March 26, 1996
The County Board of Commissioners met in the Commissioners'
Room at 9:00 a.m. Present were Chairperson Colleen Landkamer,
Commissioner Leon Tacheny, Commissioner Lin Barnes, Commissioner
Al Bennett, Commissioner Alvis More, County Attorney Ross Arneson
and County Administrator David Twa.
Commissioner Bennett moved and Commissioner More seconded
the motion to approve the amended Agenda. The motion carried.
96-87
Mr. Jerry Kallheim, Deputy Administrator-Land Records,
presented the following item for the Boards consideration.
Commissioner Bennett moved and Commissioner Tacheny seconded
the motion to decrease the Ditch Levy on Judicial Ditch #33 from
$300,000 to $190,000. The motion carried. Commissioner More
abstained. 96-88
The Commissioners reported on committees that they have
attended since the last Board Meeting.
Mr. Al Forsberg, Public Works Director and Mr. Joe Styndl,
Maintenance Superintendent, presented the following equipment
bids.
Pursuant to publication, bids were received, opened and
reviewed for the following Public Works equipment, with the

Mr. Rick Hanna, Land Use and Natural Resources
Administrator, presented the following Planning & Zoning items.
The first item heard was the review of the Odor Management
Plan for a swine nursery facility to Dennis and Eugene Ward,
Section 33, Decoria Township. No action required.
Commissioner More moved and Commissioner Bennett seconded
the motion to approve the preliminary and final plat of King
Addition Subdivision:
RESOLUTION
APPROVING FINAL PLAT
KING ADDITION SUBDIVISION
SECTION 10, LERAY TOWNSHIP
WHEREAS, the owner of the property included in the plat of
King Addition Subdivision has submitted a final plat for
approval; and,
WHEREAS, the final plat was reviewed by the Blue Earth
County Planning Commission on March 6th, 1996; and,
WHEREAS, the Blue Earth County Planning Commission
recommended approval of said final plat; and,
WHEREAS, the final plat meets the requirements of the Blue
Earth County Subdivision Ordinance.
NOW, THEREFORE BE IT RESOLVED, that the Blue Earth County
Board of Commissioners hereby approve the final plat of King
Addition Subdivision, and authorizes the Chair of the Board of
Commissioners and the County Administrator to sign said plat.
This resolution shall become effective immediately upon its
passage and without publication.

Commissioner Barnes moved and Commissioner Tacheny seconded
the motion to approve the following:
RESOLUTION GRANTING A
CONDITIONAL USE PERMIT
CONSTRUCTION OF A TOWN BORDER STATION
SECTION 15, RAPIDAN TOWNSHIP
WHEREAS, Northern Natural Gas Company, lessee, and Roger and
Cleo Matzke, owners of the following real estate in Blue Earth
County, Minnesota to wit;
Southwest Quarter of the Northwest Quarter of Section 15,
Rapidan Township, T107N, R27W.
have applied for a Conditional Use Permit to construct and
operate a town border station in a 50 foot by 50 foot easement in
an A-1, Prime Agriculture Zoning District; and
WHEREAS, the Planning Agency of the County has completed a
review of the application and made a report pertaining to said
request (CO 12-96), a copy of said report has been presented to
the County Board; and
WHEREAS, the Planning Commission of the County on the 6th
day of March, 1996, following proper notice, held a public
hearing regarding the request and, following the hearing, adopted
a recommendation that the request for a Conditional Use Permit be
granted; and
WHEREAS, the Blue Earth County Board of Commissioners finds
that:
1. The proposed use of the site will not be injurious to the
use and enjoyment of other property in the immediate area
for the purposes already permitted.
2. The proposed use will not impede or be incompatible with the
normal agricultural uses in
the area.
3. That adequate utilities, access roads, drainage and other
necessary facilities have been or
are being provided.
4. That adequate measures have been or will be taken to prevent
or control offensive odor, fumes, noise and vibration, so
that none of these will constitute a nuisance in such a
manner that no disturbance to neighboring properties will
result.
5. The applicant has demonstrated a need for the proposed use.
6. The proposed use will not interfere with existing natural
gas service.
7. The applicant has applied for all permits.
NOW THEREFORE BE IT RESOLVED, by the Blue Earth County Board
of Commissioners, that the request for a Conditional Use Permit
to construct and operate a town border station, in an A-1, Prime
Agriculture Zoning District, is granted with the following
conditions:
1. A copy of the easement agreement between the owner and the
applicant be submitted to the Blue Earth County
Environmental Services Department.
2. Any expansion or change in use from that stated on the
permit shall be cause for review
and the permit may be continued, modified, or terminated.
3. The final site plan and applicable setbacks be approved by
the Blue Earth County Board of Adjustment.
4. A Blue Earth County Construction Permit must be obtained
before building begins.
This resolution shall become effective immediately upon its
passage and without publication.

Commissioner More moved and Commissioner Bennett seconded
the motion to approve the following:
RESOLUTION
GRANTING A CONDITIONAL USE PERMIT FOR
THE EXPANSION OF A SALVAGE YARD
SECTION 31, LIME TOWNSHIP
WHEREAS, Gopher State Scrap & Metal, Inc., owner of the following
tract of real estate in Blue Earth County as described in
Attachment A has applied for a permit to expand an existing salvage
yard in an I-2 Heavy Industrial Zoning District; and,
WHEREAS, the Planning Agency of the County has completed a review
of the application and made a report pertaining to said request (CO
13-96), a copy of said report has been presented to the County
Board; and
WHEREAS, the Planning Commission of the County on the 6th day of
March, 1996, following proper notice held a public hearing
regarding the request and, following the hearing, adopted a
recommendation that the request be granted; and
WHEREAS, the Blue Earth County Board of Commissioners finds that:
1. That the proposed expansion of the salvage yard will not be
injurious to the use and enjoyment of other property in the
immediate vicinity for the uses already permitted.
2. That the predominate use in the area is industrial and the
expansion of the salvage yard will not impede the normal and
orderly development and improvement of the surrounding vacant
property.
3. That adequate utilities, access roads, drainage and other
necessary facilities have been or will be provided for the
expansion of the salvage yard.
4. That the site has sufficient off-road parking and loading
space to serve the expansion of the salvage yard.
5. That the expansion of the salvage yard can be operated so that
it does not constitute a nuisance or disturbance to
neighboring properties.
6. That soil conditions are adequate to accommodate the expansion
of the salvage yard..
7. That because the entrance is being moved from CSAH 5 to
Industrial Road any traffic congestion or traffic hazard which
currently exist should be reduced as a result of the expansion
of the salvage yard.
8. That the expansion of the salvage yard conforms with the
standards of the I-2, Heavy Industrial Zoning District.
9. That the proposed use is consistent with the County Land Use
Plan.
10. That the proposed conditional use does not include
residential development.
11. That the owner has demonstrated a need for the expansion of
the salvage yard.
12. That any significant environmental effects that may be
associated with the proposed project as described in the EAW
and this report can be avoided, minimized or mitigated as
conditions of the permits required for the proposed project.
NOW THEREFORE BE IT RESOLVED, by the Blue Earth County Board of
Commissioners, that the request for a conditional use permit for
the expansion of a salvage yard in an I-2, Heavy Industrial Zoning
District is granted with the following conditions:
1. That the existing facility and expansion area be screened as
shown on the site plan.
2. That the owner contact and coordinate with the DNR Wildlife
Game Specialist the establishment of winter feeders for
displaced wildlife.
3. That the owner amend the existing MPCA General Storm Water
Permit for Industrial Activity to include the salvage yard
expansion area.
4. That the owner address any other site concerns identified by
MPCA
5. That contaminated soil is not land farmed on the property.
6. That the owner obtain all state and federal permits before
placing any scrap or metal in the expansion area.
7. That only types A and D scrap be stored in the expansion area.
This resolution shall become effective immediately upon its passage
and without publication.

The following individuals made comments in regards to the next
item: Ms. Katie Wortel, Mankato Township, against the permit; Mr.
Bruce Maurer, applicant and Mr. Warren Enevoldson, Waseca, spoke in
favor of the permit. After discussion, Commissioner More moved and
Commissioner Bennett seconded the motion to approve the following
Conditional Use Permit:
RESOLUTION GRANTING A
CONDITIONAL USE PERMIT
TO BUILD THREE TOTAL CONFINEMENT SWINE BUILDINGS
SECTION 15, BEAUFORD TOWNSHIP
WHEREAS, Bruce and Eldo Maurer owner of the following real
estate in the County of Blue Earth, Minnesota, to wit:
Northwest Quarter, of Section 15 Beauford Township.
has applied for a Conditional Use Permit to build three total
confinement swine buildings in A-1, Prime Agriculture Zoning
District; and
WHEREAS, the Planning Agency of the County has completed a
review of the application and made a report pertaining to said
request (CO14-96), a copy of said report has been presented to
the County Board; and
WHEREAS, the Planning Commission of the County on the 6th
day of March, 1996, following proper notice, held a public
hearing regarding the request and, following the hearing, adopted
a recommendation that the request for a conditional use permit be
granted; and
WHEREAS, the Blue Earth County Board of Commissioners finds
that:
1. That with proper management of the proposed barns, manure
storage facilities and manure application, the Conditional
Use will not be injurious to the use of other property in
the immediate vicinity designated for agricultural uses.
2. That the predominate use in the area is agriculture and
that the Conditional Use will not impede the normal
and orderly development and improvement of surrounding
vacant property for agricultural uses in the area.
3. Adequate utilities, access roads, drainage and other
necessary facilities have been or will be provided. Access
will be from a (5 ton limit) Township Road.
4. Adequate measures will be taken to provide sufficient offroad parking and loading space to serve the proposed use.
5. Soil conditions are adequate to accommodate the Conditional
Use with the installation of a footing tile and utilization
of granular back fill to lower the water table.
6. Proper facilities will be provided which will eliminate any
traffic congestion or traffic hazard which may result from
the proposed use.
7. The feedlot is not greater than the feedlot standards
allowed in the A-1, Prime Agriculture Zoning District.
8. That the proposed use is consistent with the County Land Use
Plan.
9. That the proposed use does not include residential
development.
10. That the proposed use does not include industrial
development.
11. That the applicant has stated the need to expand his
agricultural operation
12. That with proper management of the proposed barns,
manure storage facilities and manure application, the
Conditional Use should not constitute a potential
pollution hazard.
NOW THEREFORE BE IT RESOLVED, by the Blue Earth County Board
of Commissioners, that the request for a Conditional Use Permit,
to build a total confinement swine facility in A-1 Prime
Agriculture Zoning District, is granted with the following
conditions:
1. That the confinement buildings conform with the site
plan attached to this report.
2. That a MPCA Certificate of Compliance is issued before a
construction permit is issued on the proposed request.
3. That a Blue Earth County Feedlot Permit and a Blue Earth
County Construction Permit is issued before construction of
the total confinement barns begin.
4. That a perimeter footing drain tile shall be located at or
below the bottom of the pit footings. The footing tile shall
include one inspection pipe for each concrete pit. Native
material must be excavated and walls back filled with
granular material (pit run gravel or equivalent).
5. That the land application of manure be on the land described
and complies with standards set forth in Attachment A-1,
Manure Management Summary, and A-4, Manure Application
Setbacks.
6. That the applicant obtain a Department of Natural Resources,
Water Appropriations Permit .
7. That the disposal of dead animals shall be consistent with
the Minnesota Board of Animal Health regulations. Applicant
shall provide an enclosed location for the pick up of dead
animals.
8. That adequate measures will be taken to minimize or control
offensive odor, fumes, dust, noise, or vibrations so that
none of these will constitute a nuisance.
This resolution shall become effective immediately upon its
passage and without publication.

the motion to approve the following:
RESOLUTION GRANTING A
CONDITIONAL USE PERMIT
TO RESTOCK AN EMPTY FEEDLOT
SECTION 6, JUDSON TOWNSHIP
WHEREAS, Martin Imlay owner of the following real estate in
the County of Blue Earth, Minnesota, to wit:
Commencing at the Northwest corner of the Northeast
Quarter of the Northeast Quarter of Section six,
Township 108, Range 28 thence running east 100 feet on
the section line; thence south at right angles 550
feet; thence west 670 feet; thence north 550 feet to
the section line; thence east 570 feet to the place of
beginning. Containing 8.44 acres, more or less.
has applied for a Conditional Use Permit in A-1, Prime
Agriculture Zoning District; and
WHEREAS, the Planning Agency of the County has completed a
review of the application and made a report pertaining to said
request (CO15-96 ), a copy of said report has been presented to
the County Board; and
WHEREAS, the Planning Commission of the County on the 6th
day of March, 1996, following proper notice, held a public
hearing regarding the request and, following the hearing, adopted
a recommendation that the request for a conditional use permit be
granted; and
WHEREAS, the Blue Earth County Board of Commissioners finds
that:
1. That with proper management of the existing barn, manure
storage facilities and manure application, the Conditional
Use should not be injurious to the use and enjoyment of
other property in the immediate vicinity designated for
agricultural uses.
2. That the predominate use in the area is agriculture and that
the Conditional Use should not impede the normal and orderly
development and improvement of surrounding vacant property
for the agricultural uses in the area.
3. Adequate utilities, access roads, drainage and other
necessary facilities have been or will be provided. Access
will be from State Highway 68 (10 ton road).
4. Adequate measures will be taken to provide sufficient off-
road parking and loading space to serve the proposed use.
5. Proper facilities will be provided which will eliminate any
traffic congestion or traffic hazard which may result from
the proposed use.
6. The feedlot is not greater than the feedlot standards
allowed in the A-1, Prime Agriculture Zoning District.
7. The proposed use is consistent with the County Land Use
Plan.
8. That the proposed use does not include residential
development.
9. That the applicant has stated that he has an economic need
to restock his agricultural operation.
10. That with proper management of the existing barn,
manure storage facility and manure application, the
Conditional Use should not constitute a potential
pollution hazard.
NOW THEREFORE BE IT RESOLVED, by the Blue Earth County
Board of Commissioners, that the request for a Conditional Use
Permit, to build a total confinement swine facility in A-1 Prime
Agriculture Zoning District, is granted with the following
conditions:
1. That the restocking of cattle conforms with the site plan
attached to this report.
2. That an MPCA Feedlot Permit is issued before restocking
begins on the proposed request.
3. That a Blue Earth County Feedlot Permit is issued before
restocking begins.
4. The land application of manure be on the land described and
complies with standards set forth in Attachment A-1, Manure
Management Summary and Attachment A-4, Manure Application
Setbacks.
5. The disposal of dead animals shall be consistent with the
Minnesota Board of Animal Health regulations. Applicant
shall provide an enclosed location for the pick up of dead
animals.
6. Adequate measures will be taken to minimize or control
offensive odor, fumes, dust, noise, or vibrations so that
none of these will constitute a nuisance.

and the Northwest Quarter of the Southeast Quarter of
the Northwest Quarter all in Section 4-106-27, Blue
Earth County, Minnesota, except the North 550 feet of
the Northwest Quarter of the Northwest Quarter of the

granted; and

before building begins.
4. That a Blue Earth County Feedlot Permit is issued
before animals are placed in the barn.
5. That a perimeter footing drain tile shall be located at or

Mr. Jerry Haley, Community Corrections Chief; Mr. Mike
McGuire, Juvenile Corrections Supervisor and Mr. David Compton,
Executive Director of the Leo A. Hoffman Center, presented the
following item for the Boards consideration.
Commissioner Barnes moved and Commissioner More seconded the
motion to approve a one time appropriation of $10,000 to the Leo
A. Hoffman Center for purpose of long-term treatment for
juveniles. The agreement is made with the understanding that the
money will be "repaid" through reduced rates for Blue Earth
County placements. The loan will be approved on the condition
that details can be worked out between Nicollet, Brown and Blue
Earth Counties. The motion carried. 96-105
Commissioner Barnes moved and Commissioner Bennett seconded
the motion to support a Restitution Grant Application submitted
by Blue Earth County Community Corrections to the Minnesota
Department of Corrections for $10,000 from July 1, 1996 to June
30, 1997. This grant will allow juvenile delinquents to earn
money to pay restitution to their victims. The money would be
earned by juveniles who have been unable to find any other type
of employment, and would go directly to the Court Administrator's
office to be distributed to the victims of these juveniles. The

Mr. Dennis McCoy, Deputy County Administrator, presented the
following Human Services items.
Commissioner Tacheny moved and Commissioner More seconded
the motion to approve the following Human Service items:
Energy Assistance Program Grant modification number 1
for $57,657 which brings the County's total to $365,105
for the 1995-96 EAP year.
Agreement with the State Department of Human Services
to receive a $20,000 grant to plan services for
severely emotionally disturbed and dangerous
adolescents. This grant application is being developed
in conjunction with Nicollet County.
The legislature has directed a one and one-half percent increase
to the following contracts or host county agreements between Blue
Earth County and the listed vendor, for the period April 1, 1996
through December 31, 1997:
Habilitiative Services Inc. to provide waivered
services; Habilitiative Services Inc. to provide semi-
independent living services; Southern Minnesota
Independent Living Enterprises and Services Inc.
(SMILES) to provide in-home family support and

Agreement with CCM Project Group to purchase a case
management software package known as CCM. It is seen
as an excellent productivity tool for social workers in
child welfare, mental health, and developmental
disabilities.
Resolution seeking Board of Government Innovation and
Cooperation's permission to modify the existing grant
contract to allow us to adjust the line item budget by
up to 10 percent of the aggregate grant amount. This
is necessary because less has been spent than
anticipated on consultants through the life of this
grant. The grant is the primary financing mechanism
behind the Southern Mental health Initiative.

RESOLUTION PROCLAIMING
APRIL 1-7, 1996, PUBLIC HEALTH WEEK
IN BLUE EARTH COUNTY
WHEREAS, the Blue Earth County Board of
Commissioners acts as the County Board of
Health and has responsibility to prevent
disease and disability and to promote and
protect the health of county residents; and
WHEREAS, a major goal is promoting health and
quality of life of all citizens of Blue Earth
County through prevention and early
intervention strategies and activities; and
WHEREAS, it is recognized that public health
programs and services benefit everyone,
regardless of race, ethnicity, and social
economic characteristics, and are essential
ingredients in a strong and proactive local,
state, and national health system; and
WHEREAS, public health workers in Blue Earth
County and in communities and states across
the nation play crucial roles in ensuring
that all citizens have the opportunity to be
healthy people living in healthy communities
in a healthy world; and
WHEREAS, the President of the United States
and the Governor of Minnesota proclaim the
first full week in April as National and
State Public Health Week and called upon
local Public Health Boards and agencies to
join with private and community organizations
and citizens to celebrate with activities to
promote health and well-being and to
acknowledge the benefits of public health to
our citizens.
NOW, THEREFORE, BE IT RESOLVED that the Blue
Earth County Board of Commissioners hereby
proclaims April 1-7, 1996, as Public Health
Week in Blue Earth County and urges that
private health and community organizations
and citizens join together in promoting and
protecting the health of individuals,
families, and communities.
A three month extension of the detoxification host
county agreement with Immanuel St. Joseph's Hospital at
the same rate as the previous contract.
A lease agreement with Professional Building Partners
for the Second Step Clubhouse space. This agreement
was previously approved by the Board at the January 23,
1996 meeting. A compromise was reached and the
agreement is back after negotiation with the building
owners.

the motion to approve the following Personnel items:
Resignation of Laurie Jacobs, Child Support Officer
(C41), effective March 7, 1996. (Human Services)
Authorization to initiate recruitment for a Child
Support Officer (C41). (Human Services)
Employment of Bradley Peyton, as an Assistant County
Attorney (C52), with a starting salary of $17.47 per
hour effective April 1, 1996. (County Attorney)
Employment of Sandy Braun, as a Clerical Specialist I
(B21), with a starting salary of $9.17 per hour
effective April 8, 1996. (Environmental Services).

the motion to table the Region 9 Economic Plan. The Board would
like a representative from Region Nine to come before the Board

the motion to approve the following proclamation:
WHEREAS, twenty-six years ago, more than twenty million
Americans joined together on Earth Day in a
demonstration of concern for the environment, and their
collective action resulted in the passage of sweeping
new laws to protect our air, water, and land, and
WHEREAS, Earth Day has gained the support of over 200
million people in 141 counties, and
WHEREAS, life on our planet and the quest for meaning
and purpose in life can be threatened by mankind's
failure to take charge and take care of the Earth, and
WHEREAS, Earth Day activities and events will educate
all citizens on the importance of acting in an
environmentally sensitive fashion by reducing, reusing,
recycling, conserving energy and water, using efficient
transportation, and adopting more ecologically sound
lifestyles.
NOW, THEREFORE, BE IT RESOLVED, by the Blue Earth
County Board of Commissioners that a day of celebration
be proclaimed that will deepen worldwide commitment for
the Earth's renewal, and the Board urges the residents
of Blue Earth County to observe this day with

Commissioner Bennett moved and Commissioner Barnes seconded
the motion to approve the following contracts with Northern
States Power Company (NSP): Construction observation of the
third cell of Wilmarth Landfill and an agreement with the County
to collect fluorescent and HID bulbs and NSP to pay disposal
costs of 74% of all residential bulbs. NSP will also pay for the
disposal of up to ten bulbs from businesses that are NSP
customers. The motion carried. 96-117
Commissioner More moved and Commissioner Bennett seconded
the motion to approve the following resolution:
RESOLUTION
SUPPORTING A DITCH CLEANING EXEMPTION
FOR THE WETLAND CONSERVATION ACT
WHEREAS, rights, duties and obligations relating to
public drainage systems are, and have been controlled
by Minnesota Statutes Chapter 103E, and prior drainage
laws; and
WHEREAS, legal public drainage gives landowners
assessed for benefits rights to drainage, and some
landowners have paid for that right for over 80 years;
and
WHEREAS, drainage is important for the economy,
farming, forest areas, for the state and county; and
WHEREAS, drainage is important to the public safety,
and efficient operation of road systems; and
WHEREAS, without repair and maintenance drainage is
impaired and property value diminished;
THEREFORE, BE IT RESOLVED that the Wetlands
Conservation Act be amended to read "A replacement plan
is not required for repair and maintenance activities
to a public drainage system affecting a wetland located
in an area previously assessed benefits". And where
wetlands and public waters are desired and needed to be
protected, protection can be implemented with dikes and
berms.
