January 2, 1996
The County Board of Commissioners met in the Commissioners'
Room at 9:00 a.m. Present were Chairperson Leon Tacheny,
Commissioner Colleen Landkamer, Commissioner Lin Barnes,
Commissioner Al Bennett, Commissioner Alvis More, County Attorney
Ross Arneson and County Administrator David Twa.
Commissioner Bennett moved and Commissioner Landkamer
seconded the motion to approve the amended Agenda. The motion
carried. 96-1
Commissioner Bennett moved and Commissioner More seconded
the motion to appoint Commissioner Landkamer as the 1996
Chairperson. The motion carried. 96-2
Commissioner Tacheny moved and Commissioner Bennett seconded
the motion to appoint Commissioner Barnes as the 1996 Vice-
Chairperson. The motion carried. 96-3

An informal ditch hearing was held on County Ditch #43. Mr.
Chad Surprenant, I & S Engineers, presented options available.
Commissioner Barnes moved and Commissioner More seconded the
motion to approve the following resolution:
SEMREX RESOLUTION
WHEREAS, in its six years of existence the Southeast
Minnesota Recycler's Exchange (SEMREX) has implemented
innovative activities to improve the infrastructure of
recycling for Minnesota's counties; and
WHEREAS, it is agreed that strong recycling markets and
the development of new businesses that use recovered
materials are key to the success of and viability of
recycling, and
WHEREAS, SEMREX has adopted a three-pronged approach to
recycling and waste reduction, including effective
cooperative marketing, market development and
material's exchange programs; and
WHEREAS, SEMREX's successes were recently recognized by
the Minnesota Office of Environmental Assistance with
receipt of the first OEA Director's Award, presented to
SEMREX for Public/Private Cooperation in a Regional
Setting.
NOW, THEREFORE, BE IT RESOLVED that the Blue Earth
County Board of Commissioners support SEMREX in its
efforts to assist the region's counties and businesses
in waste reduction, reuse and recycling.

Mr. Jerry Kallheim, Land Recorders Director, presented the
following item for the Boards consideration.
After discussion, Commissioner Bennett moved and
Commissioner More seconded the motion to proceed with the
Redetermination of Benefits on County Ditch #12 from a petition
by R. Paul Wilmes and Phyllis Wilmes. Three viewers will be
appointed at a later date. The motion carried. 96-12
Commissioner Tacheny moved and Commissioner Barnes seconded
the motion to set a $50.00 fee for Completion of Certificate as
to Taxes and Taxable Property and approve the following
resolution:
SETTING ASIDE 20 PERCENT OF THE RECEIPTS
FROM THE SALE OR RENTAL OF ANY PARCEL
OF TAX FORFEITED LAND IN 1996
WHEREAS, Minnesota Statutes 282.08 provides that the
County Board may annually by resolution set aside no
more than 20 percent of the net proceeds from the sale
or rental of any parcel of tax forfeited land and use
these proceeds for the acquisition and maintenance of
county parks or recreational areas, and
WHEREAS, there are significant costs to operate the
County's Park system, and
WHEREAS, in 1996 the County will incur significant
costs for capital improvements necessary to maintain
the County Park System,
NOW THEREFORE, IT IS HEREBY RESOLVED, that the County
Board hereby sets aside 20 percent of the net receipts
from the sale or rental of any parcel of tax forfeited
land to be used for the acquisition and maintenance of
county parks or recreational areas.

Commissioner Bennett moved and Commissioner Tacheny seconded
the motion to approve a Renewal of Liquor License to Mankato Golf
Club Inc., Mankato, MN. The motion carried. 96-14
Pursuant to publication, a public hearing was held to
consider submission to the Minnesota Department of Trade and
Economic Development an Economic Recovery Grant Program. The
public hearing was opened for public comments by Chairperson
Landkamer at 10:30 a.m., January 2, 1996. Mr. Roger Guenette,
Advanced Resource, updated the Board on the project. No public
comments were made. Chairperson Landkamer officially closed the
public hearing at 10:40 a.m.
Commissioner Bennett moved and Commissioner Tacheny seconded
the motion to approve the following Resolutions:
BE IT RESOLVED that Blue Earth County act as the legal
sponsor for project(s) contained in the Business and
Community Development Application to be submitted on
January 2, 1996 and that Board Chairperson is hereby
authorized to apply to the Department of Trade and
Economic Development for funding of this project on
behalf of Blue Earth County.
BE IT FURTHER RESOLVED that Blue Earth County has the
legal authority to apply for financial assistance, and
the institutional, managerial, and financial capability
to ensure adequate construction, operation, maintenance
and replacement of the proposed project for its design
life.
BE IT FURTHER RESOLVED that Blue Earth County has not
incurred any costs, has not entered into any written
agreements to purchase property.
BE IT FURTHER RESOLVED that Blue Earth County has not
violated any Federal, State, or local laws pertaining
to fraud, bribery, graft, kickbacks, collusion,
conflict of interest or other unlawful or corrupt
practice.
BE IT FURTHER RESOLVED that upon approval of its
application by the State, Blue Earth County may enter
into an agreement with the State of Minnesota for the
above-referenced project(s), and that Blue Earth County
certifies that it will comply with all applicable laws
and regulations as stated in all contract agreements
and described on the Compliances Section (FP-20) of the
Business and Community Development Application.
AS APPLICABLE, BE IT FURTHER RESOLVED that Blue Earth
County has obtained credit reports and credit
information from Crysteel Manufacturing, Inc. and Peter
Jones and Helen Jones. Upon review by Blue Earth
County and Ross Arneson, County Attorney, no adverse
findings or concerns regarding, but not limited to, tax
liens, judgements, court actions, and filings with
state, federal and other regulatory agencies were
identified. Failure to disclose any such adverse
information could result in revocation or other legal
action.
NOW, THEREFORE BE IT RESOLVED that Board Chairperson is
hereby authorized to execute such agreements as are
necessary to implement the project(s) on behalf of the
applicant.
And the following Resolution:

The motion carried. 96-15
Mr. Mike McGuire, Juvenile Corrections Supervisor, presented
the following items for the Boards consideration. Commissioner
Barnes moved and Commissioner Tacheny seconded the motion to
approve the Group Home Contract and the Group Home Real Estate
Lease Agreement. Both are effective January 1, 1996 through
December 31, 1997. The motion carried. 96-16
Commissioner Barnes moved and Commissioner Tacheny seconded
the motion to continue membership in the Minnesota Transportation
Alliance and pay double the annual dues which would be $2,680.00
and drop membership to Southwestern Minnesota Highway Improvement
Association and have their allocation go toward the increase to
the Alliance's dues. The motion carried. 96-17
Commissioner Barnes moved and Commissioner More seconded the
motion to adjourn at 11:17 a.m. The motion carried. 96-18
The annual meeting of the Blue Earth County Regional
Railroad Authority was held on January 2, 1996 at 11:18 a.m. in
the Board Room, Blue Earth County Courthouse, Chairperson
Tacheny called the meeting to order.
Attending were Commissioners Leon Tacheny, Colleen
Landkamer, Linley Barnes, Alvis More, Al Bennett, and Executive
Director David Twa.
Motion was made by Commissioner Landkamer and Seconded by
Commissioner Bennett to approve the minutes of the meeting of
January 3, 1995. The motion passed with all members voting aye.

Motion was made by Commissioner Barnes and seconded by
Commissioner Bennett to elect as officers of the Railroad
Authority the following individuals for the calendar year 1996:

The motion passed with all members voting aye. 96-20
There being no further business, motion was made by
Commissioner Bennett and seconded by Commissioner More to
