 



That part of the Northeast corner of Section 29, Township 

109 North, Range 25 West, Blue Earth County, Minnesota, 

described as:



Beginning at the Northeast corner of Section 29; thence 

South 00 degrees 39 minutes, 21 seconds East (assumed 

bearing) along the East line of the Northeast Quarter of 

Section 29, a distance of 555.60 feet; thence South 85 

degrees 12 minutes 15 seconds West, 326.00 feet; thence 

North 35 degrees 40 minutes 22 seconds West, 261.60 feet; 

thence North 27 degrees 21 minutes 23 seconds East, 

294.02 feet; thence North 04 degrees 42 minutes 57 

seconds East, 79.15 feet; thence North 71 degrees 14 

minutes 28 seconds East, 87.27 feet to a point on the 

North line of the Northeast Quarter of Section 29;

Contains 5.08 acres of land being subject to and together 

with any and all easements of record.



has applied for a conditional use permit to place mobile home in an 

A-2, Limited Agriculture Zoning District; and 



WHEREAS, the Zoning Administrator, after proper notice, held a 

public hearing concerning this request on the 1st day of May, 1995; 

and,



WHEREAS, staff report AH 01-95, has been presented with a 

recommendation to approve said conditional use permit; and, 



WHEREAS, the Blue Earth County Board of Commissioners finds: 



1. That the propose conditional use permit for a 

manufacture home will not be injurious to the 

use and enjoyment of other property in the 

immediate vicinity for the purposes already 

permitted; and



2. That the establishment of the conditional use 

will not impede the normal and orderly

development and improvement of surrounding 

property for predominant uses in the area. 



NOW, THEREFORE BE IT RESOLVED, by the Blue Earth County Board of 

Commissioners, that the request for a conditional use permit for a 

manufactured home in an A-2, Limited Agriculture Zoning District 

is granted subject to the following conditions: 



1. That the manufactured home be installed in conformance 

with State of Minnesota manufactured home installation 

requirements.



2. That a conforming sewage treatment system and water well 

be installed.



3. That the County Pubic Works Director approve the access 

from the county road.



4. That any change in the use from that stated on the permit 

shall be cause for review and the permit may be 

continued, modified, or terminated.



5. That the conditional use permit shall be valid for 

a period of five years.



This resolution shall become effective immediately upon its passage 

and without publication.

Commissioner Barnes moved and Commissioner Bennett seconded 

the motion to approve a lease agreement with the Department of 

Public Safety, Bureau of Criminal Apprehension, Finance Section, 

commencing on July 1, 1995 and continuing through June 30, 1996 for 

two hundred twenty usable square feet of office space on the first 

floor of the Blue Earth County Law Enforcement Center in Mankato, 

MN at a gross rate of $7.75 per usable square foot. The motion

Commissioner Bennett moved and Commissioner Landkamer seconded 

the motion to approve a tax abatement to Randall and Gloria Larson, 

427 Third Avenue, Pemberton, MN R16-20-12-103-006 K-120522. The

Commissioner Barnes moved and Commissioner Landkamer seconded 

the motion to approve a Combination Application for Retailer's Off- 

Sale Non-Intoxicating Malt Liquor License to D&R Marketing, Inc. 

d/b/a LeHillier Quick Mart located at Hwy 169 South & Hawley 

Street, LeHillier, MN. The motion carried. 95-160

the motion to approve the following adjustments to the Law Library

Mr. Al Forsberg, Public Works Director, presented the

Commissioner Bennett moved and Commissioner Barnes seconded 

the motion to approve the following two Pipeline Agreement 

Resolutions:



BE IT RESOLVED, that pursuant to Minnesota Stat. Sec. 

161.36, the Commissioner of Transportation be appointed 

as Agent of the County of Blue Earth to accept as its 

agent, federal aid funds which may be made available for 

eligible right-of-way acquisition costs for S.P. 07-690- 

06 et alii.



RESOLVED, the Chairman of the Board is hereby authorized 

and directed for and on behalf of the Board of County 

Commissioners to execute and enter into an agreement with 

the Commissioner of Transportation prescribing the terms 

and conditions of said federal aid participation as set 

forth and contained in Agreement No. 72839, a copy of 

which said agreement was before the Board of County 

Commissioners and which is made a part hereof by 

reference.

and

BE IT RESOLVED, that pursuant to Minnesota Stat. Sec. 

161.36, the Commissioner of Transportation be appointed 

as Agent of the County of Blue Earth to accept as its 

agent, federal aid funds which may be made available for 

eligible right-of-way acquisition costs for S.P. 07-690- 

06 et alii.



RESOLVED, the Chairman of the Board is hereby authorized 

and directed for and on behalf of the Board of County 

Commissioners to execute and enter into an agreement with 

the Commissioner of Transportation prescribing the terms 

and conditions of said federal aid participation as set 

for and contained in Agreement No. 73089, a copy of which 

aid agreement was before the Board of County 

Commissioners and which is made a part hereof by 

reference.

Commissioner Landkamer moved and Commissioner Bennett seconded the 

motion to approve the following resolution: 



RESOLUTION AUTHORIZING

PURCHASE OF ADDITIONAL RIGHT OF WAY

CSAH 9 FROM TH 66 TO RAPIDAN



WHEREAS, CSAH 9 from TH 66 to Rapidan requires wider 

shoulders and improved ditch slopes in order to improve 

the safety to the traveling public, and; 



WHEREAS, the existing right of way width is not 

sufficient to construct these safety improvements, now 



THEREFORE, the County Engineer is authorized to acquire 

60 feet of right of way on each side of the centerline of 

CSAH 9 from TH 66 to Rapidan.
