BLUE EARTH COUNTY, MINNESOTA
February 21, 1995
The County Board of Commissioners met in the Commissioners'
Room at 9:00 a.m. Present were Chairperson Leon Tacheny,
Commissioner Colleen Landkamer, Commissioner Lin Barnes,
Commissioner Al Bennett, Commissioner Alvis More, County Attorney
Ross Arneson and County Administrator David Twa.
Commissioner Barnes moved and Commissioner Bennett seconded
the motion to approve the amended Agenda. The motion carried.

Mr. Kent Thiesse, Extension Agent, presented the following
item for the Boards consideration.
Commissioner Bennett moved and Commissioner More seconded
the motion to approve the following proclamation.
SOUTH CENTRAL AGRICULTURE INDUSTRY DAY
WHEREAS, There is no single industry that has a greater influence
on society than Agriculture.
WHEREAS, the impact of food and fiber is often the difference
between economic, as well as human, feast or famine.
WHEREAS, Minnesota's Food and Agriculture Industry accounts for
22% of the state's exports and accounts for one of every three
jobs in the state.
WHEREAS, South Central Minnesota is a recognized leader in corn,
soybean, and swine production in Minnesota and has significant
amount of dairy, beef, poultry, and canning crop productions.
WHEREAS, Numerous industries and retail businesses in South
Central Minnesota are directly linked to the Food and Agriculture
Industry for their job creation and economic viability.
The Blue Earth County Board of Commissioners designate March 7,
1995, as South Central "Agriculture Industry Day" in support and
recognition of the region's vast and far-reaching Food and
Agriculture Industry. The motion carried. 95-59
The Commissioners gave reports on the committees that they
serve on.
Commissioner Barnes moved and Commissioner Bennett seconded
the motion to approve the February 7, 1995 Board minutes. The
motion carried. 95-60
Commissioner Landkamer moved and Commissioner Barnes
seconded the motion to approve the following Bills:
Bills for Week of February 13-17, 1995

Commissioner More moved and Commissioner Bennett seconded
the motion to approve the following Personnel items:
Authorization to initiate recruitment for a Custody
Officer (B23). (Sheriffs)
Employment of Joy Meyer, as a Financial Worker (Public
Assistance) (B23), with a starting salary of $10.32 per
hour effective February 22, 1995. (Human Services)
Employment of Steve Byrne, as a Youth Development
Coordinator (C41), with a starting salary of $13.44 per
hour effective March 1, 1995. (Human Services)
Reclassification of Jody Bloemke, from an
Administrative Specialist (B22) to Administrative
Assistant (B31), with a salary adjustment from $11.21
to $12.30 effective March 6, 1995.
Reclassification of Patti Ziemke, from an
Administrative Specialist (B22) to Administrative
Assistant (B31), with a salary adjustment from $11.21
to $12.30 effective March 6, 1995. (Human Services)

Commissioner Barnes moved and Commissioner Landkamer
seconded the motion to approve the following:
WHEREAS, the 1994 legislature appropriated $206,186 as
Blue Earth County's share of secure juvenile detention
and treatment construction funds; and
WHEREAS, the legislation stipulates that Blue Earth
County allocate these funds as a part of a unified,
cooperative detention and treatment plan from the Fifth
Judicial District; and
WHEREAS, the long-term interest of Blue Earth County
will be served by active participation in the Fifth
District's construction project,
NOW, THEREFORE BE IT RESOLVED, that the Blue Earth
County Board of Commissioners hereby elects to
participate in the secure juvenile detention and
treatment application to be submitted by the Fifth
Judicial District; and
NOW, THEREFORE BE IT FURTHER RESOLVED, that the Board
of Commissioners urges the Commissioner of Corrections
to approve the Fifth District application.

Commissioner Barnes moved and Commissioner Bennett seconded
the motion to appoint Mr. Mike McGuire, Community Corrections, to
the Blue Earth, Brown, Nicollet County's Juvenile Detention Joint
Powers Board. The motion carried. 95-64
Commissioner Bennett moved and Commissioner More seconded
the motion to approve an abatement to Don & Arlene Appel, Route
1, Box 88, Mapleton, MN R51-23-11-100-001 K-223626. The motion
carried. 95-65

the motion to approve the Blue Earth County Housing Rehab Report.

Mr. Jerry Floren, Land Use and Natural Resources Feedlot
Specialist, presented the following Planning & Zoning item for
the Boards consideration.
Commissioner Bennett moved and Commissioner More seconded
the motion to approve the following Conditional Use Permit after
speaking with Mr. Mike Matzke, petitioner:
RESOLUTION GRANTING A
CONDITIONAL USE PERMIT
EXPANSION OF A TOTAL CONFINEMENT HOG OPERATION
SECTION 20, RAPIDAN TOWNSHIP
WHEREAS, Matzke Farms, owner of the following real estate in
the County of Blue Earth, Minnesota, to wit:
Northwest Quarter of the Northwest Quarter and the North
Half of the Southwest Quarter of the Northwest Quarter of
Section 20, Rapidan Township, T107N-R27W,
has applied for a Conditional Use Permit to expand a total
confinement hog operation in an A-1 Zoning District, and
WHEREAS, the Planning Agency of the County has completed a
review of the application and made a report pertaining to said
request (CO 04-95), a copy of said report has been presented to
the County Board; and
WHEREAS, the Planning Commission of the County on the 1st
day of February, 1995, following proper notice, held a public
hearing regarding the request and, following the hearing, adopted
a recommendation that the request for a conditional user permit
be granted; and
WHEREAS, the Blue Earth County Board of Commissioners finds
that:
1. The proposed use conforms with the Zoning Ordinance.
2. The proposed use conforms with the Land Use Plan.
3. The proposed use has the required manure storage.
4. The proposed use has the spreadable acres required for
manure application.
5. The applicant is in the process of applying for all
required permits.
NOW THEREFORE BE IT RESOLVED, by the Blue Earth County
Board of Commissioners, that the request for a Conditional Use
Permit to expand a total confinement hog operation, in an A-1
Zoning District, is granted with the following conditions:
1. The confinement building conforms with the site plan
attached to the CO 4-95 report.
2. All required permits are obtained as shown in
Attachment A-4, Structural Setbacks and Required
Permits.
3. A Blue Earth County Certificate of Compliance is issued
before a construction permit is issued on the
confinement barn and concrete pit.
4. A Blue Earth County construction permit is issued
before building begins.
5. A minimum of one footing tile inspection pipe is
included in the building design and construction of
each concrete pit. MPCA requires that drain tile
should be located at least one (1) foot deeper than the
pit bottom.
6. The proposed barn has the required setbacks as shown in
Attachment A-4, Structural Setback Distances and
Required Permits.
7. The land application of manure shall be on the land
described in the Preliminary Manure Management Plan and
complies with standards set forth in Attachments A-1,
Manure Management Summary, and A-5, Manure Application
Setbacks.
8. The applicants comply with the Blue Earth County
Livestock Manure Management Ordinance, effective
January 4, 1995.
9. The applicants obtain a Department of Natural
Resources, "Water Appropriations Permit."
This resolution shall become effective immediately upon its
passage and without publication.

Mr. Jerry Books, Finance Director, presented a financial
update to the Board. Commissioner Landkamer moved and
Commissioner Barnes seconded the motion to approve the revised
Blue Earth County's Investment Policy. The motion carried. 95-68
Commissioner Landkamer moved and Commissioner More seconded
the motion to approve the following Human Service contracts:
Waivered Services Contract with Prairie River Personal
Care Associates, Mankato, MN, from February 21, 1995
through December 31, 1995.
Waivered Services Contract with Gertrude O'Connor,
Mapleton, MN, from March 1, 1995 through December 31,
1995.

Commissioner More moved and Commissioner Bennett seconded
the motion to send a letter of support of the Lura Lake
Association and their efforts to raise funds for their Handicap
Fishing Dock Project. The motion carried. 95-70
Commissioner Bennett moved and Commissioner Barnes seconded
the motion to approve an Application for County On-Sale
Intoxicating Liquor License to Cat N' Fiddle, Route 4, Box 30 New
Ulm, MN. The motion carried. 95-71
Mr. Al Forsberg, Public Works Director, presented the
following items for the Boards consideration.
Commissioner Landkamer moved and Commissioner More seconded
the motion to approve the following TH 66 Red Jacket Bridge
Detour Agreement with MnDOT:
COUNTY OF BLUE EARTH
RESOLUTION
BE IT RESOLVED that the County of Blue Earth enter into
Agreement No. 73015 with the State of Minnesota,
Department of Transportation for the following
purposes, to-wit:
To provide for payment by the State to the County for
the use of County State Aid Highways No. 35 and No. 16
as a Trunk Highway No. 66 from Engineer Station 499+09
to Engineer Station 527+47 under State Project No.
0715-27 (T.H. 66=256).
BE IT FURTHER RESOLVED that the proper County officers
are hereby authorized and directed to execute such
agreement.

Commissioner Barnes moved and Commissioner More seconded the
motion to approve the following Cooperative Agreement with MnDOT:
AUTHORIZING RESOLUTION FOR
AGREEMENT NUMBER 73210-P
AGREEMENT BETWEEN
MINNESOTA DEPARTMENT OF TRANSPORTATION
DISTRICT 7 CONSTRUCTION AND MAINTENANCE AREA 7A
AND
THE BLUE EARTH COUNTY DEPARTMENT OF HIGHWAYS
This agreement is made by and between the Minnesota
Department of Transportation hereinafter called Mn/DOT
and Blue Earth County, hereinafter called the County.
WHEREAS, Mn/DOT and the County each have responsibility
for constructing and maintaining roadways under their
authority, and
WHEREAS, the construction of these roadways requires
inspectors employed by Mn/DOT or the County to ensure
that construction contractual terms are complied with,
and
WHEREAS, the maintenance of these roadways requires
specialized equipment and knowledgeable equipment
operators, and
WHEREAS, under Minnesota Statutes Section 471.59 Subd.
1, (1994), two governmental units may enter into an
agreement to cooperatively exercise any power common to
the contracting parties of it's powers on behalf of the
other governmental unit, and
WHEREAS, both Mn/DOT and the County have limited
budgets which precludes the purchase of all necessary
equipment and the hiring of additional employees, and
WHEREAS, it would benefit both Mn/DOT and the County if
labor and equipment could be loaned between the
agencies.
NOW THEREFORE, Alan Forsberg, Blue Earth County Public
Works Director, is authorized to enter into an
agreement with Mn/DOT providing for the loan of labor
and equipment and is the authorized representative for
the administration of this agreement.

Commissioner Bennett moved and Commissioner More seconded
the motion to approve the following MnDOT Agreement for Railroad
Crossing signals on CSAH 20 at Lake Crystal:
BE IT RESOLVED, that the County of Blue Earth enter
into an agreement with the Chicago & North Western
Railway Company and the Commissioner of Transportation
for the installation and maintenance of railroad
crossing signals at the intersection of Robinson Street
(CSAH 20) with the tracks of the Chicago & North
Western Railway Company in Lake Crystal, Minnesota, and
appointing the Commissioner of Transportation agent for
the County to supervise said project and administer
available Federal Funds in accordance with Minnesota
Statute, Section 161.36. The County's share of the
cost shall be 20 percent of the total signal cost.
BE IT FURTHER RESOLVED, that the Chairperson and Clerk
of the Board be and they are hereby authorized to
execute said agreement for and on behalf of the County.
