OFFICIAL PROCEEDINGS OF THE BOARD OF COMMISSIONERS
BLUE EARTH COUNTY, MINNESOTA

February 20, 1996





The County Board of Commissioners met in the Commissioners' 

Room at 9:00 a.m. Present were Chairperson Colleen Landkamer, 

Commissioner Leon Tacheny, Commissioner Lin Barnes, Commissioner 

Al Bennett, Commissioner Alvis More, County Attorney Ross Arneson 

and County Administrator David Twa.



Commissioner More moved and Commissioner Tacheny seconded 

the motion to approve the amended Agenda. The motion carried.

The Commissioners reported on committees that they have 

attended since the last Board Meeting.



Mr. Kent Thiesse, Extension Educator, presented the 

following items for the Boards consideration. 



Commissioner Bennett moved and Commissioner More seconded 

the motion to approve the following proclamation: 



SOUTH CENTRAL AGRICULTURE INDUSTRY DAY

PROCLAMATION



WHEREAS There is no single industry that has a greater 

influence on society than Agriculture.



WHEREAS The impact of food and fiber is often the 

difference between economic, as well as human, feast or 

famine.



WHEREAS Minnesota's Food and Agriculture Industry 

accounts for 22% of the state's exports and accounts 

for one of every three jobs in the state. 



WHEREAS South Central Minnesota is a recognized leader 

in corn, soybean, and swine production in Minnesota and 

has significant amount of dairy, beef, poultry, and 

canning crop production.



WHEREAS Numerous industries and retail businesses in 

South Central Minnesota are directly linked to the Food 

and Agriculture Industry for their job creation and 

economic viability.



The Blue Earth County Board of Commissioners designate 

March 6, 1996 as South Central "AGRICULTURE INDUSTRY 

DAY" in support and recognition of the region's vast 

and far-reaching Food and Agriculture Industry.

Commissioner Barnes moved and Commissioner More seconded the 

motion to approve the following Proclamation: 



RIVER FRIENDLY FARMERS

BLUE EARTH COUNTY

PROCLAMATION



WHEREAS Blue Earth County is participating with thirty- 

six other counties in the Minnesota River Basin Joint 

Powers Board.



WHEREAS Blue Earth County supports voluntary efforts to 

implement best management agricultural practices to 

enhance surface water quality in the Minnesota River 

Basin.



WHEREAS Blue Earth County supports the concept and 

criteria established for the "River Friendly Farmer" 

program.



WHEREAS Blue Earth County farm families were provided 

an opportunity to apply for the "River Friendly Farmer" 

program and all applications were reviewed by a special 

County Environmental Education Committee to verify that 

listed criteria were achieved.



The Blue Earth County Board of Commissioners supports 

the designation of the following Blue Earth County farm 

families as "River Friendly Farmers": Robert Annis, 

Mapleton; Ervin Arndt, Vernon Center; Ivan Borchardt, 

Good Thunder; Karl and Jacqueline Duncanson, Mapleton; 

Patrick and Kristin Duncanson, Mapleton; Heinze Farms, 

Inc., Madison Lake; Harold Loeffler, Mankato; Dean 

Neumann, Lake Crystal; Don and Barb Overlie, Lake 

Crystal; Ray Phelps, Mapleton; John and Connie 

Rollings, Vernon Center.

Mr. Al Forsberg, Public Works Director, updated the Board on 

Public Works projects in progress.



Commissioner Tacheny moved and Commissioner Bennett seconded 

the motion to approve the amended February 6, 1996 Board Minutes.

Commissioner Barnes moved and Commissioner Bennett seconded 

the motion to approve the following Bills: 



Bills for Week of February 12-16, 1996



Grand Total $7,231,780.65



Bills for Week of February 19-23, 1996



Grand Total $2,517,061.92

Commissioner More made a motion to approve the Personnel 

Agenda. The motion failed for lack of a second. The Board 

decided to get clarification from Mr. Dennis McCoy, Personnel 

Director.



Commissioner Tacheny moved and Commissioner Bennett seconded 

the motion to approve the following:



RESOLUTION

AUTHORIZING EXECUTION OF

MEMORANDUM OF UNDERSTANDING



BE IT RESOLVED THAT Blue Earth County enter into a 

Memorandum of Understanding with the Department of the 

Treasury, Internal Revenue Service and the State of 

Minnesota, Office of the Secretary of State for the 

electronic filing of federal tax liens, to be conducted 

for a specified period of time. William E. James, 

Assistant Land Records Director is hereby authorized to 

sign and execute the Memorandum of Understanding on 

behalf of the County.

Mr. David Twa, County Administrator, presented the January 

1996 Financial Statement as an informational item. 



Commissioner Tacheny moved and Commissioner More seconded 

the motion to approve a Minnesota Lawful Gambling Application for 

Authorization for an Exemption from Lawful Gambling License to 

Immanuel-St. Joseph's Hospital, Mankato, MN for the Hospice 

Program to be held April 13, 1996 at the Mankato Golf Club, 

subject to Mankato Township's approval. The motion carried. 96-

Mr. Dennis McCoy, Deputy County Administrator, presented the 

following items for the Boards consideration. 



After discussion, Commissioner Barnes made a motion to 

approve the Personnel Agenda items excluding item number D, 

employment of Clerical Specialist I in the County Attorney's 

Department. The motion failed for lack of a second. 



Commissioner Tacheny moved and Commissioner More seconded 

the motion to appoint Ms. Sharon Unander-Miller, Mankato, as the 

Human Services Advisory Board Chairperson for 1996. The motion 

carried. 96-63



Mr. Donald Glamm, Interim Chairperson, updated the Board on 

the February 8, 1996 Human Service Advisory Committee meeting. 



Commissioner Barnes moved to provide legal representation, 

if necessary, to Sheriff Brad Peterson in the action of Ross 

Arneson vs the City of Mankato. The motion failed for lack of a 

second, with the understanding that the County Attorney would 

bring the matter back to the County Board for further 

consideration, before the County Attorney took any further action 

against the Sheriff.



The meeting recessed at 12:15 p.m.



The meeting reconvened at 2:00 p.m.



Pursuant to publication, a public hearing was continued from 

February 6, 1996 to hear a petition of State of Minnesota, by 

James N. Denn, its Commissioner of Transportation for the right 

to make minor alterations or changes in Joint County Ditch No. 9 

in Blue Earth County. The public hearing was opened for public 

comments by Chairperson Landkamer at 2:00 p.m., February 6, 1996. 

Mr. Rick O'Rourke, and Mr. Tom Henzel, MnDot, gave an update of 

the project. Mr. Tom Dauk, Madison Lake, asked questions. 

Commissioner More moved and Commissioner Bennett seconded the 

motion to approve the petition and the request from Landowners on 

Blue Earth County Ditch No. 9 that the elevation on the 72" 

outlet on County Ditch No. 9 be changed according to State 

figures of elevation 992.5 to elevation 987.5 as shown. This 

change is needed in order to make the tile systems of the 

landowners to work correctly. The motion carried. Chairperson 

Landkamer officially closed the public hearing at 2:12 p.m., 

February 20, 1996. A transcript of this hearing is on file at 

the County Administrator's Office, Courthouse, Mankato, MN. 96-

Commissioner Bennett moved and Commissioner More seconded 

the motion to appoint Mr. Tom Roberts, New Ulm, as a ditch 

viewer. The motion carried. 96-65



Commissioner Barnes moved and Commissioner More seconded the 

motion to approve the Personnel Agenda except for item D which 

would be voted on separately:



Promotion of Jamie Frederick, from Clerical Specialist 

I (B21) to Clerical Specialist II (B22) with a salary 

adjustment from $10.02 to $10.27 per hour effective 

February 26, 1996. (Community Corrections) 



Authorization to initiate recruitment for a Clerical 

Specialist II (B22) with a salary adjustment from 

$10.02 to $10.27 per hour effective February 26, 1996. 

(Community Corrections)



Authorization to initiate recruitment for a Clerical 

Specialist I (B21). (Environmental Services) 



Authorization to initiate recruitment for a Micro 

Computer Support Technician (B31). (Data Processing) 



Transfer of Jane Pike, Crisis Intervention Family 

Therapist (C42), from the employment of Mankato 

Rehabilitation Center, Inc. to Blue Earth County, 

effective February 1, 1996 at $15.06 per hour. (Human 

Services)



Transfer of Anne Polusny, Case Coordinator (C42), from the 

employment of Mankato Rehabilitation Center, Inc. to Blue 

Earth County, effective February 1, 1996 at $14.20 per hour. 

(Human Services)



Promotion of Charles Claude, from Light Equipment Operator, 

(B21) to Medium Equipment Operator (B22) with a salary 

adjustment from $9.73 to $10.27 per hour effective February 

12, 1996. (Highway)

Commissioner More moved and Commissioner Tacheny seconded 

the motion to approve the following Personnel item: 



Employment of Lisa Seifert, as a Clerical Specialist I 

(B21) with a starting salary of $9.17 per hour 

effective February 20, 1996. (County Attorney) 



The motion carried. Commissioner Barnes voted nay. 96-66 



Commissioner More moved and Commissioner Barnes seconded the 

motion to adjourn at 3:10 p.m. The motion carried. 96-67
